III. And be it further enacted, That the company Rates of toB hereby incorporated shall be entitled to exact and receive at each of the gates or turnpikes to be erected on the said road, for any number of miles not less than ten in length of the said road, the following rates of toll, and so in proportion for any greater or less distance, from all persons travelling and using said road, that is to say for every score of hogs or sheep, eight cents; for every score of cattle, horses or mules, twenty cents; for every chair, sulkey or chaise with one horse, twelve and an half cents; for every horse rode, four cents; for every led or driven horse, three cents; for every cart drawn by one horse, six cents; for every chariot, coach, coachee or phaton, twenty-five cents; for every four wheeled carriage drawn by two horse, mules or oxen, twelve and an half cents, and three cents for every additional horse, mule or ox; for every cart drawn by two oxen, twelve and an half cents, and three cents for every additional horse, mule or ox; for every sleigh or sled, six cents, if drawn by two horses, mules or oxen, and in like proportion if drawn by a greater or less number of horses, mules or oxen: Provided neverthe less, That no gate or turnpike shall be erected on said road within five miles of the court-house in Canandaigua.

CHAP. CCXXXI.

An ACT directing the surveying into building lots and sale of certain lands opposite to the village of Oswego. Passed April 9th, 1811.

I.

E it enacted by the people of the state of NewYork, represented in Senate and Assembly, That lay out a the surveyor-general, as soon as may be after the pasland oppo. sing of this act, shall lay out so much of the land belongfate the vil-ing to the people of this state in the county of Oneida, wego into adjoining the river Oswego, as lies opposite the village of Oswego, in the county of Onondaga, and within one and a half miles of said river, into proper streets and house lots, and so as to form, in the most convenient place, a public square or market place, all the streets to be one hundred feet wide, all the house lots to be laid out sixty-six feet front and rear, and two hundred feet in depth, and the lots for all public buildings to be reserved on the public square.

III. HEREAS Edward Manton, Phebe Manton, Sarah Manton, Joanna Manton and Esther Preamble. Manton, infants, under the age of twenty-one years, have presented their petition to the legislature, setting forth that they are seized of a real estate in the town of Kinderhook, in the county of Columbia, and praying to be enabled to sell the same.
