An Act to amend an Act paffed in the prefent Seffion of Par-
liament, intituled An Act to carry into Effect a Convention of
Commerce concluded between His Majefty and the United States
of America.
[20th June 1816.]

WHEREAS an A&t was paffed in the prefent Seffion of Par

liament, intituled An Ad to carry into Effect a Convention 56 G. 3. c. 15.

of Commerce concluded between His Majefty and the United States of America: And Whereas the faid Act does not contain any • Provision for permitting Veffels of the faid United States of Ame'rica to clear out from the Ports of the United Kingdom to any of the British Settlements in the Eaft Indies: And Whereas it is ex'pedient that Veffels built in the Countries belonging to the United States of America, or any of them, or taken by any of the Ships 'or Veffels of War belonging to the faid Government, or any of the Inhabitants of the faid States having Commiffions or Letters of Marque and Reprizal from the Government of the faid States, and ⚫ condemned as lawful Prize in any Court of Admiralty there, fuch • Ship or Veffel being owned by a Subject or Subjects of the faid States, or any of them, and whereof the Mafter and Three fourths of the Mariners are alfo Subjects of the faid States, should be al'lowed to clear out from any Part of the United Kingdom for the • principal Settlements of the British Dominions in the Eaft Indies, • videlicet, Calcutta, Madras, Bombay, and Prince of Wales's Ifland, with any Articles which may legally be exported from the United Kingdom to the faid Settlements in British built Ships;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, all Veffels built in Veffels built in the Countries belonging to the United States of Ame- the United rica, or any of them, or taken by any of the Ships or Veffels of War belonging to the faid Government, or any of the Inhabitants of the faid States, having Commiffions or Letters of Marque and Reprizal from the Government of the faid States, and condemned as lawful Prize in any Court of Admiralty there, fuch Ship or Veffel being owned by a Subject or Subjects of the faid States, or any of them, and whereof the Master and Three fourths of the Mariners are alfo Subjects of the faid States, fhall be allowed to clear out from any Port of the United Kingdom for the following principal Settlements of the British Dominions in the Eaft Indies, videlicet, Calcutta, Madras, Bombay, and Prince of Wales's Island, with any Goods, Wares or Merchandize which may be legally exported from the United Kingdom to the faid Settlements in British built Veffels, fubject to the like Rules and Regulations, Restrictions, Penalties and Forfeitures as are now by Law impofed upon the Exportation of fuch Goods to the faid Settlements in British built Ships; any Law, Cuftom or Ufage to the contrary notwithstanding.

II. And be it further enacted, That this Act fhall continue in Continuance of force fo long as the Convention between His Majesty and the United Act. States of America fhall continue in force.

WHEREAS an Act was paffed in the laft Seffion of Parliament, intituled An Act for enabling Spiritual Perfons to exchange the Parfonage or Glebe Houfes or Glebe Lands belonging to their Benefices for others of greater Value or more conveniently fituated for their Refidence and Occupation, and for annexing fuch Houfes and Lands fo taken in Exchange to fuch Benefices as Parfonage or Glebe Houfes and Glebe Lands, and for purchafing and annexing Lands to become Glebe in certain cafes; and for other Purpofes: And Whereas it is expedient to authorize the Incumbents of Benefices, Perpetual Curacies, and Parochial Chapelries to apply the Monies arifing from the Sale of any Timber cut from the Glebe or other Lands of their refpective Benefices, Perpetual Curacies, or Parochial Chapelries, towards the Purposes of the faid recited Act:' May it therefore pleafe Your Majefty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall and may be lawful for the Incumbent of any Benefice, Perpetual Curacy or Parochial Chapelry, with the Confent of the Patron of fuch Benefice, Perpetual Curacy or Parochial Chapelry, and of the Bishop of the Diocefe wherein the fame is locally fituate, or of the Archbishop or Bishop to whom the Peculiars wherein fuch Benefice, Perpetual Curacy or Parochial Chapelry is fituate fhall belong, (fuch Confent to be fignified in manner as in the faid recited Act is mentioned,) to pay and apply the Monics to arife by Sale of any Timber cut and fold from the Glebe Lands of fuch Benefice, Perpetual Curacy or Parochial Chapelry, or from any other Land, whether Copyhold, holden under any Manor of fuch Benefice, Perpetual Curacy or Parochial Chapelry, or otherwife, the Timber whereof belongs to fuch Benefice, Perpetual Curacy or Parochial Chapelry, either for Equality of Exchange, or towards and in Part of Equality of Exchange, or for the Price or Purchase Money, or towards and in Part of the Price or Purchase Money of any Houfe, Outbuildings, Yards, Gardens and Appurtenances, or any Lands, or any or either of them, by the faid recited Act authorized to be taken in Exchange or to be purchased, and from and after fuch Exchange or Purchase to be annexed to and to be and become the Parfonage and Glebe Houfe and Glebe Lands and Premifes of fuch Benefice, Perpetual Curacy or Parochial Chapelry, as in the faid recited Act is mentioned.

II. And Whereas it is by the faid recited Act enacted, that the Bishop fhall in cafes of Exchange and Purchase under the said Act iffue a Commiffion of Inquiry for the Purpofes therein mentioned, to be directed to fuch Perfons as are therein defcribed, and of whom • One shall be a Barrister of Three Years' Standing at the leaft, to be named by the Senior Judge of Nifi Prius for the County in

which the Benefice, Perpetual Curacy or Parochial Chapelry, whereto it shall be proposed to annex any Buildings or Land by • Exchange or Purchase under the faid Act fhall be fituate; but inafmuch as the Nomination of fuch Barrister by a Judge of Nifi Prius is not applicable to the County Palatine of Chefter nor to the Principality of Wales; Be it therefore enacted, That where any Exchange or Purchase shall be made or be proposed to be made under the Authority of the faid Act in any Benefice, Perpetual Curacy or Parochial Chapelry, fituate within the faid County Palatine of Chefter, or within the faid Principality of Wales, fuch Barrifter fhall be named by the Chief Juftice for the time being of the faid County Palatine of Chefter or by the Justice, or, in cafe of his Abfence, the other Juftice of the Great Seffions for thofe Counties within the faid Principality of Wales, within which faid County Palatine or respective Counties of the faid Principality of Wales the faid Benefice, Perpetual Curacy or Parochial Chapelry, fhall be fituate.

CAP. LIII.

An Act to amend and render more effectual Three several Acts paffed in the Forty eighth, Forty ninth, and Fifty fecond Years of His prefent Majefty, for enabling the Commissioners for the Reduction of the National Debt to grant Life Annuities. [20th June 1816.]

HEREAS an Act paffed in the Forty eighth Year of the 48 G. 3. c. 142.-
Reign of His present Majefty, intituled An Ad for enabling

the Commiffioners for the Reduction of the National Debt to grant

Life Annuities: And Whereas another Act paffed in the Forty 49 G. 3. c. 64. • ninth Year of His prefent Majesty, intituled An Act to amend an Act paffed in the laft Seffion of Parliament, for enabling the Commiffioners for the Reduction of the National Debt to grant Life Annuities:

And Whereas another A&t paffed in the Fifty fecond Year of the 52 G. 3. c. 129. Reign of His present Majefty, intituled An Act for amending Two Aas paffed in the Forty eighth and Forty ninth Years of His prefent Majefty, for enabling the Commiffioners for the Reduction of the National Debt to grant Life Annuities: And Whereas it is expedient that the faid Acts fhould be amended, and further Provisions made ⚫ for rendering the fame more effectual:' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament assembled, and by the Authority of the fame, That it fhall be lawful for the Commiffioners under the faid recited Acts, and they are hereby empowered to accept and receive the Transfer of any Ámount not lefs than Four Pounds per Annum (nor any Fractional Parts of a Pound) of Annuity, commonly diftinguifhed and known by the Name of Long Annuity, in lieu and inftead of Three Pounds per Centum Confolidated or Reduced Bank Annuities, as the Confideration for the Purchase of Life Annuities, under the Provifions, Limitations and Restrictions in the faid recited Acts contained; and the Amount of Long Annuity to be accepted and taken in lieu and instead of Three Pounds per Centum Confolidated or Reduced Bank Annuities, for any Life Annuity or Annuities, fhall be afcertained and regulated by fuch Prices and Proportions of Long Annuities to be accepted in lieu of Three Pounds per Centum Annuities,

Commiffioners may accept Long Annuities inftead of 31. per Cents, as the Confideration of Life Annuities.

Any Perfons may purchase Annuities on Lives of Nomi

as fhall be published in the London Gazette by the said Commiffioners; provided that fuch Amount, and any Change thereof, from time to time shall be published by such Commiffioners in the London Gazette from time to time, when and fo often as they fhall deem it expedient and fit.

II. And be it further enacted, That in cafe any Person who shall have been named as a Nominee, on the Continuance of whofe Life any Annuity under the said recited A&t is to depend, fhall, after his or her Nomination, become refident in any Kingdom or State in Europe in Amity with His Majefty, or if he or fhe fhall become refident in any other Kingdom, State or Place beyond the Seas, then and in every fuch cafe, a Certificate that fuch Nominee was living on the Day fpecified therein (being fome Day after any Annuity depending upon his or her Life fhall have become due) granted under the Hand and Seal of the Chief Magiftrate of any City, Town or Place, or any other Magiftrate acting at the time as fuch, or for and in the Place of any fuch Chief Magiftrate, where fuch Nominee may be then living, fhall be deemed fufficient and effectual for proving the Continuance of the Life of such Nominee, under the Provifions of the faid recited Acts, and for the Purpose of enabling the Perfon entitled to the Annuity dependant upon the Life of fuch Nominee to receive the fame; provided no British Minifter or Conful, or Governor or Perfon acting as fuch, fhall be refident in fuch City, Town or Place, although a British Minifter or Conful, or Governor or Perfon acting as fuch, may be refident in the Kingdom, State or Settlement wherein fuch Nominee fhall be then living, any thing in the faid Acts to the contrary notwithstanding.

III. Provided always, and be it further enacted, That to every fuch Certificate as aforefaid there fhall be annexed an Affidavit or folemn Affirmation, made before any Juftice of the Peace or Magiftrate in England or Scotland refpectively, or if in Ireland before One of the Barons of the Exchequer there, by the Perfon or Perfons entitled to the faid Annuity, or by the Perfon applying to receive the fame on his, her or their Behalf, that the Matters contained in fuch Certificate are, to the best of his or her Belief, true; and that the Perfon defcribed or certified therein is the Nominee or One of the Nominees on whofe Life or Lives the Annuity whereof such Half yearly or other Payment shall be claimed doth depend.

IV. And Whereas Perfons who have purchased Annuities under the Provifions of the faid recited Acts, upon the Life or Lives of Nominees, may purchase further Annuities on the fame Life or Lives, without new Certificates; and it may tend to facilitate the granting Life Annuities under the faid Act, if other Persons were alfo allowed to purchase Annuities upon any fuch Life or Lives, without new Certificates ;' Be it therefore enacted, That it shall be lawful for any Perfon or Perfons, upon transferring or caufing to be transferred to the faid Commiffioners either Confolidated or Reduced Bank Annuities, or Long Annuities, to purchase any Annuity, or Annuity on the Life of any One Nominee, or on the Lives of any fresh Certificates. two Nominees, and the Life of the longer Liver of them, whofe Age shall have been already certified and verified under the Provifions of the faid recited Acts, without any View, or additional Certificate or Certificates of the Age or Ages of fuch Nominee or Nominees: Provided always, that in every fuch cafe an Affidavit or folemn

Affirmation

Affirmation as to the Identity of fuch Nominee or Nominees, shall
be made by the Purchaser of the Annuity or Annuities, or by fome
Perfon on his or her Behalf, before fuch and the like Perfons as are
fpecified and required in and by the faid first recited Act, in cafes
wherein Copies of the Birth or Baptifm of any Nominee or Nominees
is or are required to be produced under the Provifion of the faid A&t,
any thing in the faid recited Acts to the contrary notwithstanding.
V. And be it further enacted, That it fhall be lawful for the faid
Commiffioners, in any cafe in which any Long Annuity fhall be
accepted and taken as the Confideration for any Life Annuity or
Annuities, in lieu and inftead of Three Pounds per Centum Confoli-
dated or Reduced Bank Annuities, to use for the Purpose of carry-
ing the faid Acts into Execution the Forms of Declarations and
Certificates in the Schedule to the First recited Acts annexed,
with fuch Alterations and Variations as may be neceffary to adapt
fuch Forms to the nature of the cafe, and the Acceptance of Long
Annuity as the Confiderations inftead and in lieu of Three Pounds
per Centum Confolidated or Reduced Bank Annuities, any thing in
the faid recited Acts to the contrary notwithstanding.

CAP. LIV.

An Act for raifing the Sum of Thirteen Millions by Exchequer Bills, for the Service of Great Britain, for the Year One thoufand eight hundred and fixteen.

rectors of all Works relating to Inland Navigation in
Ireland.
