An Act

Relative to the bonds of County Treasurers in the Auditor General's office.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of l'ennsylvania in General Assembly met, and it is hereby enacted by the authority of the sum, That it shall be the duty of the Auditor General, at the request of any person who may be authorized for that purpose, to deliver up the bonds and obligations entered into by the county treasurers of the several counties of the State, for the faithful performance of their duties, after the Auditor General and State Treasurer shall be fully satisfied that the said county treasurer has settled his accounts and paid all demands due the Commonwealth Provided, Such bond shall be held by the Proviso. To An act for the preservation and repair of the Cumberland road.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be the duty of the supervisors of highways of the several townships in the counties of Somerset, Washing- Duty of supervisors. ton and Fayette, through which the Cumberland road passes, to make or cause to be made, a paved valley or stone culvert, where any state, county or township roads shall intersect the said Cumberland road, so as to admit the free passage of water along the side of the same.

logs for the use of their farms, and when it shall be covered with ice, or shall stand any wagon, coach, or other carriage, over night, or for the purpose of feeding, or shall in any manner purposely obstruct the travelling upon the same, he shall forfeit and pay a sum not exceeding five dollars, to be recovered and applied as is directed by the ninth section of the act to which this is a supplement.

SECTION 3. The surrender by the United States of so much of the Cumberland road as lies within the State of Pennsylvania, is hereby accepted by this State; and the commissioners to be appointed under this act are authorized to erect toll gates on the whole or any part of said road, at such time as they may deem it expedient and proper to do so.

SECTION 4. The toll gatherers shall keep an accurate account of all moneys received by them, and, when required by the commissioners, shall make out a statement of the same under oath or affirmation.

SECTION 5. Each of the commissioners, before entering upon Commiss'ne's the performance of his duties, shall give a bond to the Commonwealth, in the penal sum of three thousand dollars, with security, to be approved by one of the judges of the courts of Common Pleas of Somerset, Fayette or Washington counties, conditioned for the faithful performance of their respective duties. SECTION 6. The Governor of this Commonwealth is hereby appoint two authorized to appoint two commissioners, who shall have the commiss'ners authority conferred and perform the duties, and be subject to the responsibilities, imposed upon the commissioners appointed under the act of the fourth April, one thousand eight hundred and thirty-one; and they shall each receive a compensation of two dollars per day for every day they shall be necessarily engaged on the business of said road: Provided, That the annual compensation of each commissioner shall not exceed for the first year, from the time of entering upon his duties, the sum of four hundred dollars, and for each subsequent year three hundred dollars; and the commissioners appointed in pursuance of this act shall be removable by the Governor, who shall have power to fill any vacancy which may occur in consequence of death, resignation or removal.

A Supplement

To the act incorporating the Schuylkill Valley Navigation and Rail Road Company, and to the several supplements thereto, and to extend the time of commencing and completing the Tuscarora and Cold Run tunnel and rail road.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the said corporation is hereby authorized to sell, alien, mortgage, grant and dispose of its estate, real and personal, from time to time as it may deem expedient.

SECTION 2. The time for commencing the Tuscarora and Cold Run tunnel and rail road, provided for in the act entitled an act to incorporate the Tuscarora and Cold Run tunnel and railroad company, passed the sixth day of April, one thousand eight hundred and thirty, and the supplement thereto, passed the seventh day of May, one thousand eight hundred and thirty-two, is hereby extended to three years, from and after the passage of this act, and for completing the same, to six years, from the date of this act.

An Act

To authorize the appraisers of damages on the Pennsylvania canal to settle and adjust the claims for damages of David Brenneman, William Cochran and Lewis Brenneman.

SECTION 1. Be it enacted by the Senate and House of Re presentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be the duty of the appraisers of damages on the Pennsylvania canals, to ascertain the damage done to, and

sustained by David Brenneman, William Cochran and Lewis Brenneman, in the carrying away and destruction of their salt on the river Kiskiminetas, below the Leechburg dam, by the freshet in the month of February one thousand eight hundred and thirty-two; and if upon full investigation and inquiry, they shall be of opinion said loss was caused by the construction of the dams in the said river, then to report the amount of damages they shall find the said David, William and Lewis shall be entitled to; taking into consideration the advantage of the canal and public improvements on said river, to the property of the said David, William and Lewis, which sum so reported, shall be paid out of the damage fund, as in other cases of damages sustained by reason of the construction of the Pennsylvania canals: Provided, said damages shall in no event exceed the sum of six hundred dollars.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be the duty of the appraisers of damages on the Pennsylvania canal, to ascertain the damage done to and sustained by James Rodgers and John M'Keown, in the carrying away and destruction of their salt on the river Conemaugh, by the freshet in the month of February, one thousand eight hundred and thirty-two, and if, upon full investigation and inquiry, they shall be of opinion the said loss was occasioned by the construction of the dams in the river Kiskiminetas, then to report the amount of damages they shall find the said James Rodgers and John M'Keown shall be entitled to, taking into consideration the advantages of the canal and public improve

ment on the said Kiskiminetas river, to the property of the said James Rodgers and John M'Keown, which sums so reported, shall be paid out of the damage fund, as in other cases of damages sustained by reason of the construction of the Pennsylvania canals: Provided, said damages'shall in no event exceed the sum Proviso.. of twenty-five hundred dollars.

A further Supplement

To the act entitled "An act to incorporate the York and Maryland line
Rail Road company."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of l'ennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the York and Maryland line rail-road company, May borrow when incorporated, are hereby authorized and empowered to $400,000. borrow, on such terms as the president and directors of said company may deem advisable, any sum not exceeding in the aggregate four hundred thousand dollars, for the purpose of constructing said road, and of placing thereon the necessary cars and moving power, and the said president and directors are authorized and empowered to pledge the tolls and other property of said company, for the security and redemption of the principal and interest of the loan hereby authorized.
