The Oath.

Measurer or Measurers as aforesaid, until fuch perfon or perfons applying for fuch license or commiffion, fhall have previously undergone an examination as to his or their knowledge and capacity to act as fuch Culler or Cullers, Meafarer or Mea. furers as aforelaid, before a board of competent perfon or perfons, converfant in the Lumber Trade, as examiners, which Board the Governor, Lieutenant-Governor or perfon adminiftering the government of this Province for the time being, is hereby authorized and empowered by commiffion under his fign manual to constitute and appoint for that purpose.

V. And be it further enacted by authority aforefaid, that every perfon apply Cerrores ing for a license or commiffion as Culler or Meafurer as aforefaid, before he is ap cuce his former pointed a Culler and Measurer, fhall produce his former licenfe, as Mafter CulLicente as Mas- ler or Measurer, or a certificate of having undergone an examination as herein before provided, and of his having taken and fubfcribed the following Oath in prehaving under- fence of any one of His Majefty's Juftices of the Court of King's Bench, that is to fay: "I do folemnly fwear, that I will faithfully, truely and impartially, to "the best of my knowledge, skill and understanding, execute, do and perform "the Office and Duty of a Culler and Measurer of (here infert the description of the Lumber of which he is to be Culler and Measurer) according to the true intent and "meaning of an Act, intituled, "An Act to repeal certain Acts therein-mentioned, "and to regulate the Lumber Trade," and that I will give a true and faithful ac "count and certificate of the number, quality and dimenfions or measurement of "all fuch (here infert the defcription of the Lumber of which he is fo to be Culler and Measurer) as may be fubmitted to my infpection and judgment, according to "the best of my knowledge, and that I will not, directly or indirectly, be a dealer "in or interested in the buying or felling of any article of Lumber, either on my own account, or on account of any other perfon or persons whatsoever, and that I "will not at any time purloin or wilfully change any article of Lumber that may at any time be delivered or entrusted to me for the parpose of being culled :" which Oath every fech perfon fhall file or caufe to be filed, in the Office of the Prothonotary of the Court of King's Bench for the District in which he refides; and it shall be the duty of the faid Prothonotary, and he is hereby required to grant a certificate un der his hand and feal of office, to every fuch perfon of his having taken and subfcribed the faid Oath and filed the fame in his Office, in conformity to this A, for which certificate the faid Prothonotary shall not ask or receive more than two fhil. lings and fix-pence, current money of this Province.

V. Et qu'il foit de plns ftatué par l'autorité fufdite, que toute personne faisant application pour avoir une Licence ou Commiffion d'Infpecteur ou Mefureur comme fufdit, produira, avant d'être nommé Inspecteur ou Mefureur, fon ancienne Licence comme Maître Infpecteur ou Mefureur, ou un Certificat conftatant qu'il a été examiné ainfi que ci-deffus pourvû, et qu'il a pris et foufcrit le ferment fuivant, en prélence d'un des Juges de la Cour du Banc du Roi, c'est à savoir, “ Je jure folemnelle "ment que fidèlement, vraiment, et impartialement, au meilleur de mes con"naissances, habiletés et jugement, j'exécuterai, ferai et remplirai l'office et le devoir "d'Inspecteur et Mefureur de (ici inférez la defcription du bois dont il doit être Infpe&teur et Mefureur) fuivant le vrai fens et intention d'un Acte, intitulé, “ Acte pour rappeller certains Actes y mentionnés, et pour régler le commerce des bois,' "et que je donnerai un état et certificat vrai et fidèle du nombre, de la qualité et "des dimenfions ou mefures de tous tels (ici inférez la description du bois dont il "doit être Infpe&teur et Mefureur) qui pourront être foumis à mon inspection et "jugement, au meilleur de mes connoiffances, et que directement ou indirectement, "je ne ferai point commerce et n'aurai aucun intérêt dans Iss achats ou ventes d'au"cun article de bois, foit pour mon propre compte, ou pour le compte d'aucune autre perfonne ou perfonnes quelconques. et que je ne déroberai en aucun tems, ni ne "changerai de propos délibéré, aucun article de bois qui me fera en aucun tems "remis ou confié aux fins d'être infpecté" le quel ferment toute telle perfonne filera ou fera fiier dans le Bureau du Protonotaire de la Cour du Banc du Roi, pour le District dans le quel il fait fa demeure, et il fera du devoir du dit Protonotaire, et il eft par le préfent requis d'accorder un certificat fous fon feing et fceau d'office, à toute telle personne qu'elle a pris et foufcrit le dit ferment, et qu'elle l'a filé dans son Bureau en conformité à cet Acte, pour le quel certificat le dit Protonotaire ne pour ra pas de mander ou recevoir plus de deux chelins et fix deniers, argent courant de

VII. And be it further enacted by the authority aforefaid, that it shall not be and selling, or lawful for any Culler and Measurer of any article of Lumber to buy or fell, directly or indirectly, or be a dealer in or interested in the buying or felling of any article of Lumber either on his own account or on account of any other perfon or perfons whatsoever, under a penalty for each and every offence not exceeding two hundred pounds, nor lefs than fifty pounds, currency.

VIII. And be it further enacted by the authority aforesaid, that the perfons fo appointed Cullers and Measurers as afo:efaid, fhall, refpectively hold themfelves in readir.efs, on all lawful days, to execute the duties of their office when thereunto required; and for every neglect, refufal or delay, when not otherwise employed in the duties of their office, to proceed, within the space of fix hours after fuch requirement, to do and perform the duties prefcribed by this A&t, they fhall respectively, for every fuch offence, forfeit and pay the fum of five pounds, current money of this Province, to the use of the person or perfons injured or delayed by fuch neglect or peded beyond refufal. Provided always, that in cafe any Culler or Measurer, when required to ether, to proceed to the execution of his office, fhall be detained or impeded therein, either by the Buyer or Seller, for more than two hours, fuch Culler and Measurer, fhall, in fuch case, be reasonably indemnified for his and their trouble and loss of time, by the perion fo detaining or impeding fuch Culler and Meaturer as aforesaid, which indemnity, in cafe of difference between the parties, fhall be ascertained and adjusted, in a fummary manner, by any one of His Majefty's Juftices of the Peace, and may be fued for and recovered, with coûts, in the fame manner as other debts of the lame value are recoverable in this Province.

IX. Et comme il fera néceffaire que les Infpe&teurs et Mefureurs foient ref. pectivement gouvernés dans leur devoir d'office par un contrat ou marché entre l'a cheteur et le vendeur, quant à ce qui regarde les dimenfions et la defcription de l'article ou des articles foumis à leur infpection: Qu'il foit de plus ftatué. par l'autorité fufdite, que dans tous les cas où il y aura un contrat ou marché par écrit entre l'acheteur et le vendeur, tel contrat ou marché fera loi pour les parties, en autant qu'il exprimera les dimenfions et la defcription de l'article ou des articles pour lef quels il aura été ainfi fait un contrat ou marché. And be it further enacted by the authority aforefaid, that in all cafes where buyer and seller, there is no fpecific agreement between the Buyer and Seller, the Cullers and Measurers to be go furers fhall respectively be governed by the following descriptions, rules, standards, descriptions in and limitations, in afcertaining and certifying the Merchantable quality of Lumber fubmitted to their infpe&tion, refpectively, that is to fay: fquare Oak Timber fhall her submited to not be lefs than twenty feet in length,and not lefs than ten inches at the smaller end,for The descriptions measurement, and fhall be free from rot, rings, fhakes and other defects, properly hewed, fquared and butted, and not more than one bend or twift in alog; fquare Elm fhall not be lefs than thirty feet in length, and not lefs than twelve inches fquare at the fmalleft end, for measurement, free from rot and fhakes and other defects, properly hewed, fquared and butted, and not more than one twift in a log; fquare white or yellow pine timber fhall not be lefs than twenty feet in length and not lefs than twelve inches fquare at the fmaller end for measurement, and fhall be free from rot, bad knots, shakes and other defects, and properly hewed, fquared and butted, and not more than one bend or twift in a log; Red Pine timber fhall not be less than ten inches fquare for measurement, and not less than twenty-five feet in length; Pine Boards fhall not be less than ten feet in length, and not lefs than one inch in thicknefs, and not lefs than eight inches in breadth, equally broad from end to end, edged by a faw or neatly trimmed by a ftraight line, free from rot, fapftains, bad knots, rents and fhakes, and of an equal thicknefs on both ides from end to end; Pine Plank fhall not be lefs than ten feet in length and not less than one and a half inch in thickness, nor lefs than fix inches in breadth, equally broad from end to end, edged by the faw or neatly trimmed by a ftraight line, free from rot, fapstains, bad knots, rents and fhakes, and of an equal thickness on both fides, from end to end; Deals fhall not be less than twelve feet in length and not less than two and a half inches in thickness, and feven, nine, and eleven inches in breadth, (the proportion of feven inches not to exceed one fixteenth part of the whole); Pipe Staves fhall not be less than five feet fix inches, in length, and five inches in breadth at the narrowest part, free from fap, and not less than one inch and a half thick; and the ftaves commonly called the ftandard Pipe Staves, by which the price of all other fizes excepting Weft-India dreffed Staves and heading, is commonly regulated, shall be of the length and breadth aforefaid, and one and a half inch thick, at the thinneft part, and on all thicker Pipe Staves one fifth of the price of the Standard Stave fhall be allowed for each additional half inch in thicknels; and Pipe Staves of one inch thick, fhall be reckoned only at one half of the price of the Standard Staves. Hogfhead Staves fhall be four feet fix inches long, four and a half inches broad, free from fap and none less than one inch thick, at the thinneft part, and fhall be reckoned at two thirds of the price of Pipe Staves of correfponding thicknefs; Puncheon Staves fhall be three and a half feet long, four inches broad, free from fap, and none lefs than one inch in thick nefs, at the thinnest part, and shall be reckoned at one half the price of Pipe Staves of corresponding thicknets.
