A. D. 1811. BE it enacted by the people of the state of New? York, represented in Senate and Assembly, That it

shall be lawful for the said Johannes Martinus Van Harlingen, and the other heirs of the said Peter S. Van Harlingen, to execute a good and sufficient deed of conveyance for the aforesaid one hundred acres of land in said lot number ninety-nine to the said Abraham Brokaw, his heirs and assigns forever; and that it shall be lawful for the said Abraham Brokaw to execute a like deed of convevance for the aforesaid one hundred acres of land in said lot number eighty-four, to the heirs of the said Peter S. Van Harlingen, their heirs and assigns forever, and that upon the execution and delivery of said deeds, the same shall be as good and effectual in law and equity to all intents and purposes as if the said Johannes was of full age.

CHAP. CCXLI.

An ACT to appoint Commissioners to lay out a road in the county of Montgomery.

Passed April 9th, 1811.

1. BE it enacted by the people of the state of NewYork, represented in senate and assembly, That John Herkimer, Thomas Sammons and Charles Newkirk be and are hereby appointed commissioners, with full powers, (if they shall deem it proper and necessary) to lay out a public road in as direct and convenient a route as the face of the country will admit, from Salisbury meeting-house to Luther Pardees, on the Mohawk turnpike road, in the county aforesaid; and it shall be the duty of the said commissioners after having laid such road, to make or cause to be made an accurate map of the survey of the said road, and deliver the same to the clerks of the several towns through which the said road shall run, and it shall be the duty of the said clerks to record the same; and when so recorded, the said road shall be opened and kept in repair in the same manner as all other public highways are opened and kept in repair; and all damages which shall accrue in consequence of laying such road shall be assessed and paid in the same manner as is directed by the act entitled "An act to regulate highways," and the acts amending the same.

II. And be it further enacted, That the said com- A. D. 1811. missioners shall receive for their services the sum of two dollars per day, to be paid by the inhabitants who have petitioned for such road, together with the costs of surveying the same.

An ACT supplementary to the act entitled "An act relative to the lot of land appropriated for the use of the Missionary to the Oneida tribe of Indians, and for other purposes." HEREAS it is made the duty of the districtattorney residing in the county of Washington to advise and direct the Saint Regis Indians residing at St. Regis, in the controversies among themselves, and with any other person, and defend all actions brought against any of them by any white person, and commence and prosecute all such actions for them or any of them, as he may find proper and necessary.

An ACT to lay out and improve a road running_southerly from the house of Thomas Stevens, in the town of Fort-Ann, through the States' land opposite to the north line of Campbell's patent, and for other purposes. Passed April 9th, 1811. V. VI. And be it further enacted, That the treasur $800 to be er, on the warrant of the comptroller, shall pay to building a such person as the surveyor-general shall appoint, the bridge over sum of eight hundred dollars for the purpose of erecting a good and sufficient bridge across the waters of the out-let of Lake George, near the lower falls, where the old bridge formerly stood, known by the name of the long bridge, which monies shall be expended by said person for that object, for which services the said person so appointed shall receive two dollars per day for his services out of the aforesaid monies; and before he enters on the duties of his office he shall enter into bonds to the people of this state in double the amount of the sum appropriated, which shall be approved of by the comptroller and deposited in his office.

VII. And be it further enacted, That Sylvanus appointed Smalley, and Zebulon Douglass, of the county of to build a Madison, be and they are hereby appointed commisthe Oneida sioners for the purpose of building a bridge across the Chittenengo creek, and also a bridge across the Oneida creek, on the road commonly called the state road, extending from the house now or late of Martin Langdon, in the town of Verona, in the county of Oneida, to the Genesee river, part of which road was laid out by James Geddes and Zebulon Douglass pursuant to the act entitled "an act authorising cominissioners to lay out certain great roads within this state," passed the 8th day of April, 1808, and the residue of said road was laid out by Philetus Swift, Asa Rice and William Rogers, pursuant to an act of the 27th day of March, 1809.
