from, on the Payment of the Sum of Two Shillings and Sixpence to the faid Clerk or Clerks for any and every fuch Infpection.

CIX. And be it further enacted, That it fhall and may be lawful to and for the Commiffioners or Trustees, or other Perfons having the Control of the Pavements in the Streets or public Places in any parochial or other District within the Jurifdiction of this Act, from time to time and at all times afterwards to assemble and meet together for the Execution of the local A&t or Acts of Parliament whereby or by virtue whereof they may have been appointed, and of this Act, within their refpective parochial or other District or elsewhere, and may adjourn fuch Meetings from time to time as they fhall think proper; but that One fuch General Meeting fhall be held at least Once in every Calendar Month, and that Five or more of fuch Commiffioners or Trustees or other Perfons fhall attend at and be neceffary to conftitute every fuch General Meeting; and the Acts, Refolutions and Proceedings of the Majority prefent at fuch Meetings, fhall be deemed and confidered to be the Acts, Commiffioners, Refolutions and Proceedings of fuch Meetings; and that fuch Commiffioners or Trustees or other Perfons as aforefaid may retain and employ and discharge and pay fuch Clerks, Surveyors, Inspectors and other Perfons, as they from time to time fhall deem expedient; and also shall and may deduct and allow to themselves and to each other, and to their Officers and Servants, all Expences neceffarily incurred in and about the Execution of any local Act or Acts of Parliament, or of this Act; and also shall and may from time to time purchase or rent upon Leafe, for a Term or Terms of Years or otherwise, or may erect, furnish, alter or improve, any Houses, Offices and other Places which they may deem neceffary or expedient for their Places of Meeting, or for the Tranfaction of their Official Business, or for the Deposit and safe Custody of their Books, Vouchers and Documents; and alfo may purchase or rent upon Leafe or otherwife from time to time fuch Place or Places, to be called "The Green Yard," for fuch parochial or other District, for the Reception, Depofit and fafe Cuftody of any Article seized and removed by virtue of any local A&t or Acts of Parliament, or of this Act, within their refpective parochial or other Districts, or of any Horfes, Beafts, Cattle or any Animals or other things which may be found ftraying, or which fhall be in or about any Streets or public Places within their respective parochial or other District, or which, according to any local A& or Acts of Parliament, or to this Act, or to the Common or Statute Law, may be impounded be impounded; and may appoint any Person or Persons to inhabit and take care of fuch Houfes, Offices and other Places of Meeting, and to have the Cuftody and Care of fuch Books, Vouchers and Documents, and to take care of and fuperintend and may appoint fuch Places of Depofit as aforefaid; and may appoint the Fees and Charges which fhall be paid and payable, and which may be demanded on or for the Depofit and fafe Cuftody of any fuch Articles fo feized, or of any Horfes, Beafts, Cattle, Animals or other things which fhall be there impounded as aforefaid; and that the fame Fees and Charges fhall be fo paid before any fuch Articles or things fhall be given up or reftored to any Perfons whomfoever, or fhall and may be deducted out of the Proceeds of any Appraisement or Sale of any fuch Articles and Things, and

CX. And be it further enacted, That the Clerk or Clerks to the Notice of Genefaid Commiffioners or Trustees, or other Perfons having the Control ral Meetings to be given. of the Pavements in the Streets or public Places in any parochial or other District within the Jurifdiction of this Act, fhall, at least One Day previous to any General Meeting of the faid Commiffioners or Trustees or other Perfons as aforefaid, cause a Notice to be left for every fuch Commiffioner or Trustee or other Person at his Dwelling Houfe or Office, or laft or ufual Place of Abode, in fuch parochial or other District, of every fuch General Meeting, and of the Place and Time when and where fuch General Meeting is intended to be held.

CXI. And be it further enacted, That in cafe Five Commiffioners or Trustees or other Perfons as aforefaid shall not attend at any fuch General Meeting within One Hour after the time appointed for fuch Meetings refpectively, it fhall and may be lawful to and for the Clerk or Clerks to fuch Commiffioners or Trustees or other Persons as aforefaid to declare fuch General Meeting to be adjourned until a future time, within Seven Days after fuch Meeting was appointed to be or ought to have been held, and forthwith to caufe Notice of such Adjournment to be left for every fuch Commiffioner or Trustee or other Perfon having the Control of the Pavements in the Streets or public Places in fuch parochial or other District within the Jurifdiction of this Act, in manner herein before mentioned and directed.

CXII. And be it further enacted, That at each and every General Meeting of the faid Commiffioners or Trustees or other Perfons having the Control of the Pavements as aforefaid, any One Commiffioner or Trustee or other Perfon then prefent, who fhall be denominated by the Majority of the Commiffioners or Trustees or other Persons as aforefaid prefent at any fuch Meeting, fhall prefide at every fuch Meeting, and take the Chair as Chairman of fuch Meeting; and in cafe of an Equality of Votes on any Tranfaction, including the Vote of the Chairman, the Chairman at fuch Meeting hall have another or the cafting Vote.

CXIII. And be it further enacted, That if any Five or more of the Commiffioners or Trustees or other Perfons having the Control of the Pavements in the Streets or public Places in any parochial or other District within the Jurifdiction of this Act, shall on any Occafion think it neceffary or expedient to call or convene a Special General Meeting of the faid Commiffioners or Trustees or other Persons, it shall and may be lawful for fuch Five or more Commiffioners or Trustees or other Perfons to direct their Clerk or Clerks for the time being to fummon fuch Special General Meeting of the faid Commiffioners or Trustees or other Persons respectively, to be assembled at the ufual Place of Meeting, and at fuch time as the faid Five or more Commiffioners or Trustees or other Persons as aforefaid shall direct, by a Notice specifying the particular Object of fuch Special General Meeting, and of which Special General Meeting Notice fhall be accordingly given by the Clerk or Clerks in the manner hereinbefore directed to be given of any General Meeting.

CXIV. And be it further enacted, That all Acts, Orders and Proceedings of the faid Commiffioners, Trustees or other Perfons as aforefaid at any of their Meetings, fhall be entered in a Book or Books to be kept by their Clerk or Clerks for the time being for that Purpose, and fhall be figned by fuch Clerk or Clerks; and that all fuch Orders and Proceedings fhall then be deemed and taken to be original A&s, Orders and Proceedings; and fuch Book or Books shall and may be produced and read as Evidence of all such Acts, Orders and Proceedings, upon any Appeal or Trial or Information, or any Proceeding Civil or Criminal, and in any Court or Courts of Law or Equity whatfoever; and that it shall not be neceffary upon any Appeal or Trial or Information or Proceeding, or upon any Occafion, to prove the Appointment of fuch Clerk or Clerks; and that within Ten Years after the Date of any fuch Acts, Orders and Proceedings, Proof of the Handwriting of fuch Clerk or Clerks fhall alone be neceffary to verify his or their Appointment, and the Accuracy of fuch Entries of fuch Acts, Orders and Proceedings; and that after the Expiration of Ten Years from the Date of any fuch Acts, Orders and Proceedings, no other Proof shall be neceffary, or fhall be required of his or their Appointment, or of the Accuracy of fuch Entries, than the Production of fuch Book or Books appearing to be figned by fome Perfon or Perfons as the Clerk or Clerks for the time being; and that any Proof of his or their Handwriting fhall not be necessary, nor fhall be required; and also that upon any Appeal or Trial or Information, or other Proceeding Civil or Criminal, and in any Court or Courts of Law or Equity, a Certificate from the Clerk or Clerks for the time being, figned by him or them, that any Perfon or Perfons who hath or have acted or may act as Commiffioners or Trustees, or other Perfons having the Control of the Pavements in any parochial or other District, or as a Surveyor or Surveyors of Pavements, or in any other Office, was or were or is or are One or more of fuch Commiffioners or Trustees or Persons having the Control of the Pavements in fuch parochial or other Diftrict, or was duly appointed to be and was a Surveyor or Surveyors of Pavements, or to fuch other Office wherein fuch Perfon or Perfons fhall or may have acted, or shall or may act or appear, fhall be fufficient and conclufive Evidence of the Appointment and Authority of such Perfon or Perfans, without any other Proof or Evidence whatsoever.

CXV. And be it further enacted, That it fhall and may be lawful to and for the faid Commiffioners or Trustees or other Perfons having the Control of the Pavements of the Streets and public Places within the Jurifdiction of this Act, present at any General Meeting, from time to time and at all times hereafter to make such Bye Laws, Rules, Orders and Regulations for the better regulating their own Proceedings at any of their General or other Meetings, and of enforcing the good Conduct and Behaviour of the several Officers and Servants employed by the faid Commiffioners or Truftees or other Perfons as aforefaid, in the Execution of any local Act or Acts of Parliament relating to fuch parochial or other District, or of this Act, and for the Application of the feveral Monies that may be levied, collected or received by virtue of such local A&t or Acts of Parliament, or of this Act, to the Purposes thereof; and likewise from time to time to vary, alter, amend or repeal all

or any of fuch Bye Laws, Rules, Orders and Regulations, and
to fix and appoint all fuch reasonable Fines and Penalties for the
Breach or Nonperformance of any fuch Bye Laws, Rules, Orders or
Regulations, or any Part thereof, as to them fhall feem proper,
so that no fuch Fine or Penalty fhall exceed the Sum of Ten
Pounds; and all fuch Bye Laws, Rules, Orders and Regulations
when made, and all Alterations, Variations and Amendments thereof,
fhall be confirmed at another General Meeting, and being fo con-
firmed fhall be printed and be hung up or affixed at the feveral
Places of Meeting of the faid Commiffioners or Trustees or other
Perfons as aforefaid; and all fuch Bye Laws, Rules, Orders or
Regulations, when fo made, confirmed, printed and affixed, fhall be
good and binding upon all Perfons concerned; provided that the
fame be not inconfiftent with or repugnant to the Laws of that Part
of the United Kingdom called England, nor inconfiftent with or
repugnant to the Provifions and Directions in any local Act or
Acts of Parliament for fuch parochial or other District, or in this

CXVI. And be it further enacted, That the faid Commiffioners Commifioners or Trustees or other Perfons as aforefaid at any of their General may enter into Meetings shall and may and they are hereby authorized and empow herein menered from time to time to contract or agree with any Perfon or Per- tioned. fons whomfoever for removing the Duft and Afhes, cleanfing, paving and repairing the Pavement of and within their respective parochial or other District, and for doing and executing all or any of the Works which, under and by virtue of any local A&t or Acts of Parliament relating thereto, or of this Act, the faid Commiffioners or Trustees or other Perfons as aforefaid may direct to be done and executed; and alfo to purchase or provide, either by Contract or otherwife, from time to time, fuch Goods, Materials and things whatsoever, as they fhall think proper for effectually executing the Powers and Provifions of fuch local Act or Acts of Parliament or of this Act, and fhall pay or order the Payment of the Monies due or to become due upon any fuch Contracts, Agreements or Purchases, to the Perfon or Perfons entitled to receive the fame, by and out of all or any Monies which shall or may be paid to or received by them by virtue of any fuch local Act or Acts of Parliament or of this A&t, for and towards the Expence of paving and repairing the Pavements of the Streets or public Places within their refpective parochial or other Districts, either exclufively or jointly with or for or towards

CXVII. And be it further enacted, That previous to any Meeting of the Commiffioners or Trustees, or other Perfons as aforesaid, for the making of any fuch Contracts which they may deem expedient for the better Execution of this A&t, Seven Days' Notice of fuch Meeting to make any fuch Contracts fhall be given in Two or more of the public Newspapers published in London or Weftminster, expreffing the Nature and Objects of each of fuch Contracts, in order that any Perfon or Perfons willing to contract may make Proposals for that Purpose, to be offered and presented to the faid Commiffioners or Truftees or other Perfons as aforefaid, or to their Clerk or Clerks, at the Time and Place mentioned in fuch Notice; and also that the Particulars of all fuch Contracts or Agreements, and all Receipts and Payments by fuch Commiffioners or Trustees or other Perfons in the Execution of the faid local Act or Acts of Parliament or of this Act, and alfo Minutes of their Proceedings at all and every of their General Meetings, fhall be fairly entered by their Clerk or Clerks, or by his or their Direction, in a Book or Books to be provided for those Purposes, and to be carefully preferved.

CXVIII. And be it further enacted, That in cafe any fuch Contract or Contracts, for any Purpose or Purposes whatsoever, shall have been heretofore or fhall be hereafter entered into by any Commiffioners or Trustees or other Perfons as aforefaid acting in purfuance of any local Act or Acts of Parliament or of this Act, and the Perfon or Perfons who may have entered or who fhall hereafter enter into any fuch Contract or Contracts, fhall be guilty of any Breach or Nonperformance of any fuch Contract or Contracts, it shall and may be lawful to and for the faid Commiffioners or Truftees or other Persons as aforefaid, at any of their General Meetings, in cafe they shall deem it proper and expedient, to declare fuch Contract or Contracts to be null and void, and fuch Contract or Contracts shall be from thenceforth null and void accordingly; or it fhall or may be lawful to and for them to compound for fuch Sum or Sums of Money with the Person or Persons so having entered into or who fhall hereafter enter into fuch Contract or Contracts, for fuch Breach or Nonperformance of fuch Contract or Contracts, and for all Cofts, Charges and Expences which have been or shall be occafioned thereby, as to them the faid Commiffioners or Trustees or other Persons shall appear proper and expedient; or it shall and may be lawful to and for them the faid Commiffioners or Trustees or other Persons as aforefaid to fue for and to recover the full Penalty or Penalties contained and expreffed in any fuch Contract or Contracts, or in any Bond or Bonds given and executed for the due Performance of such Contract or Contracts, by Action of Debt or on the Case in any of His Majesty's Courts of Record at Westminster, in which Action or Actions no Effoign, Protection, Wager at Law, nor more than One Imparlance, fhall be allowed.

CXIX. And be it further enacted, That it fhall be lawful for all and every the Perfons poffeffing or entitled to any Bonds, Mortexamined, &c. by gages,' Annuities or other Securities affecting or charged upon the faid Rates or Affeffments for any parochial or other District within the Jurifdiction of this Act, and all Perfons rated to the Rates or Assessments to be made for or towards the Expences of paving or
