CHAP. 348.-AN ACT extending, for a certain period, and with certain limitations, the Charter of the old Bank of Kentucky.

Whereas, the term for which the charter, or act of incorporation, of the Bank of Kentucky, which by its limitation, would have expired on the thirty-first day of December, 1835, has been extended, by an act of the present general assembly, until the first day of May, ensuing: and, whereas, it is deemed expedient, as well as just and proper, to enable the said bank to close its concerns, by the payment of own debts as well as the collection of the debts due to the said corporation, and for the final disposition of its real estate, which it has acquired, or may acquire, in the pursuit of its lawful business: Wherefore,

SEC. 1. SEC. 3. SEC. 4. SEC. 5. It shall be the duty of said board, whenever the funds collected by the commissioner shall amount to one per centum (or one dollar per share,) on the amount of the stock held in said institution, after deducting the necessary expenses for collecting, &c., (and the amount of his commission, as hereinafter provided) to declare a dividend or distribution of the same amongst the stockholders, which said commissioner shall pay to the individual entitled thereto, on application, as well as to the treasurer of this commonwealth, for its proportion of such dividend or distribution: Provided, That said board shall divide and distribute all the funds in their hands on the first February, eighteen hundred and thirty-eight, amongst said stockholders and the trea

SEC. 6. The president of said bank, acting as Salary of com- commissioner, shall be allowed a commission of three per centum on all moneys collected and paid over by him, in full and in lieu of all salary or compensation heretofore allowed him: Provided, The amount to be allowed the president for his compensation shall not, in any one year, exceed the sum of nine hundred dollars. And the directors and treasurer shall each be allowed the sum of two dollars per day, for each and every day they shall be employed in the discharge of the duties enjoined on them by this act.

SEC. 8. SEC. 9. SEC. 13. Be it further enacted, That said president is hereby required to make examination of the books of said bank, at the request of any person, and application & give copies from the records of the bank, which, when certified by said president, shall be evidence in all courts in the state; and for said examination and copy, in each case, the president shall receive, from the party applying for the same, the sum of seventy-five cents. This act shall be in force from and after its passage.

CHAP. 350.-AN ACT to authorize certain county courts to ap point constables and magistrates.

SEC. 1.
