Resolution

Relative to that part of the Columbia and Philadelphia rail road, which passes through the city of Lancaster.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Canal Commissioners be and they are hereby authorized and required to pay to the city of Lancaster the sum of sixteen thousand eight hundred and fifty-s y-seven dollars and ninetyone cents, an unpaid part of the appropriation made by a reso. lution of the twenty-fourth day of April, Anno Domini, eighteen hundred and thirty-two, for the purpose of defraying expenses in changing the location of the Columbia and Philadelphia rail-road through the said city, said sum being the balance of said appropriation, after deducting thirteen thousand nine hundred and seventy four dollars and thirty cents, the amount paid by the State for completing with rails the additional length occasioned by the said change.

Relative to the pension of Isaac Vanhook.

WHEREAS, the Legislature of eighteen hundred and thirty. three, passed an act granting to Isaac Vanhook, of Fayette county, a soldier of the revolutionary war, a gratuity of forty dollars immediately and forty dollars during life, payable half yearly, to commence on the first day of January, one thousand eight hundred and thirty-three: And whereas, The said Isaac Vanhook died without receiving the gratuity or any part of the annuity; Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the State Treasurer be and he is hereby authorized and required to pay to Sarah Vanhook, widow of the said Isaac Vanhook, late of Fayette county, deceased, or to her order the gratuity that was granted to her said husband.

Resolution

Relative to the distribution of the Pamphlet Laws.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the treasurers of the several counties within this Commonwealth are hereby directed to advertise in one or more newspapers, published in the respective county, during the three first weeks of December in every year, that they will receive subscriptions for the pamphlet laws of this Commonwealth : Provided, The laws so subscribed for, shall be distributed agreeably to the provisions of the resolution, passed the second day of March, one thousand eight hundred and twenty-six, entitled, A resolution for the further distribution of the pamphlet laws of this Commonwealth.

To authorize the Canal Commissioners to enquire into the claims for damages of Jane Reese and others.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Canal Commissioners are hereby authorized and required to enquire into and ascertain whether the loss sustained by Jane Reese, in the burning of her property near the Colum. Jane Rees bia and Philadelphia rail-road, in the month of November, one thousand eight hundred and thirty-four, and also, whether the loss sustained by Joseph J. Downing, Jeremiah Moore, James J.J.Dowaing, Ogden and Job Griffith, in the burning of their property near the Columbia and Philadelphia rail-road, in the months of January and February, one thousand eight hundred and thirty-five, were caused by fire from any locomotive engine or engines belonging to the State, and if they find the said property was set on fire by fire from any locomotive engine or engines, as aforesaid, then the said Canal Commissioners shall ascertain the actual loss sustained by the said persons, and what damages they are entitled to, and shall pay the same to the said persons out of the damage fund, and the said payments shall be allowed by the Auditor General as in other cases: Provided, That if it ap- Proviso. pears to the said Canal Commissioners that any portion of the said property was suffered by negligence to be burned, which might by reasonable and proper exertion have been saved, no damage shall be allowed for the loss of such property so suffered to be destroyed.

Resolution

For the relief of Samuel Boon, Joshua Hause and James McClure.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the board of canal commissioners be and they are hereby required to construct or cause to be constructed, such drain as may be necessary to drain from the lands of Samuel Boon, Joshua Hause and James McClure, of the township of Bloom, in the county of Columbia, all waters by which their lands are now or may hereafter be inundated in consequence of leakage from the Pennsylvania canal.

Resolution

For relief of George Weiser.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the canal commissioners be and they are hereby authorized to settle and adjust the claim of George Weiser, late a contractor for building the abutment at Shamokin dam, on the east side of the Susquehanna river, and to make him such allowance for work he has done, and stone for which he has been overcharged in the settlement of his accounts, as may upon examination and investigation appear equitable and just, and the Auditor General is hereby authorised to audit the same in the way and manner other claims are audited.

Resolutions

Relating to the Chesapeake and Delaware canal.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Governor be requested to cause an inquiry to be made into the obstructions that have been thrown into the way of the free and unembarrassed use of the Chesapeake and Delaware canal, and to use all legal and constitutional means to have the same removed, so that the citizens of this Commonwealth may have the full benefit and advantage from this great public highway, which were contemplated by the charter and by the contributions of this Commonwealth and her citizens for the construction of the same.
