In the re-codification of the statutes of 1925, a material change was made in the wording of subdivision 7 of article 1995, Revised Civil Statutes, 1925. Prior to the recodification, subdivision 7 read as follows:

"In all cases of fraud and in cases

As carried into the Revised Statutes of 1925, the subdivision reads:
