in cities of first class, in counties having a population of not less than twenty-two thousand four hundred thirty-two (22,432) and not more than twenty-two thousand five hundred (22,500), according to the next preceding Federal Decennial Census, wherein the actual cost of construction of such Public School Building has exceeded or does exceed the amount of funds legally available for the construction of said Public School Building. The excess cost of such construction over and above that sum legally provided for the construction thereof, be and the same is hereby declared to be a legal and binding obligation against such School District, provided that such excess cost represents actual cost of construction therein without fraud or collusion by or between members of the said Board of Education and any contractor or sub-contractors engaged in the construction thereof.

Board of Education-Suits-May Enter Appearance.

Section 2. The acts of the Board of Education in contracting such indebtedness where the same was and is in good faith and without fraud and collusion are hereby validated and declared to be legal and binding upon such School District and the said Board of Education is hereby authorized to enter the appearance of such School District in any proceedings in a competent court for the purpose of having such claim reduced to judgment against such School District.

Emergency.

Section 3. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval. Approved January 26, 1923.

CHAPTER 5.

SENATE BILL NO. 7.

Aid For Union Graded and Consolidated Schools.

AN ACT making an appropriation for the purpose of aiding Union Graded and Consolidated Schools; Providing for the distribution of such money, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Appropriation.

Section 1. There is hereby appropriated out of any money in the State Treasury to the credit of the Union Graded and Consolidated School District Fund, created by Chapter 112, of the Session Laws of Oklahoma, 1921, the sum of Seventy-five Thousand ($75.000.00) Dollars, for the fiscal years 1923-1924 and 1924-1925, or so much thereof as may be necessary, for the purpose of aiding and assisting in the construction of Union Graded and Consolidated School District buildings, to be apportioned, distributed and expended according to the provisions of existing law.

Appropriation.

Section 2. There is hereby appropriated out of any money in

the State Treasury to the credit of the General Revenue Fund, not otherwise appropriated, the sum of Seventy-five Thousand ($75,000.00) Dollars, for the fiscal years 1923-1924 and 1924-1925, or so much thereof as may be necessary, for the purpose of aiding and assisting in the construction of Union Graded and Consolidated School District buildings, to be apportioned, distributed and expended according to the provisions of existing law. Provided, that in no event shall the State contribute toward the construction of any such building an amount in excess of the appropriation herein contained. Buildings Standards.

Section 3. Buildings for which aid is given from moneys appropriated by this Act must conform to the standards prescribed by Chapter 63, Session Laws of 1919.

Emergency.

Section 4. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 6.

SENATE BILL NO. 9.

Jurors' Fees.

AN ACT amending Section 6441, of the Compiled Statutes of Oklahoma, 1921, relating to jurors' fees, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Jurors-Fees.

Section 1. That Section 6441, of Compiled Statutes of Oklahoma, of 1921, be amended to read as follows:

"Section 6441. Jurors shall be paid the following fees out of the county treasury: For each day's attendance before any District Court three dollars; for each day's attendance before any other court of record three dollars; for each mile necessarily traveled in going to or returning from the place of attendance five cents; each juror or witness sworn before any coroner or justice of the peace, or any inquest taken by him, one dollar and fifty cents; each juror, for attendance in any justice of the peace court, to be advanced by the party demanding the same, at the time of such demand, and taxed to the party adjudged to pay the costs, fifty cents; and fifty cents for each additional day he shall attend the same."

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 7.

SENATE BILL NO. 11.

Mileage and Per Diem Appropriation.

AN ACT making appropriation to pay the mileage and per diem of members of the Senate and House of Representatives of the Ninth Legislature, salaries of officers and employees and contingent expenses, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

Appropriation.

Section 1. There is hereby appropriated, out of any money in the State Treasury, not otherwise appropriated, the sum of One Hundred Fifty Thousand ($150,000.00) Dollars, or so much thereof as may be necessary, to pay the mileage and per diem of the members of the Senate and House of Representatives of the Ninth Legislature, and salaries of the officers and employees of the Senate and House of Representatives, and such contingent expenses as either the Senate or the House of Representatives may order paid therefrom, including the preparation and publication of the Journals of the respective Houses and the Session Laws of the Ninth Legislature.

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 8.

SENATE BILL NO. 14.

Sheriffs-Deputies.

AN ACT authorizing the appointment of two field deputies and one jailer for the sheriffs in all counties having a population of not less than 33,925, nor more than 33,950, fixing the compensation and providing for the payment thereof, repealing all laws in conflict herewith, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

Sheriffs-Deputies.

Section 1. Authority is hereby granted the County Sheriffs in all counties having a population of not more than thirty-three thousand nine hundred fifty (33,950) nor less than thirty-three thousand nine hundred twenty-five (33,925), to appoint two field deputies and one jailer in addition to the deputies now provided for by law in such counties, subject to the confirmation of the Board of County Commissioners of said counties, at salaries not to exceed One Hundred Twenty-five ($125.00) Dollars, per month, payable monthly. Repealing Section.

Section 2. All acts and parts of acts in conflict herewith are hereby repealed.

Emergency.

Section 3. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 9.

SENATE BILL NO. 15.

Aid For Disabled Soldiers and Sailors.

AN Act providing for an emergency appropriation of One Hundred Thousand Dollars for the aid of sick, wounded and disabled soldiers, sailors and marines of the late world war, and their destitute wives, widows and minor children, providing for expense of communication, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Appropriation.

Section 1. There is hereby appropriated out of any funds in the State Treasury, not otherwise appropriated, the sum of Fifty Thousand ($50,000.00) Dollars, for the fiscal year ending June 30, 1924, and Fifty Thousand ($50,000.00) Dollars, for the fiscal year ending June 30, 1925, or so much thereof as may be necessary, for the purpose of aiding the sick, wounded and disabled soldiers, sailors and marines of the late World War, and their destitute wives, widows and minor children; provided, that not to exceed Five Thousand ($5,000.00) Dollars of said monies shall be expended for relief within any one county of said state for any one fiscal year. Governor-Authority to Expend Money.

Section 2. Authority is hereby given the Governor of the State of Oklahoma to expend said sum of One Hundred Thousand ($100,000.00) Dollars as set out in Section One of this Act upon the recommendation and approval of any Executive Officer of the State Department of the American Legion of Oklahoma and the Executive Secretary of the State Department of Oklahoma or any County Chapter of the Red Cross of the State of Oklahoma.

Section 3. Authority is hereby given the Governor of the State of Oklahoma to expend not to exceed the sum of Five Hundred ($500.00) Dollars, per year, of said monies to reimburse the American Legion of Oklahoma for expense of communication, printing, stationery and supplies in connection with such relief.

Felony.

Section 4. Any person who shall knowingly make a false statement under oath, orally or written, of a material fact relating to a claim, under the provisions of this Act, shall be guilty of a felony and upon conviction thereof shall be punished by a fine of not more than Five Hundred ($500.00) Dollars, or by imprisonment for not more than one (1) year in the State Penitentiary, or by both such fine and imprisonment.

Emergency.

Section 5. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect, and be in full force from and after its passage and approval. Approved March 30, 1923.

CHAPTER 10.

SENATE BILL NO. 16.

Free Fair Association Buildings.

AN ACT authorizing County Commissioners of any county in Oklahoma, with a population not less than 33,400 or more than 33.500, by Federal Census of 1920, to make a special levy for the purpose of erecting buildings for the Free Fair Association upon real estate owned by the said county or any municipal corporation therein, under contract or lease, for use as exhibit grounds for free county fair.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

County Commissioners-Free Fair Association Buildings.

Section 1. The County Commissioners of any County in Oklahoma having a population of not less than 33,400 and not more than 33,500, by the Federal Census of 1920, are hereby authorized and empowered to include an item in the estimate of the County budget for the next five (5) fiscal years, for the erection of a Livestock and Exhibit buildings on the grounds of the Free Fair Association of said County not to exceed one fourth (4) mill for the year 1923; one eight (%) mill for the years 1924, 1925, 1926 and 1927; and the County Excise Board is authorized and empowered to levy the amount stated herein.

Section 2. The Board of County Commissioners of any such county are hereby authorized and empowered to enter into a contract for the use and management of said structures and buildings with any person, municipal corporation or officials of any Free Fair Association and to construct said buildings or structures on leased land, and to lease any real estate on which to erect said buildings and structures from any municipal corporation, person or official of any Free Fair Association.

SENATE BILL NO. 19.

Oklahoma Soldiers' Memorial Hospital.

AN ACT making appropriations for additional quarters for housing of personnel, other than nurses and doctors, to the Oklahoma Soldiers' Memorial Hospital, located at Muskogee, Oklahoma, authorizing expenditure thereof by Soldiers' Relief Commission, and declaring

an emergency.
