as may be closed by virtue of this act, and a plot thereof to be filed in the office of the clerk of the court of Quarter Sessions for the said county.

SECTION 3.

The Court of Quarter Sessions of the county aforesaid, upon the petition of any person or persons conceiving himself or themselves to be injured in their property by the va cation of the aforesaid part of said Cherry alley, shall appoint three discreet and reputable freeholders, neither of whom shall reside or own real estate in the said town of Washington, who, being first sworn or affirmed, shall inquire what damages the petitioner or petititioners shall or may sustain by reason of said vacation, and make report to the next Court of Quarter Sessions after their appointment: Provided always, That it shall be the duty of the said freeholders, in assessing damages, to consider the advantages which may accrue to the petitioner.

SECTION 4. Upon the return of the report as aforesaid, if it shall be approved by the court, the damages (if any) so awarded, shall be paid to the petitioner by the treasurer of the board of trustees of said Washington college.

SECTION 5. No petition for damages shall be received and acted on by the court, unless presented within six months from the date of this act.

A Supplement

To the act entitled An act directing the collection of a debt due to the Commonwealth, passed the ninth April, one thousand eight hundred and thirty-three.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General "Assembly met, and it is hereby enacted by the authority of the same, That the judges of the Supreme Court be and they are hereby authorized and required to hold Circuit Courts in the county of Allegheny, for the trial and final determination of the action and legal proceedings directed to be instituted in the name of the Commonwealth against the mayor, aldermen and citizens of Pittsburg, by the act to which this is a supplement,

as effectually and to all intents and purposes as if the said Circuit Courts had not been abolished.

SECTION 1. Be it enacted by the Senate and House of Rep resentatives of the Commonwealth of Pennsy vania in General Assembly met, and it is hereby enacted by the au hority of the same, That all acknowledgments or probates of deeds or other instruments of writing, heretofore taken or made or which shall hereafter be taken or made, shall be construed to have the samo effect to all intents and purposes, although the same may have ments made been certified by the officers before whom such acknowledg- valid, where ments or probates have been made under their hands only, as seals haye if the same had been certified under their hands and seals; been omitted. and the omission in any certificates heretofore made, or hereafter to be made, by any officer authorized to take such acknowledgments and probates, to certify the same to have been taken before him under his seal, (the same being duly certified under his hand,) shall not be held or adjudged to avoid, prejudice, or render invalid the acknowledgment or probate of any deed or other instrument of writing as aforesaid, nor shall the recording heretofore done, or hereafter to be done, of any deed or other instrument of writing as aforesaid, be deemed invalid or defective by reason of the omission of any such officer as aforesaid to certify any acknowledgment or probate as aforesaid under his seal, the same being certified under his hand in due form.

SECTION 2. That from and after the passage of this act, the aldermen for the county of Philadelphia shall have like juris- aldermen of diction with the aldermen of the city of Philadelphia, in the Philad'a co. acknowledgment of deeds and other instruments of writing.

An Act

To continue the benefit of the unexpired term of an auctioneer's commission to Matthew P. Mitchell.

SECTION 1. Be it enact d by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Matthew P. Mitchell, of the city of Philadelphia, commission merchant, late of the firm of Gillingham, Mitchell & Co., is hereby licensed as an auctioneer of the said city, for the period of eight months and thirteen days, and no longer, with the powers conferred by the license heretofore paid for and granted for one year to Mahlon. Gillingham, but not used by him for the last eight months and thirteen days of said year: Provided, That the said Matthew P. Mitchell shall not enter -upon the said business of an auctioneer, until he furnishes the security required by law for the payment to the State of all duties and taxes which may become due in consequence of his exercising the trade or occupation as aforesaid, and until he procures the consent of the partners of the said late firm of Gillingham, Mitchell & Co. to the provisions of this ac:.

An Act

To alter the time of holding the courts in Washington county.

SECTION 1. Be it enacted by the 'Senate and House of Representatives of the Commonwealth of Pennsylvania in Gineral As embly m t, and it is hereby enac ed by the authority of the same, That the term of the several courts in the county of Washington, which by the existing law now commences on the fourth Monday of January, shall, from and after the of passage this act, commence on the Monday next preceding the last Monday of December, in each and every year, and that so much of

any law as is inconsistent herewith be and the same is hereby repealed.

SECTION 2. The coming spring term of the several courts of the said county of Washington, which according to the pre- Spring ter.n sent law should commence on the fourth Monday of March time of com. next, shall, instead thereof, commence on the fourth Monday of mencing April next; and all jurors, witnesses and other persons, bound altered. by recognizance or otherwise to appear at the said March term, shall appear before the judges of the said courts on the said fourth Monday of April: and all writs, process, precepts, recognizances, and other proceedings in the said courts, or re turnable to the said fourth Monday of March, shall be entitled as of March term, and be as good and effectual, to all intents and purposes, as if no change was made in the time of holding said spring term of the said courts: and the sheriff of the said county shall give at least three weeks' public notice, in two of the newspapers printed in said county, of the change in the given. time of holding said courts, the expense thereof to be paid out of the county funds: Provided, That this second section sha!l Proviso, not be construed to alter the law fixing the time of holding the spring term of the said courts, except in so far as relates to the one term therein mentioned.

An Act

Providing for the use of horses on parts of the Allegheny Portage rail. road and Philadelphia and Columbia rail-road.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the canal commissioners are hereby authorized and required to contract with individuals or associations of individuals, for the supply of such horses or other beasts of draft,

drivers and attendants, as may be found necessary or useful for transporting persons or merchandise across the Allegheny Portage, on such levels of the rail-way where in their opinion the use of animal power is required or expedient; and also on the levels at the foot of the inclined planes near Philadelphia and at Columbia, of the Philadelphia and Columbia rail-way : Provided, That no contract made for such supply for such levels on the Philadelphia and Columbia rail-way, shall continue longer than the fourth of March, one thousand eight hundred and thirty-six and they are further required to make a separate contract for each level; which contracts are hereby directed to be made in the same manner and subject to the same regulations, limitations and restrictions, which are contained in the sixth section of an act passed on the twenty-fifth day of February, one thousand eight hundred and twenty-six, and the twentieth section of the act passed on the ninth day of April, one thousand eight hundred and twenty-seven, so far as these sections relate to contracts, excepting that the canal commissioners shall not be required to give more than seven days notice when they shall invite proposals this year by the authority of this act, and thereafter twenty days notice shall be given.
