LOCAL LAW No. 4

A local law amending local law number three, entitled "A local law regulating and restricting the location of trades and industries and the location of buildings designed for specified uses, and regulating and limiting the heights of buildings hereafter erected, and regulating and determining the area of yards, courts and other open spaces surrounding buildings and establishing the boundaries of districts for said purposes and providing penalties for the violation of its provisions, by placing certain property situated on the northerly side of Ponfield Road West in a "B" area district.

Be it enacted by the common council of the city of Yonkers as follows:

ARTICLE I.

Section 1. The property known and designated on the official maps of the city of Yonkers as lots numbers 25, 27, 29, 30, 31, 32, 33, 36 and parts of 38 and 39 in block 5660, section five, as more particularly appears on a certain map filed in the office of the city clerk, March tenth, nineteen hundred and twenty-five, shall hereforth be in a "B" area district as said district is defined in local law No. -, nineteen hundred and twenty-five, and said property shall be subject to the rules and restrictions placed upon property in a "B" area district and residential use district as specified and defined in said local law.

§ 2. That the map filed with said local law shall be deemed amended and modified in conformity with the provisions of this ordinance.

§ 3. This law shall become effective upon approval by the mayor.

LOCAL LAW No. 5

A local law fixing the time of opening and closing polls on days on which special elections are held in the city of Yonkers pursuant to provisions of chapter four hundred and forty-four of the laws of nineteen hundred and fourteen.

Became a law May 13, 1925, with the approval of the Mayor. Passed by the local legislative body of the city of Yonkers.

Be it enacted by the common council of the city of Yonkers as follows:

Section 1. Time of opening and closing polls. The polls of every special election held in the city of Yonkers pursuant to provisions of chapter four hundred and forty-four of the laws of nineteen hundred and fourteen, shall be opened at six o'clock in the forenoon and shall close at nine o'clock in the evening on days on which such elections are held. In the event that a special election

shall be held in the period when daylight saving time shall be in force and effect, the hours herein stated shall be computed in accordance with daylight saving time. There shall be no adjournment or intermission until the polls are closed. Electors entitled to vote who are in the polling places at or before nine o'clock in the evening shall be allowed to vote.

§ 2. This local law shall take effect upon the approval of the mayor after a public hearing shall be held thereon.

LOCAL LAW No. 6

A local law in relation to establishing a department of buildings and defining its powers and duties.

Became a law December 28, 1925, with the approval of the Mayor. Passed by the local legislative body of the city of Yonkers.

Be it enacted by the common council of the city of Yonkers as follows:

Section 1. A department of buildings in and for the city of Yonkers is hereby established. The head of such department shall be a superintendent of buildings to be appointed by the mayor for a term of five years. Such superintendent may be removed by the mayor for incompetency, neglect of duty, or misconduct or malfeasance in office. Such department of buildings shall be deemed for all purposes the successor of the existing bureau or department of buildings of the city, and, upon the appointment of a superintendent of buildings as herein provided, the tenure of the present superintendent of buildings, heretofore appointed by the commissioner of public safety, shall terminate.

§ 2. The department of buildings hereby created shall have all the powers and duties of the bureau or the department of buildings of the city, existing at the time this local law takes effect, and all other powers and duties vested by law or ordinance in the office of superintendent of buildings, or in the office of inspector of buildings, in so far as the same apply to the city of Yonkers.

§ 3. The superintendent of buildings, if authorized by the board of estimate and apportionment, may appoint, and at pleasure may remove, a deputy superintendent of buildings, who shall perform such duties as the superintendent shall prescribe, and, in the absence or disability of the superintendent, or during a vacancy in the office of superintendent, shall discharge the duties of the office until the superintendent returns, the disability ceases or the vacancy is filled.

§ 4. The offices of inspector of buildings and of assistant inspector of buildings, as established by section two of article two of chapter four hundred and fifty-two of the laws of nineteen hundred and eight, are continued; and such officers shall continue to be appointed as provided therein, but hereafter shall

be within the department of buildings, subject to the jurisdiction and control of the superintendent of buildings.

§ 5. All persons now employed, pursuant to the civil service law, by the inspector of buildings, or as subordinates in the building bureau or building department of the city, are transferred without change of status, grade or salary to the department of buildings established by this local law. The superintendent of buildings shall also appoint such other employees as may be authorized by the board of estimate and apportionment. § 6. All the books, records, papers, documents, and other property in the offices of the existing bureau or department of buildings of the city shall belong to the department of buildings hereby created, and, upon the requisition of the superintendent of buildings appointed appointed as herein provided, shall be turned over accordingly.

§ 7. The superintendent of buildings, by and with the advice of the corporation counsel, is authorized, in the name of the city, to maintain actions to restrain the threatened or continued performance of any act contrary to his orders, directions or decisions or of any rule or regulation of the department of buildings, or of any law or ordinance affecting or relating to the construction, alteration, repair or removal of buildings and structures, and to restrain and abate nuisances caused by the defective or unsafe condition of buildings or other structures dangerous to life, person or property; and for the purpose of obtaining a temporary injunction in any such action no undertaking shall be required. But this section shall not confer on the superintendent of buildings jurisdiction over any matter or subject within the jurisdiction of the commissioner of health or the commissioner of public works of the city.

§ 8. This local law shall not affect any action, proceeding or appeal now pending, nor prejudice or affect any notice or order heretofore given or made.

§ 9. This local law shall supersede as to the city of Yonkers the provisions of section one hundred and thirty of the second class cities law prescribing the appointment of a superintendent of buildings by the commissioner of public safety, the provisions of sections one hundred and thirty-one, one hundred and thirtytwo and one hundred and thirty-three of such law in so far as they confer on the commissioner of public safety, or deputy commissioner of public safety any jurisdiction over the superintendent of buildings or the building department of the city, and the provisions of section one hundred and fifty-two of such law, authorizing the commissioner of public safety to maintain certain actions in relation to buildings.

§ 10. This local law shall take effect immediately.
