the said creek to John Marshall's saw-mill; thence to the meeting house on Buffalo, known by the name of Smith's; thence by a straight line to Waller's fort, on the road from Washington to Wheelen; thence along the said road to the state line; thence along the said state line to the place of beginning; and the freemen of the said district shall hold their annual elections at the house now occupied by Samuel Urie.

CHAPTER MDCCXXXV.

AN ACT TO PROVIDE FOR THE SETTLEMENT OF THE ACCOUNTS OF DIVERS OFFICERS OF THE MILITIA OF THE COUNTIES OF WESTMORELAND AND WASHINGTON, AND FOR OTHER PURPOSES THERE

IN MENTIONED.

Whereas part of the militia of the counties of Westmoreland and Washington, in this state, were ordered out in the year one thousand seven hundred and ninety-two, at different times, by the governor, to protect the frontiers from the repeated inroads made by the Indians into the said counties, and upon a settlement of the pay-rolls in the war-office of the United States, the pay of a number of the officers of the said militia has been reduced one grade, so that each captain has received only the pay which belonged to the station of a lieutenant, each lieutenant the pay of an ensign, and each ensign the pay of a sergeant, which reduction was made because the companies to which the said officers belonged had not their full complement of men. And whereas, in the same year, a number of volunteers were sent on an expedition against a body of Indians, who were encamped on the Muskingum, from whence they sallied forth and committed depredations on the frontiers, on which expedition a number of horses and some other property, which belonged to private individuals, and employed in the public service, were lost. And whereas Charles Campbell, lieutenant of the county of Westmoreland, and Absalom Baird, lieutenant of

the county of Washington, on behalf of those officers of the militia of the said counties, and the other individuals interested, have presented their memorials to the legislature, praying that compensation should be made them for the reduction so as aforesaid made in their pay, and that the owners of the said property should be reimbursed for the loss of the same. And whereas the above mentioned facts, stated in the said memorials, having been found on investigation to be true, it appears to the legislature to be just and reasonable to comply with the prayers

thereof.

[Section I.] (Section I. P. L.) Be it therefore enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That it shall and may be lawful for the register-general and comptroller-general of this commonwealth, and they are hereby authorized and directed to examine, liquidate and adjust the accounts of the several officers of the militia of the said counties of Westmoreland and Washington, who were ordered out in the service aforesaid, and the accounts and vouchers of the owners of the property so as aforesaid lost, in the manner prescribed in and by an act of assembly of this commonwealth, passed the fourth day of April, one thousand seven hundred and ninety-two, entitled "An act to provide for the settlement of public accounts, and for other purposes therein mentioned," and in the said settlement to allow each officer so much as will make up the deficiency in the settlement of his accounts in the war-office of the United States, so that the said officers may in the whole receive the full pay due to their respective stations in the militia, and to allow to the owners of the property aforesaid a just and reasonable compensation for their respective losses, having respect to the value of the property lost.

[Section II.] (Section II. P. L.) And be it further enacted by the authority aforesaid, That when the said accounts shall be settled, and the balances struck, in manner above mentioned, the same shall be paid to the several persons entitled thereto,

out of the fund appropriated for the support of government, in the manner prescribed and directed in and by the aforesaid recited act.

CHAPTER MDCCXXXVI.

A SUPPLEMENT TO THE ACT ENTITLED "AN ACT TO ENJOIN CERTAIN DUTIES ON THE SECRETARY OF THE COMMONWEALTH, AND FOR OTHER PURPOSES."1

[Section I.] (Section I, P. L.) Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That, from and after the passing of this act, the salary of the deputy secretary shall be nine hundred dollars per annum.

CHAPTER MDCCXXXVII.

AN ACT TO REPEAL SO MUCH OF AN ACT ENTITLED "AN ACT TO INCORPORATE THE SUBSCRIBERS TO THE BANK OF PENNSYLVANIA"2 AS REQUIRES THE ATTENDANCE OF THIRTEEN DIRECTORS TO PERFORM THE DISCOUNT BUSINESS OF THE SAID BANK, AND TO AUTHORIZE A LESSER NUMBER TO DISCHARGE THAT DUTY.

Whereas it has been represented by the president and directors of the Bank of Pennsylvania, in the name and by authority of the stockholders, that great difficuties have occurred in consequence of the fifth article of the seventh section of the act of incorporation, which requires the presence of not less than

thirteen directors for the transaction of business, as from their various and active avocations they are often prevented from giving punctual and necessary attendance, by which means the discount business is exposed to suffer to the inconvenience of the public, and the injury of the institution.

[Section I.] (Section I. P. L.) Be it therefore enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That so much of the fifth article of the seventh section of the act to incorporate the subscribers to the Bank of Pennsylvania, as requires the attendance of thirteen directors of the said bank to perform the business of discounting, be, and hereby is, repealed.

[Section II.] (Section II, P. L.) And be it further enacted by the authority aforesaid, That seven directors shall constitute a board for the purpose of transacting the discount business of the Bank of Pennsylvania.

CHAPTER MDCCXXXVIII.

AN ACT FOR THE RELIEF OF PATRICK ROBERTS AND CHARLES WEST, JUNIOR.

Whereas it has been represented to the legislature by Patrick Roberts, a soldier in the late Pennsylvania line of the army of the United States, that he has lost a certificate, number seventyseven, for the sum of fifty-six pounds six shillings and four pence, issued to him for the depreciation of his pay. And whereas it has been represented by a petition from Charles West, junior, that he has lost a new loan certificate, number eleven thousand eight hundred and seventy-four, for two hundred and ninety-four pounds five shillings: And whereas it appears by a certificate of the comptroller-general that the said certificate granted to Patrick Roberts hath not been redeemed, and as it

also appears from the certificate of the comptroller-general that the certificate issued to Charles West, junior, hath not been redeemed, nor re-exchanged for a continental certificate by this state.

Therefore:

[Section I.] (Section I, P. L.) Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That upon sufficient security being given by the said Patrick Roberts, for the use of the state, to the secretary of the commonwealth, and approved by the governor, to indemnify the commonwealth against the certificate, number seventy-seven, issued to the said Patrick Roberts, for the sum of fifty-six pounds six shillings and four pence, the depreciation of his pay, and the same being duly certified to the comptroller-general, the said comptroller shall, and he is hereby authorized and directed to certify in favor of the said Patrick Roberts, or his legal representatives, to the state treasurer, the amount of the principal of the said certificate, together with interest of six per cent. per annum until the first day of July, one thousand seven hundred and ninety-two, which said certificate of the comptroller-general shall be sufficient authority to the treasurer of the state to pay the same to the said Patrick Roberts, or his legal representatives, and the treasurer aforesaid is hereby enjoined, and required to pay the same accordingly.

[Section II.] (Section II, P. L.) And be it further enacted by the authority aforesaid, That the comptroller-general be, and he is hereby, directed to deliver to the state treasurer the continental certificate received in exchange for the new loan certificate, number eleven thousand eight hundred and seventy-four, issued to Charles West, junior, as aforesaid, or other continental certificates of equal value, who, on receiving the same, is hereby authorized and required to subscribe the said certificate to the loan of the United States, in trust for the use and benefit of the said Charles West, junior, his heirs and assigns, and draw the interest due thereon, and pay the same, as well as such as shall hereafter become due and payable thereon, to the said Charles
