CHAPTER 173.

AN ACT

AUTHORIZING THE COMPTROLLER OF THE CITY OF BUF-
FALO TO ADD TO THE GENERAL TAX ROLLS OF THE
CITY OF BUFFALO CERTAIN UNPAID SCHOOL TAXES,
AND TO COLLECT THE SAME AS A PORTION OF SUCH
GENERAL TAX.

The people of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The comptroller of the city of Buffalo is hereby authorized to add to the general tax rolls containing the tax to be levied for general purposes in the as unpaid. city of Buffalo for the fiscal year commencing January first, one thousand eight hundred and seventy-three, all taxes returned into his office unpaid, which were assessed pursuant to the provisions of sections seven and eight of title eleven of an act entitled "An act to revise the charter of the city of Buffalo," passed April twenty-eight, eighteen hundred and seventy, for school purposes; and for the collection of which, by the provisions of section. nine of said title, the same proceedings were to be had as were provided in said act for the collection of the general tax. And he is further authorized to collect said unpaid taxes out of the several parcels of land upon To collect which they shall have been levied, or from the owners thereof, in the same manner as he is now authorized to collect said general tax, and as if said unpaid taxes were a portion thereof.

2. This act shall take effect immediately.

COUNCIL OF THE CITY OF BUFFALO TO LAY OUT AND
EXTEND GENESEE STREET FROM ITS TERMINATION AT
BEST STREET THROUGH TO INTERSECT THE BUFFALO
AND BATAVIA PLANK ROAD.

The people of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The proceedings taken by the common esee street le- council in the city of Buffalo, in the year eighteen hundred and sixty-eight, to lay out and extend Genesee street from its then present termination at Best street through to intersect the Buffalo and Batavia plank road, and all proceedings taken to lay ont and extend Genesee street as aforesaid, are hereby declared to be legal and valid.

§ 2. On payment to the respective owners, persons lands to vest and corporations interested in the lands taken for the said extension of said street of the several amounts respectively awarded to such persons and corporations by the commissioners appointed in the matter of such extension by the superior court of Buffalo, on the thirtieth day of June, eighteen hundred and sixty-eight, the

lands taken for such extension shall vest in the said city for the purposes of a public street, and the said extension of said streets, as the same appear on the map attached to the report of said commissioners, and filed in the office of the city clerk of the city of Buffalo, on the twentyninth day of August, eighteen hundred and sixty-eight, shall be and constitute a public street of said city.

TO PROVIDE FOR THE CONSTRUCTION OF A SWING BRIDGE
OVER CITY SHIP CANAL, IN THE CITY OF BUFFALO.

The people of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The common council of the city of Buffalo are hereby authorized and empowered to construct, or cause to be constructed, a swing bridge, over the city ship canal in said city. Before taking any proceedings in reference thereto, they shall appoint three reputable freeholders of said city as commissioners for the purpose of taking the lands and property necessary for the approaches to said bridge.

§ 2. The said bridge shall be located between the westerly line of Main street and the easterly line of Michigan street, extended across said city ship canal at right angles with the center line thereof, upon the most practicable line, conforming as near as may be to the line of the proposed bridge across Buffalo river.

At the next meeting of the common council of said city thereafter the clerk shall present the said report presented to to said common council; and the said common council shall, within two weeks thereafter, by resolution, declare its intention to apply to the superior court of Buffalo, at a special term thereof (the time and place for the holding of which shall be designated in said resolution), for the appointment of three appraisers to ascertain and report the just compensation to be paid to the owners of the land and property so taken, or to any person interested therein, and the damages which in their judgment any
