SEC. 6. That said company shall have power and
authority to construct a turnpike road from Hardins- powers.
burg to Cloverport, on the Ohio river, in Brecken-
ridge county, and for that purpose, may contract and
be contracted with, sue and be sued, plead and be
impleaded, and have a common seal, and alter the
same at will, and shall be entitled to all the rights,
tolls, privileges and immunities vested by law in the
board of internal improvements for the county of
Shelby, subject to the like limitations and restric-
tions, in every particular, to the beneficial interest,
as if the same was here again repeated and re-
enacted, except as herein otherwise provided for.

CHAP. 336.-AN ACT to incorporate a company to turnpike the
road leading from Elizabethtown to Bardstown, and for other
purposes.

SEC. 1. Be it enacted by the General Assembly of
Company in-
the Commonwealth of Kentucky, That a company corporated.
shall be, and the same is hereby established and in-
corporated, with a capital stock of one hundred and
fifty thousand dollars, to be divided into fifteen hun-
dred shares of one hundred dollars each, to construct
a turnpike road from Elizabethtown, in Hardin
county, to Bardstown, in Nelson county, under the
-style of the Elizabethtown and Bardstown Turnpike
Road Company, and as such, shall be a body politic
and corporate forever, and by that name and style Corporate
shall be capable to contract and be contracted with, powers.
to sue and be sued, plead and be impleaded, answer
and be answered, defend and be defended, in all courts
and places, with full power and authority to acquire,
hold, possess, occupy, and enjoy, and the same to sell
and convey, all such real and personal estate as shall
be necessary and convenient for the site or route of
said road, and for piers, abutments, and all and every
bridge that shall be required on said road, and all such
toll houses and residences of the gate keepers, the
necessary stone quarries for the construction and re-
pairs of said road, and all other things that shall or
may be required in the construction and repairs
thereof; and to have and to use a common seal, and

the same to alter and renew at pleasure; and to make, establish, and put into execution all such bylaws as may be proper for the construction, formation and repairs of said road, and the management and direction of its prudential concerns, not contrary to the laws of this commonwealth.

SEC. 2. That the width of said road shall not be less than fifty, nor more than sixty feet, except on the sides of hills, where the ground will not reasonably permit of that width, and the artificial or paved part not less than sixteen feet wide, and made on one side, if the president and directors shall prefer it; that said road shall be graded to two degrees, and the Rolling fork shall be bridged if practicable.

SEC. 3. That Samuel Carpenter, John Strother, Subscriptions Samuel Belmere, Daniel Cotton, Joseph Harned, and William Johnson, of Nelson county; Washington R. Lucas, Handley Cunningham, John S. Cully, Hance Hamilton, William Quinn, and Anthony Vernon, of Hardin county, are hereby appointed commissioners to open books at such time and place, or such times and places, as they, or any three of them, may deem expedient for the subscription of stock in the company; and whenever three hundred shares shall be subscribed, the said commissioners, or any three of them, may close the books, and call a meeting of the stockholders, at such time and place as they may deem convenient, first advertising the time and place of meeting in one or more of the newspapers printed in Bardstown or Elizabethtown; and the stockholders shall choose a president and six managers, in whom shall be vested all the powers of the corporation for the construction of said road, and the management and direction of its prudential concerns. being may supply any vacancy which may arise in their own body, from any cause; and whenever any annual election shall fail to take place on the first Monday in July in any year, the president and managers may direct and advertise an election on any other day they may think fit.

SEC. 4. That the president and managers of the Vested with Bardstown and Elizabethtown turnpike road company the Louisville the powers of shall be vested with all the powers, authorities, immunities, tolls, privileges and advantages, in all and every respect, that are now vested by law in the Louisville turnpike company, subject to the like limitations and restrictions, as if they were herein embodied and repeated, except so far as they are modified in this act. SEC. 5. That the president and managers may, at May sell resi any time after the organization of the company, open the books and sell the residue of the stock, but not for less than par. So soon as five miles of the said road shall be completed from Elizabethtown in the direction to Bardstown, or from Bardstown in the direction to Elizabethtown, it shall be lawful to construct gates and charge toll for so much of the road thus completed, and so on for each and every successive five miles, as it becomes completed as aforesaid; and also it shall be lawful to charge double toll at one gate nearest the bridge to be constructed across the Rolling fork, which said last mentioned toll shall, from time to time, be under the regulation and control of the general assembly of the commonwealth of Kentucky.

CHAP. 337.-AN ACT to incorporate a company to construct a Turnpike Road from Elizabethtown to Greensburg, by the way of Hodginsville and Summersville.

SEC. 1. Be it enacted by the General Assembly of the Style of the Commonwealth of Kentucky, That a company shall company. be formed, under the name and style of the Elizabethtown and Greensburg turnpike road company, for the purpose of constructing a turnpike road from the town of Elizabethtown in Hardin county, by the way of Hodginsville and Summersville, to Greensburg in Green county.

SEC. 2. That the capital stock of said company shall be one hundred and fifty thousand dollars, to Capital stock. be divided into shares of one hundred dollars each; and if it shall be ascertained that the amount of capital stock is not sufficient to accomplish the object of this act, then the president and directors of said company may enlarge it to such amount as they may deem necessary, and open subscription therefor, in such manner as they may think proper.

SEC. 3. That books for the subscription of stock in Subscriptions said company shall be opened on the third Monday in April next, or as soon thereafter as convenient, at the town of Greensburg, Green county, under the direction of John P. Little, William Porter, William Hobson, James D. Mottley and William D. Barrett; at Summersville, under the direction of Leonard Mudd, Edward C. Fitzpatrick, William Barrett, and William Richardson; at Hodginsville, under the direction of Lloyd Harris, Cadwalader Churchill and John C. Ray; at Elizabethtown, under the direction of William Allen, John L. Helm, James Crutcher, Samuel Haycraft, John S. Cully and Thomas Patton; at Columbia, under the direction of William Caldwell, Benjamin Bell, John Miller, Asa Pittman, John D. Winston and Edmund M. Waggener; at Lexington, under the direction of Joseph Ficklin, Robert Wickliffe, Daniel Bradford, Aaron K. Woolley and George Norton; at Louisville, under the direction of Thomas Joyes, Charles M. Thurston, Levi Tyler, William Pope, William Garvin, Walker Alsop, James Guthrie and Thomas Q. Wilson; at Munfordsville, under the direction of James Murray, Benjamin T. Edmundson, George T. Wood, Noah A. Smith, James M. Gardner, and Jesse Craddock, or some two or more of them at each place, who are appointed commissioners; the said commissioners, for each place, shall procure a book or books, and the subscribers to the stock of said company shall enter into the following obligation in said books, to-wit: We, whose names are hereunto subscribed, promise to pay to the presi dent, directors and company of the Greensburg and Elizabethtown turnpike road company, the sum of one hundred dollars, for each share of stock in said company, set opposite our names, in such manner and proportion, and at such times, as we shall be required by the president of said company, and

CHAP. 339.-AN ACT to amend the Charter of the city of Cor.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That so much of Laws repeal the charter of the city of Covington as provides for the election of the mayor of said city by the people; and so much also of said charter as provides that the mayor of said city shall be the chief executive officer of said city; and so much of said charter as providesthat the mayor shall preside over the deliberations of the council of said city, be, and are hereby repealed.

SEC. 2.
