upon oath, with a copy of the aforefaid notices thall be depofited with any Notary Public refiding in the D.ft&t of Quebec.

XIV. Provided always, and be it further enacted by the authority aforefaid, Proces Verbal that if the inhabitants of the faid parishes of Saint Nicholas and Saint. Jofeph de la Point Levi, fhail, within three months after fuch notification as aforesaid, apply by Petition to the Grand Voyer of the Diftri& of Quebec, or to his Deputy, to obtain a Procès Verbal, and shall cause the same to be ratified according to law, before the twenty-first day of January one thousand ei he hundred and nineteen, for the purpose of caufing the faid bridge to be erected by the faid partthes of St. Nicholas and St. Jofeph de la Point Levi, according to the laws now in force, and shall thereafter in virtue of the faid Procès Verbal erect the laid bridge within one year to be computed from the date of the homologation of the faid Procès Verbal, then, and in fach cafe, the faid Walter Davidfon, fhall not avail himself of this Act for the purpose of erecting the faid bridge, and levying the faid rates of toll. Provided always, that if fuch Petition as above-mentioned, be not made to the Grand Voyer, or to his Deputy, as aforelaid, within three months, and a copy thereof ferved upon the faid Walter Davidjon, within three months after fuch notification as aforefaid, it shall forthwith, after the expiration of the faid three months, be lawful for the faid Walter Davidfon, to avail himself of this Act, and to proceed immediately thereafter to the erection and conftruation of the laid bridge and toll-house.

XV. And be it further enacted by the authority aforefaid, that this A& shall be deemed a public A&t, and shall be judicially taken notice of as fuch, by all Judges, Juftices of the Peace, and all other perfons whomfoever, without being specially pleaded.

XIV. Pourvû toujours, et qu'il foit de plus ftatué par l'autorité fufdite, que fi habitants dans les trois mois après telle notification comme ci-deffus, les Habitants des dites Grand-Voyer Paroiffes de Saint Nicolas et de Saint jofeph de la Pointe Lévi s'adreffent par Re- Procks Verbal. quête au Grand Voyer du District de Québec, ou à lon Député, à l'effet d'obtenir un procès verbal, et que le dit procès verbal foit homologué conformément à la Loi, avant le vingt-unième jour de Janvier, mil huit cent dix-neuf, fpécifiant que le dit Pont fera érigé par les dites Paroiffes de Saint Nicolas et de Saint Jofeph de la Pointe Lévi, conformément aux Loix maintenant en force, et fi les dits habitants en vertu du dit procès verbal érigent le dit Pont dans le cours d'une année, à compter de la date de l'homologation du dit procès verbal, alors et dans tel cas le dit Walter Davidfon ne pourra fe prévaloir de cet Acte au fins d'ériger le dit Pont, et prélever les dits taux de péage. Pourvu toujours, que fi telle Requête, tel que ci-deffus mentionné, n'est pas faite comme fufdit au Grand-Voyer ou à fon Député dans trois mois, et fi copie d'icelle n'eft pas signifiée au dit Walter Davidfon, dans les trois mois après la dite notification, il fera loifible, fitôt après l'expiration des dits trois mois, au dit Walter Davidfon, de le prévaloir de cet Acte, et de procéder Litôt après à ériger et conftruire le dit Pont, et la dite Maison de Péage.

XV. Et qu'il foit de plus flatué par l'autorité fufdite, que cet A&te fera jugé être Acte publie, un Acte public, et comme tel, il en fera judiciairement pris connoiflance par tous Juges, Juges de Paix et autres perfonnes quelconques, fans qu'il foit spécialement. plaidé.

ter, would materially augment the convenience and facility of the intercourfe of the Inhabitants of the adjacent parishes and conceffions, and of the public at large. And whereas François Verrault, of the parish of Sainte Marie Nouvelle Beauce, in the faid County, by his petition in that behalf, hath prayed leave to erect a toll-bridge over the faid iver Etchenins; may it therefore please your Majefty, that it may be enacted and be it enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of Fr. Verrault, an Act paffed in the Parliament of Great-Britain, intituled, "An Act to repeal cer. authorized to "tain parts of An Act paffed in the fourteenth year of His Majesty's Reign, intiover the river of tuled " An Act for making more effectual provifion for the government of the Province 6 of Quebec in North America," and to make further provifion for the government "of the faid Province ;" and it is hereby enacted by the authority of the fame, that it fhall be lawful to and for the faid François Verrault, and he is hereby authorized and empowered at his own cofts and charges to erect and build a good and substantial Bridge over the faid river of Eichemins, near the Church of the faid Parish, and to erect and build one Toll-Houfe and Turnpike, with other dependencies, on or near the faid Bridge; and alfo to do, perform, and execute all other matters and things requiste and neceffary, ufeful or convenient for erecting and building, maintaining and fupporting the said intended bridge, toll- houfe, turnpike, and other dependencies, according to the tenor and true meaning of this Act, and further that for the purpose of erecting, building, maintaining and fupporting the faid bridge, the faid François Verrault, his heirs, executors, curators and affigns, fhall have full power and authority to take, from time to time, and use the land on either fide of the faid river Eichemins, and there to work up or caufe to be worked up the materials and other things necef fary for erecting, conftructing or repairing the faid Bridge accordingly: the faid François Verrault, his heirs, executors, curators and affigns, and the perfons by him or them en ployed, doing as little damage as may be, and making reasonable and just satisfaction to the refpective owners and occupiers of all fuch lands and grounds, as fhall be altered, damaged or made ufe of, for the value of fuch land as well as for that of the alteration or of the damages which they may caule to the proprietors, by means of or for the purpofe of erecting the faid bridge, and the faid house as above defignated; and in cafe of difference of opinion and difpute about the quantum of fuch fatisfaction, the fame shall be fettled by His Majefty's Court of King's Bench, of and for the District of Quebec, after a previous vifitation, examination and eftimation of the premises fhall have been made, by Experts, to be named by the parties, respectively and in default of fuch nominaiion, by them or either of them, then by the faid Court, in manner and form prescribed by Law; and the faid Court is hereby authorised and empowered to hear, fettle and finally determine the amount of such compensation, in confequence. Provided always, that the faid François Verrault, his heirs and fucceffors, fhall not commence the erection of the faid bridge and other works by which any perfon may be deprived of his land or of part thereof, or may fuffer damage before the price or value of the faid land and

chefter, augmenteroit de beaucoup l'aifance et la facilité de la communication des Habitans des Paroiffes et Conceffions voisines et du public en général; Et attendu que François Verrault, Ecuyer, de la Paroiffe de Sainte Marie, Nouvelle Beauce, dans le Comté fufdit, a par fa Pétition à cet effet demandé permiffion de bà ir un Pont de Péage fur la dite Rivière Etchemins: Qu'il plaife donc à Votre Majesté qu'il puiffe être ftatué, et qu'il soit ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Afte qui rappelle certaines par "ties d'un A&te paffé dans la quatorzième année du Règne de Sa Majefté, intitulé, "Ate qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec, "dans l'Amérique Septentrionale," et qui pourvoit plus amplement pour le Gou "vernement de lafdite Province ;" Et il eft par le présent ftatué par la dite autorité, qu'il fera loifible au dit François Verrault, et il eft par le préfent autorifé et a pouvoir d'ériger et bâtir à fes propres frais et dépens un Pont folide et fuffifant fur la dite Rivière Echemins, piès de l'Eglife de la dite Paroiffe, et d'ériger et conftruire une Maifon de Péage et une Barrière avec d'autres dépendances fur on près du dit Pont, et auffi de faire et exécuter toutes autres matières et chofes requifes et néceffaires, utiles ou commodes pour ériger et conftruire, entretenir et foutenir le di: Pont projetté, Maifon de Péage, Barrière et autres dépendances fuivant la teneur et le vrai fens de cet Acte; et de plus afin de parvenir à ériger, bâtir et entretenir et foutenir le dit Pont, le dit François Verrault, fes héritiers, exécuteurs, curateurs et ayans caufe auront plein pouvoir et autorité de prendre de tems à autre, et de fe fervir du terrein foit d'un côté ou de l'autre de la dite Rivière Echemins, là de travailler ou faire travailler les matériaux et autres chofes néceffaires à l'érection, conftruction ou réparation du dit Pont, en conféquence le dit François Verrault, fes héritiers, exécuteurs curaleurs ou ayans caufe, et les perfonnes par lui ou par eux employées, caufant auffi peu de dommage que poffible,et accordant une compenfation jufte et raisonnable aux propriétaires et occupans refpectifs de tous tels terreins qui feront altérés, endommagés ou mis en ufage pour la valeur de tel terrein, ainfi que pour celle de l'altération ou des dommages qu'ils pourroient caufer aux propriétaires pour ériger le dit Pont et la dite Maison, ainfi qu'il eft ci-deffus défigné, et en cas de différence d'opinion et de contestation fur le montant de telle compenfation, il fera réglé par la Cour du Banc du Roi de Sa Majefté, pour le District de Québec, après que visite et examen et eftimation des lieux auront été préalablement faits par des experts qui feront nommés par les parties refpe&tivement, et à défaut de telle nomination par elle ou aucune d'elles, alors par la dite Cour, en telles manières et forme prefcrites par la Loi, et la dite Cour eft par ces préfentes autorisée et a pouvoir d'estendre, régler et finalement déterminer le montant de telle compenfation en confé quence. Provided, that after the expiration of fifty years, to be accounted from the paing of this AC, it all and may be lawful for His Majefty, his heirs and fucceffers, to affume the poffeffion and property of the faid budge, toll-houfe, turnpike, and dependencies, and the afcents and the approaches thereto, upon paying to the faid François Perrault, his heirs, executors, curators, or affigns, the full and entire value which the fame may, at the time of fuch affumption, bear and be worth; and when and fo foon as the faid bridge fhall be erected and built, and made fit and proper for the paffage of travellers, cattle and carriages, and that the fame shall be certified by any two or more faftices of the Peace, for the District of gois Verrault for Quebec, after examination thereof, by three Experts, to be appointed and fworn by the faid Juftices of the Peace, and be advertifed in the Quebec Gazette, it shall be Lawful for the faid François Perrault, his heirs, executors, curators and affigns, from time to time and at all times, to af, demand, receive, recover, and take toll, and for his own proper ufe and behoof, for Pontage, or in the name of a toll or duty, b.. fore any paffage of the faid bridge, fhall be permitted, the feveral fums following, that is to fay: for every Coach or other four-wheeled Carriage, loaded or unloaded, with the Driver and four Perfons, or lefs, drawn by two or more horfes or other beafts of draught, one filling and three pence, currency; for every waggon or other four-wheeled carriage, loaded or unloaded, one thilling currency; for every chaife, calafh, chair, with two wheels or cariole, or other fuch carriage, loaded or unloaded, with the driver and two perfons, or lefs, drawn by two holes or other beafts of draught, four pence, currency; and drawn by one horse or other beaft of draught, three pence, currency; for every cart, fled, or other fuch carriage, loaded or unloaded, drawn by two horfes, oxen or other beafts of draught, with the driver, four-pence, currency; and drawn by one horse, or other beaft of draught, three-pence, currency; for every perfon on foot, one half penny, currency; for every hoife, mare, mule, or other beaft of draught, laden or unladen, one-penny, half penny, currency; for every perfon on horseback, two-pence, currency; for every bull, ox, cow, and all other horned and neat cattle, each, one penny, currency; for every hog, goat, fheep, calf or lamb, one-haifpenny, currency.
