signs, and whoever shall own and possess the said bridge, shall Penalty for collect or demand any greater rate or prices for the passing over ex ortion. the said bridge, than what are herein before prescribed and specified, or shall neglect to keep the said bridge in good repair, he, she or they so offending, shall for every such offence, forfeit and pay the sum of thirty dollars; one-third thereof for the use of the poor of the county of Bucks, in the state of Pennsylvania, and one-third thereof for the use of the poor of the township of Kingwood, in the state of New Jersey, and the other third for the use of the person who may sue for the same: Provided always, That no suit or action shall be brought, unless Proviso. within sixty days after such offences shall be committed.

SECTION 14. SECTION 15. The said president, directors and company, shall also keep a just and true account of all and every the moneys received by their respective collectors of tolls, for crossing the said bridge, and shall make and declare a dividend of the Dividends. profs and income thereof, among all the stockholders of the said company, de lucting first therefrom, all contingent costs and harges, and such proportion of said income, as may be deemed necessary for a growing fund, to provide against the dee

and for the rebuilding and repairing the said bridge; and shall on every first Monday in May and November, in each and every year, publish the dividend to be made of the said clear profits thereof amongst the stockholders, and of the time and place where and when the same shall be paid, and shall cause the same to be paid accordingly.

SECTION 6. This act shall not take effect or go into opera tion, until the legislature of the state of New Jersey shall pass Concurrence a law, appointing commissioners on their part, and vesting like of N. A Supplement

To the act entitled An act authorizing the Governor to incorporate the Bald Eagle and Spring Creek Navigation company," passed the fourteenth day of April, one thousand eight hundred and thirty-four.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is her by enacted by the authority of the same, That the faith of the State be and is hereby pledged for the payment of an interest of five per cent. per annum, half yearly, to those who shall be subscribers to the stock of the Bald Eagle and Spring Creek Navigation company, on a sum not exceeding two hundred thousand dollars, for a period of twenty-five years.

SECTION 2. It shall be the duty of the said president, managers and company, to commence the said work at the pool of commanding the State dam on the Bald Eagle creek, and to put under conthe work, & tract and so progress with said navigation as soonest will produce tolls; to declare dividends semi-annually on the noit profits of every section of five miles, which dividends shall be duly certified to the Auditor General, on the oath or affirmation of the president and treasurer of the said company, within fifteen days after the first Monday of January and second Tuesday in July, in each and every year: the Auditor General, if there should be a deficit of five per cent. on the money so expended, shall report the same to the Governor, who shall draw his warrant on the State Treasurer for any balance that may be required to pay the said interest of five per cent.: Provided, That as the navigation is completed, the tolls shall be declared on the same, and certified as aforesaid; and any deficiency which may be required to pay the said interest of five per cent., semi-annu

SECTION 3. It shall and may be lawful for the Commonwealth of Pennsylvania, at any time after the said guarantee Right of the shall cease, under the provisions of this act, to take possession State to buy the works, of the said navigation and improvements, and connect the same with their other works of inland navigation, on payment of the neat cost thereof; and from thenceforth all the chartered privileges granted to the said company shall cease and determine.

SECTION 4. It shall be the duty of the commissioners, cr majority of them, named in the first section of the act to which Manner of this is a supplement, before they open the books to receive sub-taking subscriptions to the stock of the said company under this act and scriptions, & c the act to which this is supplementary, to offer one hundred and eighty thousand dollars of the said stock at private sale in the city of Philadelphia, or elsewhere, at such premium as can be obtained for the same; and if a premium can be so obtained, the balance of twenty thousand dollars shall be offered for sale in the county of Centre, at the like premium ; and any advance which may be obtained at the sale of the said stock, shall be paid into the State Treasury, to meet any demand of interest which shall be required under the provisions of this act: ro- Proviso. vided, That if no advance can be obtained on a sale of the said stock as aforesaid, then the said commissioners, or a majority of them, shall open the books under this act, and the act to which this is supplementary, at such times and places hereafter as shall be deemed proper and expedient, to obtain the stock in couformity with the said acts: And provided further, That the 2d Provise. rates of tolls shall at no time be lower than those charged on the canals of the Commonwealth.

An Act

To incorporate the Resolution Hose company in York.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all and every the persous who shall at the time of passing this act be members of the association called the Resolution Hose company, in the borough of York, and all such persons as may thereafter be regularly admitted as members of the same, shall be and they are hereby created and declared to be one body politic and corporate, by the name, style and title of the "Resolution Hose company in the borough of York;" and by the same name shall have perpetual succession, and shall be able to sue and be sued, implead and be impleaded, in all courts of record or elsewhere; and to purchase, receive, have, hold and enjoy, to them and their successors, lands, tenements, rents, annuities, franchises and hereditaments, goods and chattels, of what nature, kind or quality soever, real, personal or mixed, or choses in action; and the same from time to time to sell, grant, devise, alien or dispose of: Provided, That the clear yearly value or income of the necessary houses, lands and tenements, rents, annuities or other hereditaments and real estate of the said corporation, and the interest of money by it lent, shall not exceed the sum of five hundred dollars. And also to make and have a common seal, and the same to alter and renew at pleasure; and also, by a majority of such number of the members as by the constitution of the said association form a quorum, to transact the business thereof, to ordain, establish, and put in execution, such by-laws, ordinances and regulations, as shall appear necessary and convenient for the govern ment of the said corporation, not being contrary to this charter, or the constitution and laws of the United States or of this Commonwealth; and generally to do all and singular the matters and things which to them it shall lawfully appertain to do, for the well-being of the said corporation, and the due management 2d Proviso. and ordering of the affairs thereof: Provided, That nothing in
