CHAPTER 132.

SENATE BILL NO. 408.

Proposed Amendment To Constitution.

AN ACT proposing an amendment to the Constitution of the State of Oklahoma by adding to Article 14, another Section to be known as Section 4.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

That the following amendment to the Constitution of the State of Oklahoma, is hereby proposed and said amendment with the yeas and nays thereon, shall be entered in the journals of the respective Houses of the Legislature and referred by the Secretary of State to the qualified voters of the State for their approval or rejection at a special election which is hereby called and shall be held in the manner provided by law on the 5th day of June, 1923. and which amendment shall be known as Section 4, of Article 14, of the Constitution, and is in words and figures, as follows, to-wit:

Depositors Guaranty Fund-Payment By State.

"Section 4. The Legislature is hereby authorized and it shall be its duty to provide for the payment of all lawful demands and claims against the Depositors' Guaranty Fund by reason of state banks which failed prior to the adjournment of the Ninth Legislature of this State out of any money in the State Treasury realized from fines, penalties, forfeitures, licenses and privileges, but no money collected by a direct ad valorem tax or tax levied under the laws of this State as a substitute for ad valorem tax shall be used for such purpose. Payment of such claims or demands shall be made in five equal annual installments under rules and regulations as may be prescribed by the Legislature."

CHAPTER 133.

Assistant County Attorneys.

HOUSE BILL NO. 2.

AN ACT amending the last paragraph of Section 1, of Senate Bill No. 55, Chapter 11, of the Session Laws of Oklahoma, 1921, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Amendments.

Section 1. The Fourth or last paragraph of Section 1, of Senate Bill No. 55, Chapter 11, of the Session Laws of Oklahoma, 1921, is hereby amended to read as follows:

"In all counties having a population in excess of 112,000 inhabitants, as shown by the last decennial Federal census, the County Attorney may appoint five assistant county attorneys, to be designated as first, second, third, fourth and fifth assistant county attorneys, respectively. Each assistant county attorney in counties having a population of over 112,000 inhabitants as shown by the last decennial Federal census, shall receive a salary of Three

Thousand Dollars ($3,000.00) per year, by and with the consent of the Board of County Commissioners. In all counties having a population of over 112,000 inhabitants, as shown by the last decennial Federal census, the County Attorney may appoint two stenographers, one of them shall receive a salary of not to exceed One Hundred Fifty Dollars ($150.00) per month, and the other a salary of not to exceed One Hundred Twenty-five Dollars ($125.00) per month, and one Evidence Man, who shall receive a salary of not to exceed Two Thousand One Hundred Dollars $2,100.00) per annum. Each and all of the above designated salaries are to be paid monthly out of the County Treasury, by order of the Board of County Commissioners; Provided, that the assistant county attorneys provided for in this Act are hereby prohibited from practicing law in any other cases or matters except those that come within their duties as assistant county attorneys; and any violation of this Act by them shall ipso facto terminate their appointment and shall immediately be grounds for disbarment from the practice of law as otherwise provided by law."

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist. by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 134.

HOUSE BILL NO. 6.

Superior Court.

AN ACT amending Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, by fixing and providing for terms of the superior court of Creek county, Oklahoma, to be held at Bristow in said county and providing for a clerk of said court and additional deputy county attorneys and fixing the salaries of said clerk and deputy county attorneys, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Amendment.

Section 1. That Section 3154, of Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and is hereby amended to read as follows, to-wit:

"Section 3154. Such Court shall have and exercise concurrent jurisdiction in all matters both civil and criminal with the District Court and County Court of Creek County, except as to matters of probate. Appeals may be taken from the Justice of the Peace Court, in all matters civil and criminal, to either the County, Superior or District Court. Appeals may also be taken from the County Court in all probate matters to either the Superior or District Court. All appeals shall be taken in the same manner and under the same conditions as is provided by law. No judgment rendered in the court at Drumright or Bristow, or the filing of any suit in either Court shall be a lien on real estate until a transcript of said judgment or a

copy of the petition filed in said court, shall be filed and docketed in the Court Clerk's office at the County Seat. The cost of filing and docketing such copy of petition shall be $1.00, and the cost of filing and recording such transcript shall be $1.00."

Amendment.

Section 2. Section 3156, of Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended to read as follows:

"Section 3156. There shall be held in each calendar year at least eight (8) terms of said court in said county, two (2) terms of said court shall be held at Sapulpa, beginning on the first Monday in March and November, in each year, three (3) terms of said court shall be held at Drumright, beginning on the first Monday in February, June and October in each year, and three (3) terms of said court shall be held at Bristow, beginning on the first Monday in January, May and September of each year. The Judge of said court shall have power and authority by order entered of record to fix additional terms of said (sic) at either of said places. Provided, upon petition signed by two-thirds of the members of the Bar of either of said cities respectively, and filed with the Court Clerk, it shall be the duty of said Superior Court Judge, when not elsewhere engaged in holding court, to hold a special term in the city where said petition originates."

Amendment.

Section 3. That Section 3158, Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended to read as follows:

"Section 3158. The Court Clerk of Creek County, Oklahoma, shall by virtue of his office be the Clerk of said Superior Court. He shall have the same power and authority and perform the same duties as Clerk of said Superior Court that he possesses and performs as provided by law as Clerk of the District Court. He shall maintain his office at Sapulpa, Drumright and Bristow and keep suitable records in such office of the proceedings of such Court at Sapulpa, Drumright and Bristow. He shall appoint a Deputy Superior Court Clerk, for each court held at Drumright and Bristow, who shall be a resident of the City of Drumright and the City of Bristow, respectively, to care for said offices and perform the duties of Court Clerk at said places, to keep the said office open at all times for the transaction of business in said Court, and for which service said Deputy shall be paid by the County, One hundred fifty and no/100 ($150.00) Dollars per month. Provided, the County Commissioners shall upon verified vouchers allow a sum not exceeding Two Hundred and no/100 ($200.00) Dollars, per annum for actual traveling and hotel expenses for the Court Clerk, in supervising the office at Drumright and Bristow."

Amendment.

Section 4. Section 3159, Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended to read as follows, to-wit:

"Section 3159. The procedure of said Court, shall follow the

procedure that is or may be provided for the District Court. The
juries of said Court, shall be selected in the same manner as Juries
for the District Court, and the Jury Commissioners, of said County,
whenever they meet to make jury lists for the District Court, shall
make three additional certified lists of jurors of the same number
as for the District Court. One for Sapulpa, one for Drumright, and
one for Bristow, and mark the same respectively: 'Jury List Number
1 for the Superior Court at Sapulpa,' Jury List Number 2 for the
Superior Court at Drumright,' 'Jury List Number 3 for the Superior
Court at Bristow;' and shall deliver the same to the Court Clerk,
and the said Clerk and the Sheriff of the County shall select from
said list the jurors for the Superior Court, for each of said Superior
Court towns, in the same manner as for the District Court. Jurors
in said Court, shall be composed of the same number of men of the
same qualifications as in the District Court, and all laws relative
to juries and jurors for District Court, shall be and are hereby made
applicable to said Superior Court. Appeals from said Court shall be
taken to the Supreme Court of the State of Oklahoma, and the Crim-
inal Court of Appeals of the State in the same manner as is now or
may hereafter be provided by law for taking appeals from the Dis-
trict Court to said Appellate Courts."

Amendment.

Section 5. That Section 3166, Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended to read as follows:

"Section 3166. The County Attorney of said County, shall have power and authority to appoint two additional deputy county attorneys, in addition to all deputy county attorneys now provided for, for such county, one of whom shall reside at Drumright, Oklahoma, and one of whom shall reside at Bristow, Oklahoma, whose duty shall be to give special attention to the prosecution of criminal cases in said Superior Court of said Cities, and for services said deputies shall each receive Two Hundred and no/100 ($200.00) Dollars per month."

Amendment.

Section 6. That Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended by adding a new section to be known as Section 3166-A, to read as follows:

"Section 3166-A. The Superior Court or Judge thereof may at. any time upon his own motion or the motion of any party to any action, either civil or criminal, transfer from one divison of Superior Court, of Creek County, Oklahoma, to any other division thereof, any cause therein pending for trial or further proceedings. Provided that no cause shall be thus transferred until all parties have had at least five (5) days written notice of the purpose so to do and not then if either party to said cause objects."

Amendment.

Section 7. That Chapter 12, Article 4, of the Compiled Statutes of Oklahoma of 1921, be and the same is hereby amended by adding a new section to be known as Section 3166-B, to read as follows:

"Section 3166-B. There shall be provided at the expense of the county, all things, articles, records, offices and places for the
