the faid cities of Quebec or Montreal, as an Audioneer or Auctioneers, without fuch licences, fhall forfeit and pay for all and every fach offence or offences, the fum of fifty pounds, current money of this Province; the faid fines fhall bere covered by ac tion of the Treasurers of the faid cities refpe&tively, in the Court of King's Bench of the District in which the offence fhall have been committed, on the teftimony at leaft of two credible witneffes; which faid fines fhall be applied for the purposes of

this Act.

VIII. And be it further enacted by the authority aforefaid, that out of the funds arifing from the duties impofed by this A&t, the fum of eighteen hundred pounds, Currency, hall be appropriated for each of the faid cities of Quebec and Montreal, for defraying the expences neceffary for the purposes of this Act.

IX. And be it further enacted by the authority aforefaid, that it shall be the duty for carrying this of the Road Treaturers of the cities of Quebec and Montreal respectively, upon the orders to him iven by three Juftices of the Peace in the faid cities respectively, to infti. tute and conduct to final judgment and execution, the profecutions neceflary for compelling payment of any monies which it is hereby made the duty of any perfon or perfons to pay; and that the mode of prolecution fhall be by action by the faid Road-Treafurers refpectively, in His Majefty's Court of King's B nch of the District in which they are refuectively Road Treasurers; and in cafes where judgment fhall be given in favor of the faid Treafurers, the Court may levy the amount thereof, with the cofts of fuit which may be taxed, by execution, seizure, and fale of the moveable effects, belonging to the offender or offenders.

X. And be it further enacted by the authority aforefaid, that the Road Treasurers Road-Treasurers of the faid cities of Quebec and Montreal refpectively, fhall be entitied to have, receive, and retain for, and in confideration of their trouble in levying, collecting, and paying the monies to be by them levied, collected, and paid in virtue of this Act, at the rate of two and one half per cent. upon the groís amount of all the monies which may at any time hereafter come into their hands refpectively, under and by Virtues of this A&.

Surplus of the money how applied.

XI. And be it further enacted by the authority aforefaid, that the annual furplas of all monies that fhall be levied under and by virtue of this A&t, over and above the appropriations herein-before provided, fhall go to the fund, and be applied to and for fuch purpofes as the affeffments rifed in the faid cities of Quebec and Montreal, under and by virtue of an Act paffed in the thirty-ninth year of His Majefty's

Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera du devoir du · Trélorier des chemins des Cités de Québec et de Montréal refpectivement, fur sorier des chemins ordre à loi donné par trois Joges de Paix des dites Cités relpectivement, d'intenter Acte à exécution et conduire jufqu'à jugement final et exécution, les pourfuites néceffaires pour forcer la rentrée d'aucunargent qu'il eft par le préfent du devoir d'aucune perfonne ou perfonnes de payer, et que le mode de pourfuivre fera far action des dits Tréforiers refpectivement dans la Cour du Banc du Roi de Sa Majefté du Diftri& où i's font. Tréforiers des chemins refpectivement, et dans le cas où le Jugement fera rendu en faveur des dits Tréforiers, la Cour pourra faire prélever la fomme principle avec les Honoraires et frais de pourfuite à être taxés par Exécution,, Saifie et vente des biens et effets mobiliers des contrevenans..

XII. An ACT to amend an Act paffed in the forty-fixth year of His Majesty's Reign, intituled, "An Act to repeal an Ordinance made and paffed in "the twenty fifth year of His Majefty's Reign, intituled, "An Ordinance "to prevent the exportation of unmerchantable Flour, and the falfe taring "of Bread and Flour casks, to regulate the packing and inspection of "Flour and Indian Meal, and to provide for afcertaining the quality of Biscuit in future.”

WHEREAS, it is expedient to amend an Act palled in the forty-fixth year of

His Majefty's Reign, intituled, "An Act to repeal an Ordinance made and " paffed in the twenty-fifth year of His Majefty's Reign, intituled," An Ordinance - to prevent the exportation of unmerchantable Flour, and the falfe taring of Bread * and Flour casks, to regulate the packing and inspection of Flour and Indian meal,

" and to provide for afcertaining the quality of Bifcuit in future," and to make further provifion for the purposes of the faid Act; Be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legiflat ve Council and Affembly of the Province of Lower Canada, conftituted and ffemble dby virtue of and under the authority of an A& paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act paffed in "the fourteenth year of His Maj fty's Reign, intituled," An At for making more "effectual provifion for the government of the Province of Quebec in North America," "and to make further provifion for the government of the faid Province;" and it is hereby enacted by the authority of the fame, that from and after the paffing of this Governor, &c. Act, it fhall and may be lawful for the Governor, Lieutenant-Governor, or perfon maturat adminiftering the Government of this Province for the time being, from time to real, Three-ii- time, by an inftrument under his hand and fea! at Arms, to nominate and appoint vers,and William one or more Inspectors of Flour and Meal in each of the Cities of Quebec and Montreal, and for the town of Three-Rivers refpectively, and an Infpector of Four and Meal for the Borough of William Henry ; which Inspectors of Flour and Meal fhall not have power or authority to appoint or fubftitute any deputy or deputies in their or any of their places or fteads, for any of the purposes of this Act, nor for any of the purposes of the Act herein-firft above mentioned, it being hereby enacted and required, that the faid Infpectors fhall execute the duties of their offices in perfon, and not otherwife..

II. And be it further enacted by the authority aforefaid, that no perfon or perfons: appointed Inspec- fhall at any time after the paffing of this Act, be appointed as fuch Inspector or In1pectors as aforefaid, until fuch perfon or perfons fhall have previously undergone an examination as to his or their knowledge and capacity to act as fuch Infpector and Inspectors as aforefaid, before a Board of competent perfons as examiners, which Board the Governor, Lieutenant-Governor, or perfon adminiftering the government of this Province for the time being, is hereby authorifed and empowered to nominate and appoint for that purpose, by Commiffion under his hand and feal.

III. And be it further enacted by the authority aforelaid, that from and after the first day of May, one thoufand eight hundred and nineteen, all cafks containing Dimensions of Four or Meal, brought to the Cities of Quebec and Montreal, to the town of ThreeRivers, and to the borough of William Henry, for fale or exportation, shail be of the following dimenfions; that is to fay; the ftaves of all barrels to be of the length of twenty-seven inches, and the diameter at the head to be feventeen inches; the ftaves of all half barrels to be twenty-two inches in length, and the diameter at the head to be thirteen inches.
