it fhall and may be lawful to and for His Majesty, His Heirs, and Succeffors, by His or Their Proclamation, to prohibit and restrain all Small Boats and Veffels, under the Burden of Twenty Tons, from failing or paffing out of any Port or Place of Great Britain or Ireland, or the Iles of Guernsey, Jersey, Alderney, Sark, and Mann, or any of them, until Security be firft given by the Mafter of every fuch Boat or Veffel respectively, to the Satisfaction of the principal Officer of the Customs, or the chief Magiftrate of the Port or Place from whence fuch Boat or Veffel fhall fail, by Bond taken to the King, His Heirs, or Succeffors, with fufficient Sureties, in the Penalty of Three hundred Pounds, with Condition, that if fuch Boat or Veffel fhall not go to, or touch at, any Country, Port, or Place, to be mentioned for that Purpose in fuch Proclamation; and if the Master, or other Person having Charge of fuch Boat or Veffel, and all and every Mariner and Mariners, Paffenger and Paffengers, going in fuch Boat or Veffel, fhall, during the Time aforefaid, not go on Board any other Ship or Veffel at Sea; and if such Mafter, or other Perfon having Charge of fuch Boat or Veffel, shall not permit or fuffer any Person or Persons to come on Board fuch Boat or Veffel at Sea from any other Ship or Veffel, and thall not, during the Time aforefaid, receive any Goods and Merchandizes whatsoever out of any other Ship or Veffel, then fuch Bond fhall be void, or to fuch Effect; for the making of which Bond, no Fee or Reward whatsoever shall be taken; and in cafe any Boat or Veffel, Veffels fail- for which fuch Security fhall be required by fuch Proclaing without mation, shall set fail or pass out of any Port or Place of giving fuch fecurity, to Great Britain or Ireland, or the Ilands of Guernsey, Jer be forfeited, fey, Alderney, Sark, or Mann, or any of them refpectively, before fuch Security be given as aforefaid, every fuch Boat or Veffel fo failing or paffing out of any Port or Place, contrary to the true Intent and Meaning of this Act, together with her Tackle, Apparel, and Furniture, fhall be forfeited to the King, His Heirs, and Succeffors, and fhall and may be feized, fued for, and recovered in His Majefty's Court of Exchequer, at Westminster, Edinburgh, or crew to for- Dublin, or in the proper Courts of the Iles of Guernsey, Ferfey, Alderney, Sark, or Mann, refpectively, to the Ufe

of His Majefty, His Heirs, and Succeffors; and the Maf- GO. 11, ter of, and every Mariner failing in, any fuch Boat or Vef- POLICE, fel, being thereof lawfully convicted upon his or their Appearance or Default, upon the Oath or Oaths of One or more credible Witness or Witneffes, by One or more Juftice or Juftices of the Peace where fuch Offender fhall be found (which Oath fuch Juftice or Juftices of the Peace are hereby impowered and required to adminifter), fhall forfeit the Sum of Twenty Pounds; One Moiety thereof to the Informer, the other Moiety to the Poor of the Parish where fuch Offender fhall be found; the fame to be levied by Distress and Sale of the Offender's Goods, by Warrant under the Hand and Seal, or the Hands and Seals of fuch Juftice or Juftices before whom fuch Offender shall be convicted, as aforefaid; and for want of fufficient Diftrefs, every such Offender shall, by fuch Justice or Juftices, be committed to Prifon, there to remain without Bail or Mainprize, for the Space of Three Months; and in cafe any fuch Offender shall be found in any of the said Isles of Guernsey, Jersey, Alderney, Sark, or Mann, and shall be lawfully convicted of fuch Offence in any Action or Suit to be founded on this Act, in the proper Court of any of the faid Ifles where he fhall be fo found, fuch Offender shall forfeit the Sum of Twenty Pounds; One Moiety thereof to the Informer, and the other Moiety to the Poor of the Parish or Place where fuch Offender fhall be found; and, in Default of paying fuch Penalty, fhall fuffer Imprifonment, without Bail or Mainprize, for the Space of Three Months.

21, AND be it further enacted by the Authority aforefaid, That if any Action or Suit fhall be commenced against any Perfon or Perfons for any Thing done in purfuance of this prefent Act, the Defendant or Defendants General if in fuch Action or Suit may plead the General Iffue, and give this Act, and the Special Matter in Evidence, at any Trial to be had thereupon; and that the fame was done in pursuance, and by the Authority of the said A&t; and if it shall appear fo to have been done, then the Jary fhall find for the Defendant or Defendants; and if the Plaintiff fhall be Nonfuited, or discontinue his Action, after the Defendant or Defendants fhall have appeared; or if Judgment shall have been given upon any Verdict or Demurrer against the Plaintiff, the Defendant or Defendants shall and may recover Treble Cofts, and have the like Remedy for the fame, as the Defendant or Defendants hath or have in other Cafes by Law.

[HERE follows a narrative of the ftatutes, 39 Geo. III, Preamble. c. 99; 26 Geo. II, c. 6; 12 Géo. III, c. 37.] Be it therefore enacted, &c. That it fhall and may be lawful for the The treafuLords Commiffioners of His. 2, AND whereas it is reasonable that the Owners of Ships, Veffels, and Cargoes, which in future shall have to perform Quarantine, fhould defray the Charge incurred thereby; be it further enacted, That from and after the First Day of October One thoufand eight hundred, there shall be raised, levied, collected, and paid, to His Majefty, His Heirs, and Succeffors, the several and respective Duties of Customs herein after mentioned; that is to fay, for every Ton Burthen of every Ship or Veffel, the Cargo of which, or any Part thereof, fhall have performed Quaran tine in this Kingdom, and which shall have arrived from any Part of Turkey, or from any Port or Place in Africa within the Streights of Gibraltar, or in the Weft Barbary on the Atlantic Ocean, with a clean Bill of Health, Seven Shillings and Sixpence; for every Ton Burthen of every fuch Ship or Veffel, which fhall have fo arrived without a clean Bill of Health, Fifteen Shillings; for every Ton Burthen of every Ship or Veffel, the Cargo of which, or any Port thereof, shall have performed Quarantine in this Kingdom, and which fhall have arrived from any Port or Place whatever, except from any Part of Turkey, or from any Port or Place in Africa within the Streights of Gibraltar, or in the Weft Barbary on the Atlantic Ocean, with a clean Bill of Health, Three Shillings; for every Ton Burthen of every fuch Ship or Veffel, which shall have fo arrived without a clean Bill of Health, Ten Shillings; for every Ton Burthen of every Ship or Veffel arriving in this Kingdom, with a Cargo, which in Whole or in Part fhall confift of Goods, Wares, or Merchandize, the Growth, Produce, or Manufacture, of Turkey, or of any Port or Place in Africa within the Streights of Gibraltar, or in the Weft Barbary on the Atlantic Ocean, and which shall have performed Quarantine in this Kingdom, and which fhall have arrived from any Port or Place in Holland, or from any Port or Place whatever at which there is not a
