CHAPTER 46.

AN ACT for the benefit of Simon Humphrey, late sheriff of Nelson county, and sureties.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That when Simon Humphrey, late sheriff of Nelson county, and his sureties for him, shall have paid the full amount of the principal, interest, costs, and the Attorney General's fee, embraced in the judgment rendered against them in the Franklin circuit court, for the balance due the State on account of the revenue of 1872, the damages, and the five per cent. adjudged against them under the act of March 22, 1871, to change the time of paying the revenue into the State Treasury, shall be, and the same is hereby, remitted: Provided, however, That said debt, interest, costs, &c., shall be paid within sixty days from the approval of this act.

§2 This act shall be in force from its passage.

CHAPTER 47.

AN ACT to repeal an act to authorize the board of trustees of the town of
Lebanon to issue bonds and provide for the payment of the same.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That so much of an act approved March 11th, 1868, chapter one hundred and twelve, as authorizes the trustees of the town of Lebanon, in Marion county, to issue bonds of said town, be, and the same is hereby, repealed: Provided, however, That this act of repeal is not to affect the validity of the bonds already issued and disposed of.

CHAPTER 48.

AN ACT to amend the charter of the city of Newport, in Campbell county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the marshal of the city of Newport be, and is hereby, made chief of the police, for the time being, of said city of Newport, and be, and hereby is, invested, for himself and his successors in office, with all the powers

which are now or may be hereafter vested by the charter
and ordinances of said city in said chief of police.
§ 2. This act shall take effect and be in force from and
after its passage.

CHAPTER 49.

AN ACT to amend an act, entitled "An act to incorporate the Cynthiana and Millersburg Turnpike Road Company."

WHEREAS, It is represented that the corporate seal of the Cynthiana and Millersburg Turnpike Road Company has been lost, mutilated, or destroyed; wherefore, for the remedy thereof,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the private seal or scroll of the president of said corporation may be issued in all cases where, by the original and amended charters, it might be necessary to use a seal, and that the private seal or scroll of the president, when so issued, shall have the same efficacy in law as if a corporate seal had been used.

§ 2. This act shall take effect from its passage.

CHAPTER 50.

AN ACT to renew the charter of the Alexandria and Flagg Spring Turnpike Road Company, in Campbell county.

WHEREAS, The charter of the Alexandria and Flagg Spring Turnpike Road Company expires in December, 1874, by special enactment; and since further time is necessary to enable the company to complete said road, therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the charter of the Alexandria and Flagg Spring Turnpike Road Company be, and the same is hereby, continued in force until December, 1884; and that the company shall have, if necessary, until that time in which to complete said road.

§ 2. That this act shall take effect December the 4th, 1874.

CHAPTER 51.

AN ACT to authorize the county court of Livingston county to levy an additional poll and ad valorem tax for bridge and road purposes. WHEREAS, The Livingston county court of claims, at its October term, 1873, made sundry appropriations for the repairing and building in the said county of certain roads and bridges; and whereas, the county levy for the year 1874 is wholly inadequate to meet the said appropriations; now, therefore, in order to raise a fund sufficient to meet said appropriations, and secure the speedy building of said bridges, and the construction of said roads,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Livingston county court of Kentucky, a County court majority of the justices of said county in commission being present and concurring, be, and it is hereby, authorized and empowered to levy an additional capitation and ad valorem tax for the years 1874-25, not to exceed fifty cents on the poll, and not exceeding fifteen cents on each one hundred dollars' worth of taxable property in said county, as shown by the assessors' books for said year or years; said tax to be levied prior to the time of returning the assessors' books for the year 1874, and to be levied for the express and only purposes aforesaid.

CHAPTER 52.

AN ACT for the benefit of C. G. Ragan, late sheriff of Montgomery county, and securities.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the Auditor of Public Accounts be, and he Interest and is hereby, directed to credit C. G. Ragan, late sheriff of Montgomery county, and his securities, with the amount of damages, and the five per cent. charged against them under the act of March 22, 1871, to change the time of paying the revenue into the Treasury, when they shall have paid in full the principal, interest, costs, and At

CHAPTER 54.

AN ACT for the benefit of Jobn Allen, of the city of Louisville. WHEREAS, On the 7th day of June, 1873, the Jefferson county court appointed John Allen, of the city of Louisville, a guard to conduct to the Feeble-minded Institute a pauper lunatic named Margaret Gallavan; and whereas, it appears from the certificate of Dr. E. H. Black, Superintendent of said Institution, that said John Allen did perform the duty assigned him; therefore, in order that the said party be reimbursed for the funds expended by him in carrying out the order of the court,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor of Public Accounts be directed to draw his warrant on the Treasurer of the State in favor of said John Allen for the sum of nineteen dollars and thirty-five cents ($19 35), to be paid out of any money in the Treasury not otherwise appropriated.

§ 2. This act to take effect from and after its passage.

CHAPTER 55.

AN ACT for the benefit of R. W. Williams, jailer of Christian county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the sum of fifteen ($15) dollars is hereby appropriated to R. W. Williams, jailer of Christian county, for keeping and taking care of Doc Henry Buckner, a pauper lunatic, in June, 1873; said sum to be paid on the warrant of the Auditor out of any money in the Treasury not otherwise appropriated.

§ 2. This act to take effect from its passage.

CHAPTER 56.

AN ACT to incorporate the Christian Church at Warsaw.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the members, and those who may hereaf ter become members, of the Christian Church at Warsaw, are hereby created a body-corporate, by the name of the "Christian Church;" and by that name shall have perpetual succession, and be capable of suing and being sued, and of holding, by contract or gift, real and personal estate not exceeding twenty thousand dollars.

2. That the title to the property now owned by Title vested in said church shall be, and the same is hereby, vested in H. P. Clore, Robert Payne, J. J. Landram, and Florien Cox, trustees of said church, and their successors in office; and all property hereafter acquired by said church shall be, and the same is, to vest in said trustees, and their successors in office, for them to have and to hold the same in trust for the use and benefit of said church.

§ 3. That it shall be lawful for a majority of the members of said church, present at any called or regular meeting, to direct and authorize the trustees of said church to sell and convey any property, either real or personal, belonging to the same.
