sidewalks, alleys, lanes and other city grounds, whether the same shall be made by direction of the common council, a board of street commissioners, or made voluntarily by the owner or occupant of such ground or of land adjacent to such improvement.

SEC. 7. The street commissioner shall have the general care and superintendence of the streets, side-walks, alleys, public grounds, and bridges of the city: and the common council may, by ordinance, from time to time, regulate and prescribe his powers and duties, and fix the compensation for his services; which said compensation shall be paid from the city treasury. And the Council may common council shall have power at any time, for proper cause, at their discretion, to remove said commissioner, and in all cases of removal as aforesaid, it shall be the duty of the common council to order a new election; Provided, That no person shall be removed from office by said common council without their first giving such person personal notice of the charges or causes of his removal, and grantig him a hearing thereon.

SEC. 8. The street commissioner and the aldermen of commissioners the several wards shall constitute the board of street commissioners for said wards respectively, and one of the said aldermen, or some one appointed by the board, shall be clerk of such board, and keep a record of all the acts and doings of said board, and preserve all the papers and records thereof. The street commissioner and two of the aldermen of any ward shall be a quorum of the board of street commissioners for such ward; and the said board of street commissioners for such ward in said city shall have and exercise the same powers, and do and perform the same duties as the respective boards Their powers and duties. of street commissioners have heretofore had and exercised, done and performed; except that all work, grading, repairing, &c., of whatever kind, connected with streets, alleys, sidewalks, bridges, &c., in said city, shall be done under the superintendence of the street commissioner; and except, where any owner or occupant of any lot or parcel of land adjoining any street, lane, alley, or ground to be repaired or improved, shall fail to do the work required to be done, that the same shall be done by the street commissioner, who shall keep an accurate account of the cost and expense thereof, including items of materials furnished and labor done,

and such cost and expense shall be charged, to such lot or parcel of land, and if not paid, the same shall be collected as now provided by said charter of said city of Janesville.

SEC. 9. Whenever the common council or board of Repairs and street commissioners for any ward, shall determine to improvements, make any repairs or improvements, as authorized by how proceeded sections three, four, and five of chapter seven of said charter, the street commissioner, after the estimate mentioned in said section six shall be made and filed as therein provided, shall give notice, by advertisement in the city paper, to the owners or occupants of the lots or parcels of land to be charged with the cost and expense thereof, or with any portion of such cost and expense, and also by serving such notice personally on each such owner or occupant, requiring them to do the work mentioned in such notice within a reasonable time, not less than thirty days, therein to be specified, and if the said work shall not be done within such time, the same shall be done by the street commissioner; Provided, That if Proviso. any such owner or occupant cannot be found or served personally, that a copy of such notice may be left at his usual place of abode, with some proper person, or with his agent, or posted on the lot or parcel of land to be charged.

SEC. 10. SEC. 11. Whenever a vacancy shall occur in the Election to fill office of street commissioner, such vacancy shall be vacancy. filled by a new election, which may be ordered by the common council, and held within twenty days after such vacancy shall occur.

The rule of taxation in said city shall be uniform; Provided, That in no case shall the real or personal property within the territorial limits of said city, and not included within the boundary limits of the recorded plat of the village of Janesville or of any addition to said village, which may be used, occupied or reserved for agricultural purposes, be subject to an annual tax to defray the current expenses of said city exceeding one half of one per cent., nor for the building and repair of roads and bridges more than one half as much on each dollar valuation as shall be levied for such purpose on the property within such recorded plat, nor shall the same be subject to any tax for any of the purposes mentioned in section three of chapter five, chapter seven and chapter nine of the act hereby amended.

The costs and expenses of laying out, openimprovements, ing, grading, graveling, planking or paving any public road or highway, or the sidewalk of any such highway or road in or over that part of said city not included within any of the recorded plats aforesaid, shall be levied, assessed, collected and paid by said city in the way and manner now provided by law for defraying the expenses of laying out, opening, working and repairing highways in towns.

the city shall be a party, and shall have sole and exclusive jurisdiction to hear all complaints, and conduct all examinations and trials in criminal cases within the city, and shall have the same power and authority in cases of contempt as a court of record.

SEC. 15. Persons entitled to vote for county or state officers, who shall have resided within the ward where the vote is offered for thirty days next preceding the election, shall be entitled to vote for any officer to be elected in said city; and if any person so offering to vote shall be challenged for any cause, before his vote shall be received, he shall take the same oath and answer the same questions required by law of persons. offering to vote for state and county officers, varying the form of such oath so far only as may be necessary to make the same applicable to this act and the act hereby amended.

SEC. 16. All that portion of section twelve of chapter

three of the act hereby amended preceding the proviso in said section, and all other acts and parts of acts now in force, which in any manner conflict with the provisions of this act, are hereby repealed.

SEC. 17. This act shall be in force and take effect from and after its passage.

Chapter 63.

An Act to authorize the town of Winneconne, in the county of Winne-
bago, to aid in construction of a Railroad.

The people of the State of Wisconsin, represented in
Senate and Assembly, do enact as follows:

SECTION 1. SEC. 2. The said bonds shall be executed by the Bonds. chairman of the board of supervisors of said town, and countersigned by the clerk thereof, and shall be redeemable in not less than two, or more than twenty years from the date thereof, and shall bear interest at a rate not exceeding seven per cent. per annum, payable semiannually.

SEC. 3. said town delivered to said railroad company, conditioned that the said company shall punctually pay and discharge the principal and interest due, or to become due, on any bonds issued to the said railroad company, and shall fully indemnify and save harmless the said town against all payments, liabilities, losses, damages and expenses which the said town may sustain or incur in consequence of the issue and delivery of any such bonds, and the board of supervisors of said town may, before the delivery of any such bonds, require such additional security from such railroad company, for the faithful application of the proceeds of the said town bonds issued in aid of said company, in the construction of said road, and for the faithful performance of the conditions of their said bonds, as in their opinion will be just and reasonable.

Only one proposition shall be submitted to the said electors at any one election, and which shall state the amount of the bonds proposed to be issued, and to what railroad company. At such election, those voting in favor shall vote a ballot with words inscribed thereon, "For the railroad," and those voting against, shall vote a ballot with the
