An ACT authorizing the sale of certain real estate late the property of James Stewart, of Luzerne county, deceased.

WHEREAS it satisfactorily appears to the legislature that it would be beneficial to the legatees of James Stewart, late of Luzerne county, deceased, to authorize the sale of part of said deceased's real estate; Therefore,

SECT. I. Be it enacted by the Senate and House of Representa iives of the commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the authorized to di. orphans' court of the county of Luzerne, be, and they are hereby empowered, upon the petition of the widow and executors, (or) the survivor of them,) of the late James Stewart of the said James Stewart, County, deceased, to authorize the said executors or the survivor of them to sell, in such manner as the said court may deem best, the real estate of the said James Stewart, situate in the county aforesaid, for the payment of his debts and the maintenance and education of the minor children, or such part thereof as the said court may think the interest of the creditors, legatees, and devisees of the said James Stewart require, and to convey the same as fully and effectually to the purchaser, his heirs and assigns, as if they had been authorized so to do, by the will of the said James Stewart: Provided, That before they make any such order the said court shall take from the said executors a bond with sufficient security conditioned for the faithful performance of the trust reposed in them, and for the application

CHAPTER LXIII.

An ACT dissolving the marriage of William Moland and
Hannah bis wife.

WHEREAS it hath been represented by the petition of Hannah Moland of the county of Bucks that she was legally married to William Moland, on the nineteenth day of October, Anno Domini one thousand seven hundred and seventy-three, that shortly after their intermarriage her said husband suffered himself to become the victim of intemperance, and forgetting the affectionate duty of a husband did ill-treat and personally abuse his said wife; And whereas the cruel and unjust conduct of the said William Moland is satisfactorily proven to the legislature, by sundry documents accompanying the petition; Therefore,

SECT. I. Be it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the marriage contract entered into by William Moland and Hannah William Moland Moland, be, and the same is hereby declared to be null and Moland dissolv. void, and the parties respectively set free and discharged therefrom, and all the rights and duties arising under the same, as fully and absolutely as if they had never been joined in marriage; but nothing herein contained shall be construed to render illegitimate any child or children born of the body of the said Hannah during the coverture.

An ACT to declare Lycoming creek in the county of Lycoming, a public highway.

SECT. I. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority Lycoming creek of the same, That from and after the passing of this act, Lydeclared a public coming creek in the county of Lycoming, from the mouth thereup the same to where the line of Tioga county crosses the said creek, shall be and the same is hereby declared a public highway, for the passage of rafts, boats and other vessels under under certain re- limitations and restrictions hereinafter specified; and it shall and

CHAPTER LXV.

An ACT granting an annuity to Thomas Hill..

WHEREAS it appears to the legislature that Thomas Hill was regularly discharged from the Pennsylvania line at the close of the revolutionary war, and that while in the military service of his country he received an injury in his knee from which, combined, with the infirmities of age, he is rendered totally unable to procure a subsistence by labour; Therefore,

SECT. I. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in general assembly met, and it is hereby enacted by the authority of the same, That the state treasurer be and he is hereby authorized to pay to Thomas Campbell of York county, forty dollars out of any unappropriated monies in the treasury, to be applied to the use of Thomas Hill, and that an annuity of forty dollars be granted to the said Thomas Hill, to be paid half yearly during his life to the said Thomas Campbell of said county, his executor or executors, administrator or administrators, his or their lawful attorney, by the state treasurer out of any unappropriated monies in the treasury, to commence the first day of January,
