The resolution from the House of Representatives granting leave to the government of the United States to remove obstructions in Piscataqua river, was taken up for a third reading

On motion of Mr. Peirce,

A message from the House of Representatives, by Mr. Bell, of Chester :

Mr. President-I am directed to inform the Senate, that the Hon. Levi Woodbury, having resigned the office of Speaker of the House of Representatives, the Hon. Henry Hubbard has been elected to supply his place in that office. And he withdrew.

On motion of Mr. Chandler,

The bill entitled "An act to establish a corporation by the name of the Proprietors of the Indian Head Factories," was taken up.

On motion of Mr. Chandler,

That the bill be amended by adding the following proviso at the end of the last section, viz. "Provided nevertheless, that nothing in this act contained shall in any wise affect or impair any rights or privileges heretofore granted by the Legislature of this State to any individual or corporation"

It was determined in the affirmative.

The Senate resumed, as in committee of the whole, the consideration of this bill; and no further amendments having been made, the bill was reported to the Senate ; and

Ordered, that it pass to a third reading.

On motion of Mr. Peirce,

That the resolution from the House of Representatives granting leave to the government of the United States to remove obstructions in the Piscataqua river, be now taken up and considered as on a second reading

It was determined in the affirmative.

On motion of Mr. Peirce,

That the resolution be amended by erasing from the tenth line the words "extending up said river," and inserting the following words, viz." and also in all other branches of Piscataqua river, and extending up said branches”—

It was determined in the affirmative.

The Senate resumed, as in committee of the whole, the consideration of this resolution ; and no further amendments having been made, it was reported to the Senate; and

Ordered, that the resolution, as amended, pass to a third reading.

Mr. Bean, from the committee on military affairs, to which was referred the bill entitled "An act to authorize the field officers of the fifth regiment to organize one company of grenadiers at Hollis and one company of grenadiers at Dunstable"-reported the bill without amend

ment.

On motion of Mr. Handerson,

That the resolution of the House of Representatives for a joint committee to report some suitable person to preach the election sermon in June next, be now taken up and considered

It was determined in the affirmative.

On the question, "Will the Senate concur with the House in the passage of this resolution ?"

It was determined in the negative.

The Senate, as in committee of the whole, resumed the consideration of the bill entitled "An act to authorize the field officers of the fifth regiment of militia in this State, with the permission of the brigadier general of the fourth brigade, to organize one company of grenadiers at Hollis and one company of grenadiers at Dunstable ;"-and no amendment having been made, the bill was reported to the Senate; and

Ordered, that it pass to a third reading.

Mr. Handerson introduced the following resolution: Resolved by the Senate and House of Representatives in General Court convened, That his Excellency the Governor be requested to appoint some suitable person to preach the next election sermon.

This resolution having been twice read, on motion, the rules of the Senate were so far dispensed with that it was ordered to a third reading at the present time.

Resolved, that this resolution pass.

Ordered, that the Clerk notify the House of Representatives, and request their concurrence.

Mr. Peirce, from the committee to which was referred so much of his Excellency's message as relates to schools, and which was instructed to enquire into the propriety and expedience of establishing a college under the authority of the State, and of appropriating the literary fund towards its support-reported the following resolution, viz.

Resolved, that it is expedient to establish a Literary Institution subject to the controul of the State, and that the Literary Fund be appropriated for that purpose.

On motion of Mr. Claggett,

Ordered, that said resolution be made the order of the day for Monday next.

Adjourned to three o'clock afternoon.

Met according to adjournment.

The bill entitled "An act in addition to an act entitled an act laying a fine on town clerks and sheriff's neglecting to make seasonable returns of votes for governor, counsellors and senators," was read a third time.

Resolved, that this bill pass.

A message from the House of Representatives, by Mr. Chadwick, their Clerk:

Mr. President-The House of Representatives have passed the following resolutions, viz.

Resolution making an allowance to Joseph Cofran;

› Resolution making an allowance to William Badger; Resolution making an allowance to Ebenezer Grout; Resolution making an allowance to Abira Fisk; Resolution making an allowance to Thomas Bellows; Resolution making an allowance to Benjamin Parker; In which several resolutions they request the concurrence of the Senate. And he withdrew.

Mr. Handerson, from the committee of the judiciary to which was referred the bill from the House entitled "An act in addition to an act entitled an act defining the powers and duties of a Judge of Probate, and the duties, exemptions and liabilities of executors, administrators and guardians in certain cases," reported the bill with the following amendments, viz.

In the title of the bill, second line after the words "defining the" add "jurisdiction."

Add to the end of the bill the following words, viz.

"The said guardian, being under oath to conduct such sale with fidelity, and giving bond with sufficient sureties to account for the proceeds of such sale, which bond shall be in the form required of guardians in other cases, as is provided in the act to which this is in addition."

The last of these amendments was agreed to by the Senate. When the Senate proceeded, as in committee of the whole to consider the bill; and having made no further amendments, it was reported to the Senate; and On motion of Mr. Claggett,

Ordered, that said bill lie on the table.
