SEC. 202. This title may be cited as the "Railroad Rate Adjustment Citation of Act of 1973".

TITLE III-SEPARABILITY

SEC. 301. If any provision of this Act or the application thereof to any person or circumstances should be held invalid, the remainder of such Act or the application of such provision to other persons or circumstances shall not be affected thereby. Approved July 10, 1973.

Mr. Cook introduced the following bill; which was read twice and referred to the Committee on Labor and Public Welfare

A BILL

To amend the Railroad Retirement Act of 1937 so as to increase the amount of the annuities payable thereunder to widows and widowers.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) section 5 (a) of the Railroad Retirement Act of 4 1937 is amended by striking out "equal to such employee's 5 basic amount" in paragraphs (1) and (2) and inserting 6 in lieu thereof the following: "equal to whichever of the fol7 lowing is the greater: $103, or the amount of the annuity 8 which would have been payable to such employee for such 9 month if such employee were living, had attained age sixty10 five, and had otherwise qualified for an employee's annuity".

1 (b) The first sentence of section 5 (b) of such Act is 2 amended by striking out "equal to the employee's basic 3 amount" and inserting in lieu thereof the following: "equal 4 to whichever of the following is greater: $103, or the amount 5 of the annuity which would have been payable to such em6 ployee for such month if he were living, had attained age 7 sixty-five, and had otherwise qualified for an employee's 8 annuity".

9 SEC. 2. The amendments made by the first section of 10 this Act shall be applicable with respect to annuities accru11 ing under the Railroad Retirement Act of 1937 for months 12 after the month which follows the month in which this Act 13 is enacted.

A BILL

To amend the Railroad Retirement Act of 1937 to permit an individual to receive a spouse's annuity even though such individual renders compensated service for the outside employer by whom such individual was last employed before the spouse's annuity of such individual began to accrue. 1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) section 2 (g) of the Railroad Retirement Act of 4 1937 is amended

(1) in the first sentence thereof, by striking out "The" and inserting in lieu thereof "Except as provided

(2) by inserting immediately after the first sentence thereof the following new sentence: "For pur

poses of the preceding sentence only, subsection (d) of this section shall be deemed not to contain the phrase

'or to the last person by whom he was employed prior to the date on which the annuity began to accrue'.".

(b) The amendments made by subsection (a) shall be 8 effective with respect to annuities payable, under the Rail9 road Retirement Act of 1937, for months after the month 10 in which this Act is enacted on the basis of applications 11 filed in or after the month in which this Act is enacted.
