XI. XIII. Provided always, apd be it further enacted by the authority aforefaid, that the faid William Hall, to entitle himself to the benefits of this Act, fhall, and he is hereby required within two months from and after the paffing of this Act, 10 to entitle him- give public notice three weeks in the Quebec Gazette, and in writing, to be affixed fits of this Act, to at the church doors of each of the four neareft Townships which may be fettled, and in case there be no churches in fuch Townships then at the most public places in the faid Townships, that he is thereby authorized to build and conftruct a bridge and toll-house over the great branch of the faid river Saint François, at the place above-mentioned; and that the inhabitants of the faid Townships are entitled to ap ply to the Grand Voyer, or to his Deputy, within three months after fuch notifica tion, for the purpose of themselves building the faid bridge, which faid notices fhall b: before a Juftice of the Peace, certified upon the oaths of any two Officers of Militia, refiding in the County of Buckinhamfhire to have been duly made and given. which Certificate, upon oath with a copy of the faid notices, fhall be depofited with any Notary public, refiding in the District of Three Rivers..

Et qu'il foit de plus ftatué par l'autorité fufdite, que les argents qui feront prélevés en vertu de cet A&te, et qui ne font pas ci-devant accordés au di William Hall, les hoirs et ayans caule, et les différentes amendes et pénalités in fligées par le préfent feront, comme ils font par le prefent, accordées et réservées à Sa Ma jeftě, fes héritiers-et fucceffears, pour les ufages publics de cette Province, et le foutien du Gouvernement d'icelle en la manière ci-devant exprimée, et fera tenu compte à Sa Majefté, fes Héritiers et Socceffeurs de la due application de tels argents, amendes et pénalités, par la vole des Lords Commiffaires du Tréfor de Sa Majefte, pour le tems d'alors, en elles manière et forme que Sa Majefté, lesHéritiers et Succeffeurs l'ordonneront.

XII. Pourvû toujours, et qu'il foit de plus ftatué par l'autorité fufdite, que le dit Pont qui doit être par le préfent bât fur la dite Grande Banche de la Rivière Saint François, fera fuffifamment élevé, et il y aura un elpace fuffifant de laffe entre les Pilers ou Quais du dit Pont, pour que les Cages de quarante pieds de largeur puiffent defcendre la dite Rivière, ety paffer fans interruption.

XIII. Pourvu toujours, et qu'il foit deplus ftatué par l'autorité fufdite, que le dit William Hall, pour le mettre à même de jouir du bénéfice qui lui eft accordé par cet A&te fera, et il eft par le préfent requis de donner fous deux mois après la paffation de cet Acte, notice publique pendant trois femaines dans la Gazette de Québec, et par un écrit affiché aux Portes des Eglifes de chacun des quatre Town. fhips, habités et voifins de l'endroit, et à défaut d'Eglife, alors à l'endroit le plus public,et fréquanté des dits Townships, qu'ileit autorité par le ditActe à bâtir, et construire un Pont et Maison de Peage for la Grande Branche de la dite Rivière Saint Francois, à l'endroit ci-deffus mentionné, et que les Habitants des dits Townships ont droit de s'adreffer au Grand Voyer ou à fon Député dans les trois mois après la notification pour bâtir eux mêmes le dit Pont, et il fera certifié fous le Serment d'aucun deux Officiers de Milice réfidant dans le Comté de Buckinghamshire, que les dites notices ont été duement faites et données devant un Juge de Paix, lequel certificat lous lerment ainsi qu'une copie des dites notices, feront dépofées chez aucun Notaire Public réfidant dans le Diftrict des Trois Rivièles.

XIV. Provided always, and be it further enacted by the authority aforefaid, Grand Voyer for a that if the inhabitants of any of he aforefaid Townships in the County of Bickn hamshire, shail, within three months after fuch notification as aforefaid, apply by Petition to the Grand Voyer of the District of Quebec, or to his Deputy, to obtain a Procès Verbal, and shall caufe the fame to be ratified according to law, before the twenty-first day of January one thousand ei ht hundred and nineteen, fpecifying that the faid bridge fhall be erected by the faid Townships or any one of th m, or any part of them, according to the laws now in force, and fhall thereafter in virtue of the faid Procès Verbal erect the laid bridge within one year to be computed from the date of the homologation of the faid Procès Verbal, then, and in such case, the faid William Hall, fhall not avail himself of this Act for the purpose of erecting the faid bridge, and levying the faid rates of toll. Provided always, that if fuch Petition as above-mentioned, be not made and prefented to the Grand Voyer, or to his Deputy, as aforelaid, within three months, and a copy thereof ferved upon the faid William Hall, within three months after fuch notification as aforefaid, it shall forthwith, after the expiration of the faid three months, be lawful for the faid William Hall to avail himself of this Act, and to proceed immediately thereafter to the erection and construction of the faid bridge and toll-house.

XV. And be it further enacted by the authority aforefaid, that this A&t shall be deemed a public Act, and fhall be judicially taken notice of as fuch, by all Judges, Juftices of the Peace, and all other perfons whomfoever, without being specially pleaded.

An Act to authorize François Verrault, Esqnire, to builda Toll-Bridge over the River Chaudière, in the Parish of Sainte Marie de la Nouvelle Beauce, near the Church of the faid Parish, in the County of Dorchester.

WHEREAS the erection of a Bridge over the River Chaudière, in the Parish of Sainte Marie, Nouvelle Beauce, near the Church of the faid Parifh in the County of Dorchefter, would materially augment the convenience and facility of the intercourse of the inhabitants of the adjacent parishes and conceffions and of the public at large; And whereas François Verrault, Esquire, of the parish afore faid in the County aforefaid, by his petition in that behalf, hath prayed leave to erect a toil bridge over the faid river Chaudière: May it therefore please your ma jefty that it may be enacted, and be it enacted by the King's most excellent majes

Verbal, et que le dit Procès Verbal foit homologué conformément à la Loi,avant le
vingt-unième jour de Janvier mil huit cent dix-neuf, fpécifiant que le dit Pont fera
érigé par les dits Townships, ou quelqu'uns ou quelques parties d'iceux, conformé-
ment aux Loix maintenant en force, et files dits Habitants en vertu du dit Procès
Verbal érigent le dit Pont dans le cours d'une année, à compter de la date de l'ho-
mologation du dit Procès Verbal, alors et dans tel cas le dit William Hall ne
pourra fe prévaloir de cet Acte aux fins d'éniger le dit Pont et prélever les dits
Taux de Péage. Pourvu toujours que fi telle Requête, tel que ci deffus mentionné,
n'eft pas
faite et présentée au Grand Voyer ou à lon Député comme fufdit dans les
trois mois, et fi copie d'icelle n'eft pas fignifiée au dit William Hall, dans les dits
trois mois après la dite notification, il fera loifible, fitôt après l'expiration des trois
mois, a dit William Hall. de le prévaloir de cet Acte, et de procéder fitôt après à
ériger et conftruire le dit Pont et la dite Mailon de Péage.

XV. Et qu'il foit de plus ftatué par l'autorité fufdite, que cet A&te fera jugé Acte public être un Acte public, et comme tel, il en fera judiciairement pris connoiffance par tous Jiges, Juges de Paix et autres perfonnes quelconques, fans qu'il foit spéciale ment plaidé.

TTENDU que l'érection d'un Pont fur la Rivière Chaudière en la Paroiffe Préambule de Sainte Marie Nouvelle Beauce, près de l'Eglite de la dite Paroiffe, dans le Comté de Dorchester, augmenteroit de beaucoup l'ailance et la communication des Ha bitans des Paroiffes et conceffions volfines et du public en général, et attendu que François Verrault, Ecuyer, de la Paroiffe fufdite, dans le Comté fufdit, a par fa petition à cet effet demandé permiffion de bâtir un Pont de Péage fur la dite Rivière Chaudière; Qu'il plaife donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la Très Excellente Majefte du Roi, par et de l'avis et confentement du Confri Le

ty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower-Canala, conftituted and assembled by virtue of, and under the authority of an A&t paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A&t passed in the fourteenth year of His Ma jefty's Reign, intituled, "An A&t for making more effectual provifion for the go"vernment of the Province of Québec, in North-America ;" and to make further provision for the government of the faid Province;" And it is hereby enacted by the authority of the fame, that it fhall be lawful to and for the faid François Verrault, and he is hereby autho ifed and empowered, at his own cofts and charges, to erect and build a good and substantial Bridge, over the laid river Chaudière, near the Francois Ver Church of the faid parifh of Sainte Marie Nouvelle Beauce, and to erect or build to build a bridge one toll-house and turnpike with other dependencies, on or near the faid bridge, and alfo to do perform and execute all other matters and things requifite and necel fary, ufeful or convenient for ere&ting and building, maintaining and fupporting the faid intended bridge, toll-house, turnpike, and other dependencies, according (0 the tenor and true meaning of this A&t; and further, that for the purpose of erecting, building, maintaining, or supporting the faid bidge, the said François Verrault, his heirs, executors, curators and affiges, fhail have full power and authority to t-ke from time to time, and use the land on either fide of the river Chaudière, and there to work up or caufe to be worked up the materials and other things neceffary for erecting, conftructing, or repairing the faid bridge accordingly: the faid François Verrault, his heirs, executors, curators and figns, and the pertons by him or them en ployed, doing as little damage as may be, and making reafonable and juft fatis faction to the refpective owners and occupiers of all fuch lands and grounds, as fhall be altered, damaged or made ufe of, for the value of fuch land as well as for that of the alteration or of the dam ges which they may caule to the proprietors, by means of or for the purpose of er curg the faid bridge, and the faid houfe as above defignat d; and in cale of difference of opinion and difpute about the quan. tum of fuch fatisfaction, the fame shall be fertied by His Majefty's Court of King's Bench, of and for the District of Quebec, after a previous vifitation, examination and eftimation of the premifes fhals have been made, by Experts, to be named by the parties, respectively and in default of fuch nomination, by them or either of them, then by the fad Court, in manner and form prescribed by Law; and the faid Count is he by authorised and empowered to hear, fettle and finally determine the amount of luch compenfation, in confequence. Provided always, that the faid François Verrault, his heirs or fucc flors, fhall not commence the erection of the faid bridge and other works by which any perfon may be deprived of his land or of part thereof, or may fuffer damage before the price or value of the faid land and damages eftimated and fettled in the manner before prescribed, fhall have been paid to fuch perfon, or after fuch price or value fhall have been offered to him, or that on his refufal, the faid François Verrault, fhall have depofited it, at the office of the Prothonotary of the Court of King's Bench for the District of Quebec.
