Chap. 79.

AN ACT authorizing a grant of half an acre of land in lot fifty-one, Stirling, to the trustees of the Free Will Baptist Church, and their successors, in the town of Wolcott, Wayne county.

Passed March 17, 1860; by a two-third vote. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The commissioners of the land office are authorized and directed to grant to the trustees of the Free Will Baptist Church, in Wolcott, Wayne county, half an acre of land, which was reserved to the people of the state out of a tract of fifty-four acres, sold to John Ford by the surveyor general, September thirteen, eighteen hundred and forty-two, which said fifty-four acres was part of lot fifty-one, in the township of Stirling. 52. This act shall take effect immediately.

Chap. 80.

AN ACT to amend chapter four hundred and sixty-four of the Laws of eighteen hundred and forty-seven.

Passed March 17, 1860; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section one of chapter four hundred and sixty-four of the Laws of eighteen hundred and fortyseven, is hereby amended so as to read as follows:

to authorize such applicant to assume another name. If said applicant be a minor he shall apply by guardian or next friend.

S2. Section three of said chapter is hereby amended so as to read as follows:

If the court to which such application shall be made shall be satisfied by such petition, so verified, or by affidavits presented, that there is no reasonable objection that such person should assume another name, such court shall make an order authorizing such applicant to assume such other name, from and after some time not less than thirty days, to be specified in such order. It shall be the duty of the county clerks for the several counties of this state, except the city and county of New York, and of the clerk of the court of common pleas for the city and county of New York, annually, in the month of December, to make a return to the office of the secretary of state of all changes of names of persons made under and by virtue of this act; and the names of such persons before and after such changes, as the same shall appear in such returns shall be published in a tabular form with the Session Laws of each year.

AN ACT authorizing the commissioners of highways of the town of North Hempstead, in Queens county, to regulate the highways in the eleventh road district in said town.

Passed March 17, 1860; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The commissioners of highways of the town of North Hempstead, in Queens county, are hereby highways in authorized and empowered to ascertain, describe, lay out, Hempstead, regulate and enter of record, in pursuance of the act Queens Co. entitled "An act regulating highways and bridges in the counties of Suffolk, Queens and Kings," passed February

twenty-third, eighteen hundred and thirty, and the acts amendatory thereof, so much of the existing public highways in the eleventh road district of said town, as lie to the south of the North Hempstead and Flushing turnpike, commencing where the said highway intersects the aforesaid turnpike, on the westerly side of the village of Roslyn, and extending around said village until the said highway again intersects the aforementioned turnpike on the easterly side of the said village of Roslyn, so that the same shall be of such width as the said commissioners shall decide upon; provided, however, that the same shall not be of less width, in any part thereof, than they are now open and used, and shall in no part thereof be less than two rods wide.

2. So much of the provisions of the acts referred to in the first section of this act as require the public highways in the counties of Suffolk, Queens and Kings, to be not less than three rods in width, shall not apply to that portion of the highways in said town of North Hempstead described in the first section of this act. 3. This act shall take effect immediately.

Chap. 82.

AN ACT to authorize the surviving trustees of the
First Wesleyan Methodist Church, of Keeseville,
to convey certain premises to Jacob Blaisdell, of
Keeseville.

Chap. 83.

AN ACT to consolidate and amend the several acts relating to the village of Warsaw, and to enlarge the powers of the corporation of said village.

Passed March 17, 1860; three-fifths being present. -The People of the State of New York, represented in Senate and Assembly, do enact as follows:

TITLE I.

OF THE BOUNDARIES OF THE VILLAGE OF WARSAW.

SECTION 1. The territory embraced within the following bounds, that is to say: Beginning on the north line of lot number twenty-nine, in the town of Warsaw, twenty chains east from the northwest corner thereof; thence south, parallel with the west line of lots number twenty-nine and twenty-eight, to the south line of said lot number twenty-eight; thence west on the south line of lots number twenty-eight and thirty-six, sixty-five chains; thence north parallel with the east line of lots number thirty-six and thirty-seven, to the north line of said lot number thirty-seven; thence east on the north line of lots number thirty-seven and twenty-nine, sixtyfive chains, to the place of beginning, shall constitute the village of Warsaw and the boundaries thereof.

TITLE II.

OF THE NAME AND CHARACTER OF THE CORPORATION.

SECTION 1. The inhabitants resident within the territory aforesaid, are a municipal corporation, and shall hereafter be known in law by the corporate name of "The village of Warsaw," and by that name they and their successors

shall have perpetual succession; shall be capable of suing and being sued, complaining and defending. in any court; may make and use a common seal and alter the same at pleasure; and shall have power to hold, purchase and convey such real and personal estate as the purposes of the corporation may require.

TITLE III.

OF THE OFFICERS OF THE VILLAGE, THEIR ELECTION AND
APPOINTMENT.

SECTION 1. The officers of the village shall all be elected Offloors. by ballot by the electors of said village, and hold their offices respectively, as hereinafter mentioned, and until their successors shall be duly qualified, and shall be six trustees (one of whom shall. be president of the board of trustees), to be classified in three classes, for one, two and three years, so that two trustees shall be elected at each annual meeting after the first, in the place of those whose term of office shall expire; also one treasurer, one clerk, one police constable, who shall also be collector of taxes and assessments, and three assessors, who shall hold their respective offices one year.
