and the increase and profits thereof, and of enlarging the same from time to time by new subscriptions in such manner and form as they shall think proper, if such enlargement shall be found necessary to fulfil the intent of this act; and of purchasing, taking and holding to them and their successors and assigns; and of selling, transferring and conveying in fee simple or for any less estate, all such lands, tenements, hereditaments and estates real and personal, as shall be necessary to them in the prosecution of their works; and of suing and being sued; and of doing all and every other matter and thing which a corporation or body politic may lawfully do.

SECT. III. And be it further enacted by the authority aforesaid, Notice to be giv en of organizing That the commissioners aforesaid as soon as conveniently the company. may be after said letters patent shall be sealed and obtained shall give notice in two of the public newspapers in the borough of York, and elsewhere if occasion may require, of a time and place by them to be appointed, not less than twenty days from the publication of the first notice; at which time and place the said subscribers shall proceed to organize the said corporation, and shall choose by a majority of votes of the said subscribers, by ballot to be delivered in person or by Officers to be proxy duly authorized, one president and twelve managers, one treasurer, and such other officers as they shall think necessary to conduct the business of the said for one company year, and until such other officers shall be chosen; and the said managers so chosen and their successors shall and make such by-laws, rules, orders and regulations, not inconsistent with the constitution and laws of this commonwealth, as shall be necessary for the well ordering the affairs of the said company; and generally have like powers, authorities and privileges, necessary for carrying on and completing the said turnpike road; and be subject to all the duties, qualifications, restrictions, penalties, fines and forfeitures; and be entitled to like tolls and profits in proportion to the distance, as are given and granted to the president, managers and company of the Susquehanna and York borough turnpike road; Provided, That if the company shall not proceed to carry on Proviso. the said work in three years after the passing of this act, or shall not within seven years afterwards complete the said road according to the true intent and meaning of this act, then in either of these cases, all and singular the rights, liberties and franchises hereby granted to the said company, shall revert to this commonwealth.

CHAPTER CXLIII.

An ACT for the relief of George Youndt, the younger, a pri. soner confined in the jail of Lancaster county.

WHEREAS at a court of quarter sessions of the peace held at Lancaster for the county of Lancaster, George Youndt the younger, of said county. was convicted f fornication and bastardy, and was ordered by the court among other things, to "give security to the directors of the poor of the count of Lancaster to indemnify said county against the maintenance of the bastard ;" and it being represented to the legislature that the said George Youndt the younger is confined in the jail of said county, and is unable to obtain the security required by said sentence, and there being no existing law providing for his case; Therefore,

SECT. I. Be it enacted by the Senate and House of Repre tobe liberated sentatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passing of this act, the said George Youndt, the younger, shall not be detained in prison, merely for want of the security directed to be given to the directors of the poor of the county of Lancaster under the sentence aforesaid.

CHAPTER CXLIV.

An ACT granting to John Carson, a certain tract of land.

WHEREAS it hath been represented to the legislature that John Carson of Union township in the county of Erie did settle on a tract of donation land situate in the tenth district, numbered one thousand nine hundred eighty-seven, containing two hundred acres; and it also appears that the said tract of land has never been drawn by any person, and that the said John Carson had settled on the same believing it to be vacant, and has complied with all the conditions required by the act for the sale of the vacant lands north and west of the rivers Ohio and Allegheny, and Conewango creek; Therefore,

SECT. I. Be it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the

CHAPTER CXLV.

An ACT to relinquish the right of this commonwealth to certain real and personal estate lately beld by Charles Morris and Henry Morris, and to vest the same in Mary M'Curdy and Jane Henry.

WHEREAS it appears to the legislature that by virtue of a devise in the last will and testament of Stephen Chambers, late of the borough of Lancaster, deceased, Charles Morris and Henry Morris were jointly entitled to a third part of a moiety of the residue of the real and personal estate of the said Stephen Chambers after the payment of his debts and the specific legacies mentioned therein, and that the said Charles Morris and Henry Morris being illegitimate children of the said Stephen Chambers, died intestate and without issue, whereby their estate is liable to escheat to this commonwealth; And whereas it ap pears that Mary McCurdy and Jane Henry both of the borough of Lancaster would be entitled under the intestate laws of this Commonwealth to the estate of the said Charles Morris and Henry Morris in case they had been born in lawful matrimony; Therefore,

CHAPTER CXLVI.

An ACT making appropriations to defray certain expenses of government.

SECT. I. BE it enacted by the Senate and House of Representatives of the commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That for clerk hire in for the payment of the expenses hereinafter mentioned the following sums are hereby appropriated, to wit, for clerkhire in the office of the secretary of the commonwealth for one year, fifteen hundred dollars; for clerk hire in the office of the secretary of the land-office for one year, commencing on the first of April, one thousand eight hundred and eleven, the sum of three thousand seven hundred dollars; which together with the permanent appropriation of sixteen hundred dollars for that office shall be expended by said officer in the employment of eight clerks in his office; for clerk hire in the office of the surveyor Surveyor-gene- general, for the year commencing on the first day of April,

aforesaid, the sum of two thousand four hundred dollars, which together with the permanent appropriation of two thousand dollars for that office, shall be expended by the said surveyor-general in the employment of seven clerks in his office, and the clerkhire aforesaid shall be paid quarterly in the usual manner; for contingent expenses in the office of the secretary of the commonwealth, for one year, eleven hundred dollars; for contingent expenses in the office of the secretary of the land-office for one year, two thousand two hundred dollars; and for contingent expenses in the office of the surveyor-general for one year, including the expenses of the board of property, six hundred dollars; and the sums hereby appropriated shall be paid by the state treasurer out of any money in the treasury not otherwise appropriated; previous to which the officers holding the aforesaid offices shall exhibit their accounts and vouchers for said expenditures, to the accountant department to be adjusted and settied.

SECT. II. And be it further enacted by the authority aforesaid, That the sum of eight hundred dollars, be, and the same is here
