Repealing Section.

Section 4. All Acts and parts of Acts in conflict herewith are hereby repealed.

Emergency.

Section 5. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 97.

SENATE BILL NO. 284.

County Surveyors.

AN ACT fixing the salary of county surveyors in counties having a population of not less than 15,900 nor more than 15,950, according to the Federal Census of 1920, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

County Surveyor-Salary.

Section 1. In all counties in the State of Oklahoma, having a population of not less than fifteen thousand, nine hundred (15,900), nor more than fifteen thousand, nine hundred fifty (15,950), according to the Federal Census of 1920, the County Surveyor, in addition to the fees now allowed by law, shall receive a salary not to exceed Seven Hundred Twenty ($720.00) Dollars, per annum, to be paid monthly out of the salary fund of such county.

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval. Approved April 9, 1923.

CHAPTER 98.

SENATE BILL 286.

Inaugural Expenses.

AN ACT making an appropriation for the payment of expenses incurred in making the

change of administration and in furnishing traffic guards and extra police protection for the people of the state attending the inaugural ceremonies; providing for the method of filing and auditing said claims.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Appropriation.

Section 1. There is hereby appropriated out of any money in the State Treasury, not otherwise appropriated, the sum of Twenty

five Thousand ($25,000.00) Dollars, or so much thereof as may be necessary to pay the claims for expenses incurred under General Order No. 34, dated December 6, 1922, mobilizing the Oklahoma National Guard of the State for duty at the inauguration of the new administration and Paragraph 8, of Special Order No. 3, dated January 4, 1923, revoking General Order No. 34, dated December 6, 1922, and in carrying into effect the mobilization and performing the duty directed by General Order No. 1, dated January 8, 1923, which called for the immediate mobilization of not to exceed one regiment of the National Guard with stations in and near Oklahoma City for duty as traffic guards, and to furnish additional police protection for the unusual crowds of people in attendance at the inaugural ceremonies. This appropriation is intended to expenses of transportation, freight on equipment and supplies, subsistence, such as meals, meat, bread, groceries, etc., pay of men and officers as provided by law, motor repairs, gasoline, rent of pipe and construction of water supply for camps, care of sick and injured and all expense incident to and a part of this service. Funds Available When.

Section 2. The money herein appropriated to be made available to the military department of the State Government upon the approval of these claims by the Adjutant General, on vouchers and pay rolls in due form and properly drawn and sworn to as true and correct shall be audited by the State Auditor and he shall issue warrants for such claims as is provided by law. CHAPTER 99.

SENATE BILL NO. 288.

Free Fairs.

AN ACT authorizing county commissioners of any county in Oklahoma, with a population of not less than 46,000, and not more than 47,000, or in all counties having a population of not less than 14,020, or more than 14,030, to make a special levy for the purpose of aiding free fairs, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

County Commissioners-Free Fairs.

Section 1. The County Commissioners of any county in Oklahoma, having a population of not less than 46,000, and not more than 47,000, or in all counties having a population of not less than 14,020, and not more than 14,030, are hereby authorized and empowered to include an item in the estimate of the county budget for each fiscal year, for free fair purposes, not to exceed one-half of one mill per year, and the County Excise Board is authorized and empowered to levy a tax sufficient to cover the same; Provided, that the executive board of the County Fair Association shall make a complete itemized report, verified by its president, on or before the close of each fiscal year to the county commissioners, showing the amount of all moneys received from all sources during the year, and an itemized account of all moneys expended, including the amounts paid to each member of the executive board.

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 100.

SENATE BILL NO. 290.

County Clerk.

AN ACT providing for deputy county clerks in counties having a population of not less than 18,950, and not more than 19,000, according to the last preceding Federal Decennial census, fixing their salaries, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

County Clerk-Deputies.

Section 1. In every county in the State of Oklahoma, having a population of not less than Eighteen Thousand, Nine Hundred and Fifty (18,950) and not more than Nineteen Thousand (19,000), according to the last preceding Federal Decennial Census, the County Clerk shall have authority to appoint two deputies as follows: First Deputy at a salary of One Hundred Twenty-five ($125.00) Dollars, per month; second Deputy at a salary of Ninety ($90.00) Dollars, per month.

Board of County Commissioners-Deputies.

Section 2. Whenever the Board of County Commissioners of any such county may deem it necessary, for the efficient handling of the business of the office of the County Clerk of any such County, to employ a third deputy, the County Clerk may employ a third deputy at a salary of not to exceed Seventy-five ($75.00) Dollars, per month, but the action of the Board of County Commissioners, of any such county, finding the necessity for the employment of a third deputy and fixing the salary thereof, must be made a matter of record in the journals of the Board of County Commissioners, before such deputy may be employed by the County Clerk.

Emergency.

Section 3. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 101.

SENATE BILL NO. 292.

Insurance Contracts.

AN ACT relating to insurance cont.acts made by insurance corporations, associations stock companies not having complied with the laws of the State of Oklahoma, making such contracts vold, and prescribing a penalty for violation hereof.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Insurance Contracts-Void.

Section 1. That from and after the passage and approval of this Act, all contracts of insurance made and entered into by insurance companies, corporations, associations, joint stock companies or other persons not having first complied with the laws of the State of Oklahoma, by not having obtained a permit to transact insurance business within the State of Oklahoma from the Insurance Commissioner or the State Insurance Board of said State, shall be null and void, and no property owner or his agent in the State of Oklahoma, shall be liable to such insurance company, association or other person for the payment of any premium upon such contract of insurance, and no action therefor may be maintained in any of the courts of this State.

Non-Admitted Companies-Punishment.

Section 2. Any agent or person representing any such nonadmitted company who solicits or accepts the application of any person owning property in the State of Oklahoma, for insurance in violation of Section 1, of this Act, shall be guilty of a misdemeanor for each such application so received and upon conviction shall be punished by fine of not less than Fifty ($50.00) Dollars, nor more than One Hundred ($100.00) Dollars, for each offense.

Same When May Insure.

Section 3. In case any property owner or applicant for insurance upon satisfactory showing to the Insurance Commissioner of the State of Oklahoma, establishes the fact that he is unable to place sufficient insurance upon his property in any admitted company, corporation, association or other person engaged in the insurance business, then and in that event such person may insure in a non-admitted company, referred to in Section 1, of this Act, without such contract constituting a violation of this Act, and no agent writing such policy shall be guilty of an offense as stated in Section 2, hereof.

CHAPTER 102.

SENATE BILL NO. 295.

Court Bailiffs.

AN ACT relating to the appointment of a court bailiff in all counties in the State of Oklahoma having a population of not less than fifty-five thousand nor more than fifty-six thousand, as shown by the last preceding Federal Decennial Census, additional court bailiff, prescribing their duties, fixing their salaries, and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :

Court Bailiff-Appointment-Salary.

Section 1. In all counties of the State of Oklahoma, having a population of not less than Fifty-five Thousand (55,000), nor more than Fifty-six Thousand (56,000), as shown by the last preceding Federal Decennial Census, the District Judge shall appoint a Court Bailiff, who shall receive a salary of One Hundred Fifty ($150.00) Dollars, per month, to be paid out of the County Treasury from any money to the credit of the Court Fund of such county. Said Bailiff, so appointed, shall be in attendance at all times, and shall serve all of the courts of record sitting at the County seat. Provided, that when it becomes necessary to make a temporary appointment of an additional bailiff to serve any of said courts while sitting at the county seat, or at any other place in said counties, the Judge requiring the services of an additional bailiff may appoint some suitable person to serve for such time as said court may require. A bailiff holding under temporary appointment, shall receive Three ($3.00) Dollars, per day, while in actual attendance upon the court, to be paid out of the County Treasury of said county from any money to the credit of the Court Fund. Provided, further, that where court is held at more than one place in said county, the Judge of said court making a temporary appointment of a bailiff shall designate the place of actual residence of said bailiff as his official residence, and when said bailiff is in attendance at court, upon the order of said Judge, at any place in said county other than his official residence, he shall be allowed, in addition to his salary, his actual expenses, the same in no event to exceed the sum of Two and Fifty-Hundredths ($2.50) Dollars, per day.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.
