An Act to amend an act entitled "An act to incorporate the city of Milwaukee, and the several acts amendatory thereof," approved February 20th, 1852,

The people of the State of Wisconsin, represented in
Senate and Assembly, do enact as follows:

SECTION 1. All the territory now included in the sixth ward of the city of Milwaukee which lies east of the centre of seventh street as extended to the northern boundary of said city, shall hereafter constitute and be the sixth ward of the city of Milwaukee, and all the territory now included in the sixth ward of said city which lies west of the centre of seventh street as extended to the northern boundary of said city, shall hereafter constitute and be a new ward, to be called the ninth ward of the city of Milwaukee, and the said sixth and ninth wards hereby created shall have all the rights and privileges, and be subject to the same regulations, laws, and ordinances as the other wards in said city, and shall be entitled to elect the same officers.

office for one year; and there shall be elected in the ninth ward hereby created, one alderman who shall hold his office for two years, and two aldermen who shall hold their respective offices for one year, and annually thereafter there shall be elected in each of the. aforesaid wards, one alderman who shall hold his office: for two years, and one alderman who shall hold his office for one year, and the alderman elected for two years in the sixth ward, at the last city election, shall continue and be an alderman for the said sixth ward hereby created for the remainder of his term of office, and it shall be the duty of the common council at the next city election, to appoint three inspectors of election Inspectors of in each of said sixth and ninth wards, and to designate elections. the places for holding the election in said wards."

SEC. 3. It shall be the duty of the comptroller of the City Compcity of Milwaukee to apportion the amount of city in- troller to apdebtedness, now charged to the sixth ward of the city portion indebt of Milwaukee, between the sixth and ninth wards edness of the hereby created in proportion to their equalized assessment rolls for the year 1857, and to credit the said sixth ward the amount to be charged to the ninth ward. It shall further be the duty of said comptroller in case the expenditures for work done or materials furnished for ward improvements by the aldermen of the fifth or sixth wards in said city before the acts for dividing said wards are to take effect, shall exceed the amount of the respective ward funds, for such ward applicable for ward purposes for the fiscal year ending April 1st, 1857, or if there shall be any surplus of such ward funds, 'to apportion such excess or deficiency, if any, between the several wards formed by the division of said wards, in the ratio of the equalized assessment rolls of said wards for the year 1857, and to charge or credit, as the case may be, to the proper wards respectively, the just apportionment so made. The public park or square now Public Park belonging to the second and sixth wards jointly, shall continue to be the property of said wards, and shall be improved by said wards jointly.

SEC. 4. The mayor and common council of the city To levy a speof Milwaukee are hereby authorized and empowered c al tax, at the time of levying other taxes for the year 1857, to levy a special tax on all taxable property in the several wards of said city for ward purposes, not exceeding one per cent. in addition to the tax now authorized by law

council are hereby authorized to issue the bonds of said city, of such denomination as they may deem proper, bearing such interest, not exceeding twelve per centum per annum, and payable at such time and place as they may deem advisable, not exceeding ten years from the date of such bonds.

Sealing and SEC. 3. Such bonds shall be issued under the seal of signing bonds. said city, signed by the mayor, and countersigned by the clerk of said city, and may be negotiated by such person as said mayor and common council shall authorize for that purpose.

Annual tax

SEC. 4. It shall be the duty of said mayor and comto pay interest mon council, to levy such sum annually, as will be sufficient to pay the interest on said bonds, which amount shall be levied and collected in the same manner as other city taxes are levied and collected, and the good faith of said city shall stand pledged for the punctual payment of the interest on said bonds, and their ultimate payment at the expiration of the time for which such loan may have been obtained.

Tax to pay principal.

SEC. 5. At or before the time when said bonds become due, it shall be the duty of said mayor and common council to levy a tax sufficient to pay the same, in the same manner as aforesaid.

SEC. 6. This act shall take effect and be in force from and after its passage.

Chapter 35.

An Act to amend chapter 286 of the session laws of 1853, entitled " An
act to incorporate the Winnebago Railroad Company."

The people of the State of Wisconsin, represented in
Senate and Assembly, de enact as follows:

shall have power to locate and construct a railroad, with one or more railways or tracks, from such eligible point

in the city of Oshkosh, to such eligible point in Portage City, in the county of Columbia; and the said company shall have power to transport, take, and carry property and persons upon said road, by the power and force of steam, of animals, or of any mechanical or other power, or of any combination of them, and to make, construct, and put in operation all such turnouts, side and connecting tracks as they shall think necessary and proper; also, to build, erect, construct and maintain all warehouses, car houses, engine, machine, and other shops, toll-houses, and all other fixtures useful for the accommodation of said road and of those using it, and to manufacture or purchase all necessary engines, tenders, cars, and other conveniences for running or using said road; and they shall have power to connect said railroad with any other railroad coming in contact therewith, and to operate the same in connection with such other railroad or railroads, and to lease or purchase from any other railroad company the whole or any part of any railroad or branch railroad owned by such company, or to lease or to sell to any other company the whole or any part of said railroad or any of its branches, to be built or owned by said company.

An Act for the relief of School District No. 2, in the town of Pensaukee, Oconto county.

The people of the State of Wisconsin, represented in

Senate and Assembly, do enact as follows:

the first meeting in said district, as provided in chapter nineteen of the revised statutes of this State; and the district treasurer for said district number two is hereby authorized to collect the tax hereby authorized to be levied, as provided in the said chapter nineteen of the revised statutes of this State; and so much of the provisions of the said chapter nineteen of the revised statutes of this State as are necessary to carry out the purposes of this act, are hereby revived for that purpose, and for none other.

Chapter 37.

An Act authorizing the city of Sheboygan to loan its credit in aid of
certain railroads.

The people of the State of Wisconsin, represented in
Senate and Assembly, do enact as follows:

SECTION 1. The common council of the city of Sheof city to aid boygan are hereby authorized to loan the credit of said rail- city, by issuing its bonds to aid in the construction of certain railroads leading from said city, and particularly to the Sheboygan and Mississippi Railroad Company, and any branch thereof, and the Milwaukee and Superior Railroad Company, companies duly incorporated and organized under the laws of this State; Provided, That there shall not be loaned to either of said railroad companies, under the provisions of this act, an amount exceeding two hundred and fifty thousand dollars; And provided further, That no portion of the bonds issued pursuant to the provisions of this act, shall be issued or delivered except upon the terms and conditions and in the manner prescribed by this act.

SEC. 2. Every bond authorized to be issued by this act shall be for a term not less than ten nor more than twenty years, for a rate of interest not exceeding seven per cent per annum, payable semi-annually, both interest and principal payable in the city of New York, and
