Duties collected to go to Upper Majefty's Reign, by the Commiffioners nominated and appointed on the behalf of the Province of Lower Canada, by Act of the Legiflature thereof, paffed in the faid fifty-leventh year of your Majefty's Reign, intituled, "An Act for appointing Com-"miflioners to treat with Commiffioners appointed, or to be appointed, on the part of "Upper Canada, for the purposes therein mentioned," and the Commiffioners nomi. nated and appointed on the part of Upper Canada. Which Articles followARTICLE firft. That the Legiflature of Upper-Canad will not impofe any Duties whatever on any goods, wares or merchandize, imported into Lower-Canada, and paffing into Upper-Canada, during the continuance of this agreement, but will allow and admit the Legislature of Lower Canada to impofe and levy fuch Duties on fuch goods, wares and merchandize as they may judge expedient, other than goods imported from Upper Canada. ARTICLE fecond. That during the continuance of this agreement, the Province of Upper-Canada fhall be entitled to receive annually, onc fifth part of all the Duties (exclufive of the expence of collection) which shall be One-fifth of all raised, levied and collected in Lower-Canada, under and by virtue of an Act of the In Lower-Canada Parliament of Great-Britain, paffed in the fourteenth year of His Majefty's Reign, - Canada. intituled," An Act to eftablish a fund towards further defraying the charges of the "Administration of Juftice, and fupport of the Civil Government within the Pro"vince of Quebec, in America." And alfo one fifth part of all Duties (exclufive -of the expence of collection) which the Legislature of Lower-Canada have already imposed, or may hereafter impofe on goods, wares or merchandize imported or to be imported into Lower-Canada during the continuance of this agreement: provided nevertheless, that this agreement fhall not be conftrued to extend to Duties laid up*on goods fold at auction in Lowe:-Canada, as aforefaid. That the operation of this agreement fhall be confidered to commence on the fift day of January laft, and shall be in force until the first day of July, which will be in the year of our Lord one thoufand eight hundred and nineteen. WHEREAS by an Act paffed in the forty-eighth year of His Majefty's Reign, intituled, " "An Act to regulate the trial of controverted Elections, or returns "of Members to ferve in the Houfe of Affembly of Lower-Canada," it is enacted and provided, that in cafes where in it fhall appear that the expence of bringing wit neffes to the bar would be confiderable, it shall and may be lawful to and for the Houfe of Affembly to nominate three Commiffioners for the purpofe of examining the witne ffes: And whereas it would materially tend to facilitate and expedite the public bufinefs, if it were enacted that it fhould be lawful to and for the Houfe of Affembly, in all trials of controverted elections, or returns of Members to ferve in the Houle of Affembly, to nominate and appoint three Commiffioners or a fpecial Committee for the purposes aforefaid; Be it therefore enacted by the King's mot Excellent Majefty, by and with the advice and confent of the Legislative Coun. cil and Affembly of the Province of Lower-Canada, conftituted and aff: mbled by virtue of and under the au hority of an Act paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an Act paffed in the four"teenth year of His Majefty's Reign, intituled, " An Act for making more effec "tual provifion for the government of the Province of Quebec in North America," and "to make further provifion for the government of the faid Province;" and it is hereby enacted by the authority of the fame, that from and after the paffing of this Act, it fhall and may be lawful for the Houfe of Affembly, in all trials of contro verted Elections, or returns of Members to ferve in the Houfe of Affembly of this Province, to nominate and appoint three Commiffioners (one of whom shall be Chairman) for the purpofe of examining the witneffes of the parties interested in fuch trial; which Commiffioners fhall proceed in the manner provided in and by the laid fift above-mentioned A&. |
