COLVILLE TERMINATION LEGISLATION

COMMITTEE ON INTERIOR AND INSULAR AFFAIRS,

The committee met, pursuant to notice, at 9:45 a.m. in room 1324, New House Office Building, Hon. James A. Haley (chairman of the subcommittee) presiding.

Present: Congressmen Haley, Aspinall, Edmondson, Morris, Olsen, Berry, Langen, Nygaard, and Údall.

Also present: Dr. John L. Taylor, Consultant on Indian Affairs. Mr. HALEY. The committee will be in order.

We will take up the consideration of H.R. 6801 by Mr. Tollefson and H.R. 8469 by Mr. Horan. Without objections the bill and the reports of the departments will be made a part of the record at this point in the proceedings.

RÉSUMÉ H.R. 6801 and H.R. 8469

The purpose of H.R. 6801 and H.R. 8469, introduced by Representatives Tollefson and Horan respectively, is to carry out an obligation to the Colville Tribe contained in section 5 of Public Law 772, 84th Congress, the act of July 24, 1956, Section 5 reads as follows:

"The Business Council of the Confederated Tribes of the Colville Reservation shall, in accordance with the resolution numbered 1955-33, dated April 8, 1955, of the Colville Business Council, submit to the Secretary of the Interior within five years from the date of enactment of this Act proposed legislation providing for the termination of Federal supervision over the property and affairs of the Confederated Tribes and their members within a reasonable time after the submission of such proposed legislation."

These bills represent two versions of the plans for closing the tribal rolls, distributing the assets and for termination of Federal supervision over the property and affairs of the tribes and members.

A BILL To provide for disposition of certain tribal assets of the Colville Confederated Tribes in the State of Washington

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That for the purposes of this Act

(1) "Tribe" means the Colville Confederated Tribes in the State of Washington.

(2) "Tribal lands" means real property which belongs to the tribe and either is held by the United States in trust for the tribe or is subject to a restriction against alienation imposed by the United States, but does not include mineral interests in such property.

SEC. 2. (a) The Secretary of the Interior, upon consultation with the Secretary of Agriculture shall determine what part of the tribal lands are valuable chiefly
