CA P. LIV. An Act to make provision for defraying the Civil Expenditure of the Provincial Government for the current year. (26th March, 1830.) Preamble. MOST GRACIOUS SOVEREIGN, WH HEREAS by Message of His Excellency Sir James Kempt, Knight Grand Cross of the Most Honorable Military Order of the Bath, and Administrator of the Government of Lower-Canada, laid before both Houses of the Legislature, it appears that the funds already appropriated by Law are not adequate to defray the whole expenses of Your Majesty's Civil Government of this Province, and of the Administration of Justice and other expenses mentioned in the said Message; and whereas it is expedient to make further provision towards defraying the same for the year commencing the first day of January one thousand eight hundred and thirty, and ending on the thirty-first day of December in the same year :-We, Your Majesty's faithful and loyal subjects, the Commons of Lower Canada, in Provincial Parliament assembled, most humbly beseech Your Majesty that it may be enacted, and be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great-Britain, intituled, " An Act to repeal certain parts of an "Act passed in the fourteenth year of His Majesty's Reign, intituled, “ An Act "for making more effectual provision for the Government of the Province of "Quebec in North-America," and to make further provision for the Government "of the said Province:"-And it is hereby enacted by the authority of the same, already ap that from and out of the unappropriated monies which now are or shall hereafter propriated by Law shall come into the hands of the Receiver General of the Province for the time being, there shall be supplied and paid towards defraying the expenses of the Adminis A certain sum of money granted, which together with the monies amount to a not ex. tration l'emploi des doivent être payés d'après l'ordre et l'autorité du présent Acte, par la voie des Lords Commissaires de la Trésorerie de Sa Majesté pour le temns d'alors, en tel- argens. les manière et forme qu'il plaira à Sa Majesté, Ses Héritiers et Successeurs vouloir bien l'ordonner. THEREAS the erection of a Bridge over the River des Prairies at the place called Grosse Pointe or l'abord à Plouffe, between the Parish of Saint Martin and the Parish of Saint Laurent in the District of Montreal, would materially contribute to the convenience of the inhabitants of the adjacent Parishes; And whereas, Eustache Nicolas Lambert Dument, of the District aforesaid, Seigneur of Saint Eustache, has, by his Petition in this behalf, prayed leave to build a Toll Bridge over the said River des Prairies at the aforesaid place: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower-Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act passed in the four"teenth year of His Majesty's Reign, intituled, "An Act for making more "effectual provision for the government of the Province of Quebec, in North "America," and to make further provision for the government of the said Pro" vince ; And it is hereby enacted by the authority of the same, that it shall be du soutien du Gouvernement Civil de cette Province, pour l'année commencée le premier jour de Janvier, mil huit cent trente, et qui expirera le trenteet-unième jour de Décembre de la même année, telle somme ou sommes d'argent qui avec les argens déjà affectés pour les fins susdites, se monteront à une somme qui n'excédera pas soixante et deux mille, deux cens cinquante livres, deux chelins et trois deniers sterling. II. And be it further enacted by the authority aforesaid, that for the purpose of erecting, building, maintaining and supporting the said Bridge, the said Eustache Nicolas Lambert Dumont, his heirs, executors, curators and assigns, shall, from time to time, have full power and authority to take, and use the land on either side of the said River des Prairies at the place aforesaid, and there to work up, or cause to be worked up the materials and other things necessary for erecting, constructing, or repairing the said Bridge accordingly; the said Eustache Nicolas Lambert Dumont, his heirs, executors, curators, and assigns, and the persons by him employed, doing as little damage as may be, and making reasonable and just satisfaction to the respective owners and occupiers of all such lands and grounds as shall be altered, damaged, or made use of for the value of such land as well as for that of the alteration or of the damages which they may cause to the proprietors by means of or for the purpose of erecting the said Bridge, and the said House as above designated; and in case of difference of opinion and dispute about the quantum of such satisfaction, the same shall be settled by His Majesty's Court of King's Bench, for the District of Montreal after a previous visitation, examination and estimation of the premises shall have been made by experts to be named by the parties respectively; and in default of such nomination by them, or either of them,, then by the said Court, in manner and form prescribed by law, and the said Court is hereby authorized and empowered to hear, settle, and finally determine the amount of such compensation accordingly. Provided always, that the said Eustache Nicolas Lambert Dumont, his heirs, executors, curators, and assigns, shall not commence the erection of the said Bridge and other works, by which any person may be deprived of his land or part thereof, or may suffer damage, before the price or value of the said land and damages, estimated, and settled in manner before prescribed, shall have been paid to such person, or after such price or value shall have been offered to him, or that on his refusal the said Eustache Nicolas Lambert Dumont, shall have deposited it at the office of the Prothonotary of the Court of King's Bench for the District of Montreal. III. And be it further enacted by the authority aforesaid, that the said Bridge and the said Toll-House, Turnpike and dependencies to be erected thereon, or near thereto, and also the ascents or approaches to the said Bridge, and all ma terials |
