CHAPTER MCDXXXIX.

AN ACT TO GRANT TO THE CORPORATION OF THE MINISTER, TRUSTEES, ELDERS AND DEACONS OF THE GERMAN REFORMED CONGREGATION IN THE CITY OF PHILADELPHIA IN THE STATE OF PENNSYLVANIA CERTAIN LANDS THEREIN MENTIONED FOR ENDOWING A FREE SCHOOL FOR THE USE OF THE POOR OF THE SAID CONGREGATION.

(Section I, P. L.) Whereas it hath been represented to this house that the corporation of "The Minister, Trustees, Elders, and Deacons of the German Reformed Congregation in the City of Philadelphia in the State of Pennsylvania" have at their own voluntary expense instituted a charity school in the city of Philadelphia in which a number of poor children are educated, but the funds provided are not only so precarious in their nature, but so limited in their amount as to render the continuance of their benevolent undertaking doubtful and uncertain without some assistance from the legislature, wherefore they have prayed this house to confer on them a grant of part of the unappropriated lands within this state:

And whereas this house in conformity to the true principles of liberty which is the more dear and valuable to men in proportion as their minds are more enlightened, has always promoted the dissemination of learning:

[Section I.] (Section II, P. L.) Be it therefore enacted and it is hereby enacted by the Representatives of the Freemen of the Commonwealth of Pennsylvania in General Assembly met and by the authority of the same, That five thousand acres of land with the usual allowance, to be located, set out and conveyed within the unappropriated lands of this state be and hereby are granted to the said corporation and their successors to have and to hold the same to them and their successors forever in trust for the purpose of supporting and maintaining a charity school for the education of the youth of the said congregation or others at the option of the said minister, trustees, elders and deacons or their successors, in and near the city of Philadelphia, and for no other purpose whatever.

[Section II.] (Section III, P. L.) And be it further enacted by the authority aforesaid, That upon the application of the said minister, trustees, elders and deacons or of any person duly authorized by them to the secretary of the land office of this state, he shall and hereby is required to grant and issue such and so many warrants to be directed to the surveyor-general requiring him to survey or cause to be surveyed for the said minister, trustees, elders and deacons such and so many tracts of land with such number of acres in each warrant as shall be specified in each application and not otherwise appropriated by acts of assembly nor before located or surveyed, as shall in the whole amount to five thousand acres and the usual allowance, and the surveyor-general shall receive and enter all such warrants in his office and issue copies of them directed to his deputies and upon the execution and return thereof, patents or grants of confirmation for the same shall be issued and granted in like manner and form and have the like force and effect as patents granted to private persons can or may have.

[Section III.] (Section IV, P. L.) And be it further enacted by the authority aforesaid, That all and every tract and tracts of land hereby directed to be surveyed for the use and trust aforesaid, shall be so done at the charge of the state and the president or vice-president in council is hereby authorized and empowered to draw orders on the treasurer of this state to pay and defray all charges arising thereupon.

CHAPTER MCDXL.

AN ACT TO REMEDY THE DEFECTS OF AN ACT ENTITLED "A SUPPLEMENT TO AN ACT ENTITLED 'AN ACT MORE EFFECTUALLY TO PREVENT UNFAIR PRACTICES IN THE PACKING OF BEEF AND PORK FOR EXPORTATION AND TO REGULATE THE EXPORTATION OF FLAXSEED, BUTTER AND BUSCUIT IN KEGS'" 1

practices in the packing of beef and pork for exportation and to regulate the exportation of flaxseed, butter and biscuit in kegs,'" it is enacted that salted beef and pork which shall have been brought or imported from any place or places without the bounds and limits of this commonwealth and which shall have been branded in the manner therein described, shall be excepted from the regulations of the said act:

And whereas the said exception from its extent may be injurious to the reputation of the salted provisions of this state: [Section I.] (Section II, P. L.) Be it therefore enacted and it is hereby enacted by the Representatives of the Freemen of the Commonwealth of Pennsylvania in General Assembly met and by the authority of the same, That the exception contained in the act aforesaid shall not be deemed to extend to any salted beef or pork unless the same shall be brought into this com monwealth by water from some place without and beyond the Capes of Delaware.

And in order that such beef and pork as shall be exported from this commonwealth may be the better known in foreign parts and estimated according to the qualities thereof:

[Section II.] (Section III, P. L.) Be it further enacted by the authority aforesaid, That all such tierces, barrels and half barrels as are in and by the said recited act directed and required to be branded with the arms of Pennsylvania shall instead thereof be branded with the word "Philadelphia" at full length and in a plain and legible manner.

CHAPTER MCDXLI.

AN ACT TO REPEAL CERTAIN PARTS OF AN ACT ENTITLED "AN ACT FOR INCORPORATING THE PRESBYTERIAN CONGREGATION OF NEW LONDON IN THE COUNTY OF CHESTER. 1

(Section I, P. L.) Whereas certain parts of the act entitled "An act for incorporating the Presbyterian congregation of

New London in the County of Chester" have on experience been found to be disagreeable to many of the members thereof and they have thereupon prayed that every part of the said recited act, except so much as relates to the recovering, receiving and appropriating bequests and donations by the present trustees and their successors may be repealed:

In order therefore to ease the minds of the said members and to restore harmony amongst them:

[Section I.] (Section II, P. L.) Be it enacted and it is hereby enacted by the Representatives of the Freemen of the Commonwealth of Pennsylvania in General Assembly met and by the authority of the same, That all and every part and parts of the said recited act, except so much thereof as concerns the recovering, receiving and appropriating of bequests and donations, the electing, choosing or appointing trustees or as relates to the alienation, disposition or application of the property of the corporation or any part thereof shall be and the same hereby is repealed and made null and void.

CHAPTER MCDXLII.

AN ACT FURTHER TO CONTINUE AN ACT ENTITLED “AN ACT TO SUS PEND THE SALE OF LANDS FOR NON-PAYMENT OF TAXES AND FOR OTHER PURPOSES THEREIN MENTIONED."1

(Section I, P. L.) Whereas the act passed on the eighteenth day of March last "to suspend the sale of lands for non-payment of taxes" will by its own limitation expire on the rising of this house:

And whereas at the time of passing the said act "the legislature had it in contemplation to establish a mode of collecting the public taxes less burdensome and oppressive than the present," but by reason of other urgent affairs of the state have not yet been able to devise and establish such mode of collec

tion and it is therefore reasonable that the suspension aforesaid should be further continued:

[Section I.] (Section II, P. L.) Be it therefore enacted and it is hereby enacted by the Representatives of the Freemen of the Commonwealth of Pennsylvania in General Assembly met and by the authority of the same, That the act entitled "An act to suspend the sale of lands for non-payment of taxes and for other purposes therein mentioned," be and the same is hereby declared to be continued and to remain in full force and effect until the first day of April which shall be in the year of our Lord one thousand seven hundred and ninety.

CHAPTER MCDXLIII.

AN ACT FOR DIVIDING THE COUNTY OF CHESTER, AND TO ERECT PART THEREOF INTO A SEPARATE COUNTY.

(Section I, P. L.) Whereas the inhabitants of the borough of Chester and the south-eastern parts of the county of Chester have by their petitions set forth to the general assembly of this state that they labor under many and great inconveniences from the seat of justice being removed to a great distance from them and have prayed that they may be relieved from the said inconveniences, by erecting the said borough and south-eastern parts of the said county into a separate county:

And as it appears but just and reasonable that they should be relieved in the premises.

[Section I.] (Section II, P. L.) Be it enacted and it is hereby enacted by the Representatives of the Freemen of the Commonwealth of Pennsylvania in General Assembly met and by the authority of the same, That all that part of Chester county lying within the bounds and limits hereinafter described shall be and the same is hereby erected into a separate county, that 22-XIII
