EXPLANATORY NOTE

The Civil Code, the Code of Civil Procedure, the Political Code, and the General Laws contain a large number of enactments of a penal nature which have never been incorporated in the Penal Code. It is the purpose of this index to refer to such provisions in order that, in this volume, there may be found references to all statutes which define or create public offenses.

The references in this index have been collected by a page to page examination of the three non-penal Codes and of the General Laws down to and including the enactments of 1923. For this purpose only those statutes which provide that some act or omission constitutes a crimefelony or misdemeanor-or is punishable by fine or imprisonment or both, have been considered to be penal provisions. No reference is made to penalties of a civil nature or to those which are enforceable otherwise than by criminal proceedings, such as proceedings for contempt. But the character of the penalty imposed is sometimes doubtful, and in such cases reference to the statute is not included.

It is probable that some provisions of a penal character have escaped the compiler's attention, especially in the case of the longer and more complicated statutes where there is nothing to indicate or suggest the presence of a short penal provision. And it is probable also that some of the references are to statutes which have been superseded; but this is not of much importance.
