The geodetic positions given in this description are based on Clark's spheroid of eighteen hundred and sixty-six and the astronomical data adopted by the United States coast and geodetic survey in eighteen hundred and eighty and are computed from data given in appendix number eight to the report of the said survey for eighteen hundred and eighty-eight, entitled "Geographical Positions in the State of Connecticut."

The boundary line hereinbefore described and determined which has been located and defined as, and in the manner, provided by section eight of this chapter is fully and accurately laid down on duplicate maps, one copy of which has been deposited with the secretary of state of the state of New York and the other copy thereof with the secretary of state of the state of Connecticut.

Nothing herein contained shall be construed to affect any existing titles to property, corporeal or incorporeal, held under grants heretofore made by either of said states, nor to affect existing rights which said states or either of them or which the citizens of either of said states may have by grant, letters-patent or prescription of fishing in the waters of said sound, whether for shell or floating fish irrespective of the boundary line hereby estab

lished, it not being the purpose hereof to define, limit or interfere with any such right, rights or privileges whatever the same may be.

The governor is authorized and requested to transmit a copy of this act to the governor of the state of Connecticut, and upon receiving acknowledgment of its receipt by the state of Connecticut the governor of this state shall cause such acknowledgment to be filed in the office of the secretary of state.

The governor of this state is authorized in concurrence with the governor of the state of Connecticut to communicate to congress the action of the two states on this subject and to request the approval of congress of the boundaries thus established and monumented.

§ 2. This act shall take effect immediately.

AN ACT to amend the village law, in relation to powers of village trustees to provide for band concerts.

Became a law February 14, 1913, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Subdivision twenty-two-a of section eighty-eight of chapter sixty-four of the laws of nineteen hundred and nine, entitled "An act relating to villages, constituting chapter sixty-four of the consolidated laws," as added by chapter five hundred and subd. 22a, nineteen of the laws of nineteen hundred and eleven is hereby transferred to and inserted in section eighty-nine of such chapter and made subdivision twenty-two-a of section eighty-nine, instead of section eighty-eight, to which it was erroneously added, and is hereby amended to read as follows:

22-a. Band concerts. May1 provide for public band concerts within the village, annually between June first and September fifteenth, but only after a proposition therefor, the submission whereof is hereby authorized, shall have been duly adopted at a village election, which proposition shall state the maximum amount to be expended for such purpose in any one year. § 2. 25. (a) To appoint six commissioners who shall constitute a village separate board of commissioners, vested with the care, manage to appoint ment and control of the real and personal property devised and library bequeathed to the village of Mohawk by the last will and testa- sion. ment of Frederick U. Weller and Helen Weller, both deceased, late of Mohawk, New York, which board so created shall be hereafter styled "Weller library commission." Each of the commissioners so appointed shall be at the time of his appointment Qualificaand during his term of office a resident of the village and a tax- commispayer and qualified elector therein; and they shall be so appointed that not more than three of such commissioners in office at any one time shall be members of the same political party. January next ensuing his appointment; provided, however, that if the board of the Weller library commission fail to so appoint before the first day of January, the commissioner whose term of office then expires shall continue to hold office until his successor is appointed and has qualified, but the office shall be deemed vacant for the purpose of appointing his successor, and such appointment may be made at any time thereafter for the balance of the unexpired term.

(b) Every commissioner, before entering upon the duties of his office, shall take and file with the village clerk the oath of office prescribed by the constitution of the state.

(c) Within thirty days after their appointment as hereinbefore provided, such commissioners shall meet at the Weller library in said village and proceed to organize as the Weller library comPresident. mission. They shall, at such meeting, designate one of their number to be president of the commission whose duty it shall be to preside at the meetings at which he is present, to call special meetings of the commission upon the request of any two other commissioners, or of his own motion whenever in his discretion he may deem it necessary. In the absence of the president, the commissioner having the shortest term to serve shall preside. Any four of said commissioners shall constitute a quorum for the transaction of business, and the concurrence of at least four commissioners shall be necessary for the transaction of any business and no resolution shall be adopted or other action taken unless four commissioners present at the meeting shall vote affirmatively Secretary. therefor.
