Section 2. For the maintenance of the Soldier's Relief Commission of the State of Oklahoma during the fiscal year ending June 30, 1925, there is hereby appropriated out of any monies in the State Treasury, not otherwise appropriated, the sum of Fifteen Thousand ($15,000.00) Dollars, or so much thereof as may be necessary, to be expended as follows:

AN ACT creating the office of Budget Officer and assistants thereto, and fixing their salaries, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Budget Officer-Appointment-Salary.

Section 1. The Governor is hereby authorized and empowered to appoint a Budget Officer by and with the advice and consent of the Senate, whose term of office shall be four years. The Budget Officer shall receive an annual salary of Thirty-six Hundred ($3,600.00) Dollars, payable monthly, out of the fund appropriated therefor. The Budget Officer shall appoint a stenographer at an annual salary of Fifteen Hundred ($1,500.00) Dollars, payable monthly.

Duty.

Section 2. It shall be the duty of the Budget Officer, after visiting all State Departments and Institutions, to prepare the budget under the supervision and direction of the Governor, in accordance with an Act approved March 18, 1919, entitled, "An Act to provide for the preparation and review of estimates for expenditures and revenues, and to establish a budget system for all State Departments, bureaus, divisions, officers, boards, commissions, institutions, and other agencies and undertakings, receiving or asking financial aid from the State of Oklahoma."

Section 3. Any unexpended balance in Account No. 16 for the fiscal year ending June 30, 1923, for the Governor's office, shall be available for the payment of the salaries herein created during the remainder of the fiscal year ending June 30, 1923.

Emergency.

Section 4. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

SENATE BILL NO. 107.

Departmental Appropriations.

AN ACT making general appropriations for the budget of the legislative, executive and judicial departments of the State, and for the principal and interest of the public debt, for the fiscal years ending June 30, 1924, and June 20, 1925, by functions of each department in accordance with the budget classification adopted by the Governor. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Appropriations.

Section 1. There is hereby appropriated, out of any monies in the Treasury of the State of Oklahoma, not otherwise appropriated, for the fiscal years ending June 30, 1924, and June 30, 1925, the following sums, or so much thereof as may be necessary, for the purposes herein named and no other. The appropriations herein made are from the General Revenue Fund except where otherwise provided.

The State Auditor is hereby authorized to issue warrants upon the State Treasury for such portions thereof, as may be found to be due upon the auditing of the respective claims in favor of the person, or persons to whom such claims are allowed; provided, that all claims against the State shall be itemized, and distribution inserted thereon in accordance with the budget classification, adopted by the Governor, and shall show upon their face the fiscal year within which the same shall have accrued, and shall be sworn to as true and correct, and shall bear the approval of the officer or officers of the department before being audited; and, provided, further, that assistants, deputies, or employees mentioned in this Act shall receive pay only from the time they enter the service of such office or position; and, provided, further, that where any sums herein appropriated are appropriated on conditions, said sums, or any part thereof, shall not be available unless said conditions are in letter and in spirit complied with; and, provided, further, that all warrants shall be made payable to order and not to bearer, and shall be registered with the State Treasurer for payment in the same numerical order of their issue before being delivered by the Audito. to the payee thereof, said registration shall show "payable" or "non-payable" as the case may be, and

shall be in such form as the State Examiner and Inspector may prescribe. If any state officer, board, commission, or commissioner shall file any claim contrary to this Section or if the Auditor shall honor same, then he or they shall be liable for the full amount of his or their official bonds.

The budget classifications and instructions governing same is printed in each budget by the Governor and same is hereby made a part of this Act, and is referred to for more detail.
