HOUSE BILL NO. 144.

County Attorneys-County Judges.

AN ACT fixing the salary of County Attorneys and County Judges in counties of the State of Oklahoma having a population of more than Fifty-five Thousand.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Salaries.

Section 1. That the salary of each County Attorney and County Judge, in every county in the state of Oklahoma, having a population of more than Fifty-five (55,000) Thousand, according to the last Federal Census, and taken under the direction of the Board of County Commissioners of any county in the State of Oklahoma, shall be Four Thousand ($4,000.00) Dollars, per annum, payable monthly, providing no person shall receive any increase of salary, as herein provided, until after the next General Election in 1924.

CHAPTER 167.

HOUSE BILL NO. 159.

Co-Operative Associations.

AN ACT amending Sections 5637, 5644, 5645 and 5647 of Article 19, Chapter 34, of the Compiled Oklahoma Statutes of 1921, relating to the organizations and regulations of Co-operative Corporations.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Section 1. That Section 5637, Article 19, Chapter 34, of the Compiled Oklahoma Statutes, 1921, is hereby amended to read as follows:

Section 5637.-CORPORATIONS AUTHORIZED PURPOSES. Ten or more persons may form a corporation for the purpose of conducting an agricultural, dairy, livestock, irrigation, horticultural, mercantile, mining, manufacturing, mechanical, or industrial business upon a cooperative plan, and with their associates, successors and assigns may become and be a body politic and corporate by complying with the provisions of this Act.

Section 2. That Section 5644, Article 19, Chapter 34, of the Compiled Oklahoma Statutes, 1921, is hereby amended to read as follows:

Section 5644. LIABILITY OF SUBSCRIBERS AND SHAREHOLDERS. All subscribers or shareholders shall be severally and individually liable to the creditors of the corporation, to the amount

of the unpaid capital stock subscribed for, or held by them, respectively and to no other or further amount.

Section 3. That Section 5645, of Article 19, Chapter 34, of the Compiled Oklahoma Statutes, 1921, is hereby amended to read as follows:

Notice of the time and place of holding such election shall be published not less than two weeks, previous thereto in the newspaper printed nearest to the place, where the principal office or place of business of the corporation is located. A quorum shall consist of at least one-third in number of all the stockholders or subscribers for stock who are entitled to vote.

Section 4. That Section 5647, of Article 19, Chapter 34, of the Compiled Oklahoma Statutes, 1921, be and the same is hereby amended to read as follows:

Section 5647. LIABILITY OF DIRECTORS. If the indebtedness of such corporation shall at any time exceed the amount of its subscribed capital stock and surplus the directors assenting thereto shall be personally and individually liable for such excess to the creditors. Except any indebtedness created in favor of the State warehouse revolving fund.

CHAPTER 168.

HOUSE BILL NO. 163.

State Health Department.

AN ACT giving a list of officers and employees authorized in the State Health Department; dividing the state pointment of one Health Supervisor for each of said four sections; readjusting and fixing into four approximately equal sections; authorizing the apthe salaries.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

Appropriation.

Section 1. There is hereby appropriated out of any moneys in the State Treasury of the State of Oklahoma, not otherwise appropriated, for salaries and expenses of the Health Department, as set forth in Section Three of this Act, the sum of One Hundred Eighty-three Thousand, Six Hundred Seventy and 52/100 ($183,670.52) Dollars, for the fiscal year ending June 30, 1924, and the sum of One Hundred Eighty- three Thousand, Six Hundred Seventy

and 52/100 ($183,670.52) Dollars, for the fiscal year ending June 30, 1925, or so much thereof as may be necessary. The appropriations herein named are from the General Revenue Funds and the State Auditor is hereby authorized to issue warrants from the State Treasury for such portion thereof as may be found to be due upon the auditing of the respective claims in favor of the person or persons to whom such claims are allowed; provided, that all claims against the State shall be itemized and shall show upon their face the fiscal year within which the same shall have been approved and shall be sworn to as true and correct and shall bear the approval of the officer or officers in charge of the department before being audited; and provided further, that assistants, deputies and employees mentioned in Section Three of this Act, shall receive pay only from the time they enter the service of such office or position.

Inspection Districts.

Section 2. For the purpose of more thoroughly inspecting hotels, barber shops, restaurants, stores and school premises of cities and towns in the State of Oklahoma, the State is hereby divided into four approximately equal parts, by the Santa Fe railroad running north and south, and by the Rock Island Railroad running east and west; said divisions being designated as northeast division, southeast division, northwest division, southwest division, and to each one of these four divisions the Commissioner of Health shall assign one supervisor and two inspectors and said Commissioner of Health shall hold said supervisor and inspectors of each division responsible for thoroughly inspecting the hotels, restaurants, stores and school premises of the cities and towns of their particular division of the State, to the end that epidemics may be avoided; but, should there be an epidemic in any section or sections of the State, these supervisors and inspectors may be shifted from one division of the State to another by order of the Health Commissioner.

Appropriation-Salaries.

Section 3. After the passage and approval of this Act, the officers and the salaries in the Department of Health shall be as indicated in this Section, the appropriation to cover said salaries and incidental expenses being covered in Section One of this Act.

Appropriation-Traveling Expenses.

Section 4. Where provision is made herein for traveling al

lowance, the cxpenses of same shall be computed on the following basis:

All claims made for traveling expenses within this State shall be limited to actual transportation charges, and the sum of four ($4.00) Dollars per day in lieu of all subsistence, and no claim for traveling allowance or subsistence shall be made unless the party making claim for same is actually traveling upon business for this State, and under orders from the head of the Department for which he is working, and no claim shall be approved, or allowed in excess hereof by the State Auditor, and if the State Auditor shall approve, allow or pay any claim in excess hereof, he shall be liable for the amount of the same on his official bond.

Repealing Clause.

Section 5. Chapter 79, House Bill No. 454, Session Laws of 1915, and all other Acts or parts of Acts in conflict with this Act and the same are hereby repealed.

CHAPTER 169.

HOUSE BILL NO. 164.

County Superintendent.

AN ACT authorizing the county superintendent of public instruction to appoint one deputy in every county in the state of Oklahoma, having a population of not less than sixty-two thousand, and not more than sixty-five thousand, according to the last preceding federal census, ог any census ordered or authorized by the Board of County Commissioners of any county, fixing the salary thereof, and declaring an emergency. 16

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

County Superintendent-Deputy.

Section 1. That in all counties in the State of Oklahoma having a population of not less than Sixty-two (62,000) Thousand, and not more than Sixty-five (65,000) Thousand, according to the last preceding Federal Census, or any census ordered or authorized by the Board of County Commissioners of any County in the State of Oklahoma, the County Superintendent of Public Instruction, is hereby authorized and empowered, by and with the consent of the Board of County Commissioners, to appoint one deputy necessary to carry on the work in said office, and fixing the salary of said deputy, as follows:

One deputy at $150.00 per month, and to be paid as provided by law.

Emergency.

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect from and after its passage and approval.
