An ACT to authorize William Hal, Efquire, to build a Toll-Bridge over
the Great Branch of the River St. François, near the line of feparation
between the Townships of Dudfwell and Westbury, in the County of
Buckinghamshire..

WHEREAS the erection of a Bridge over the Great Branch of the River. Saint

François, near the line of feparation between the Townships of Dudswell and Wesbury, in the County of Buckinghamshire, would materially augment the convenience and facility of the intercourse of the Inhabitants of the adjacent parih s thorized to build and conceffions, and of the public at large: And whereas William Hall, of the the great branch City of Quebec, by his petition in that behalf, hath prayed leave to erect a Toll-bridge over the great branch of the faid river Saint François, may it there fore please Your Majefty, that it may be enacted, and be it enacted, by the King's most excellent Majefty, by and with the advice and confent of the Le giflative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A&t paffed in the Parlia ment of Great Britain, intituled, " An Act to repeal certain parts of an A& paffed "in the fourteenth year of His Majefty's reign, intituled, "An Act for making "more effectual provifion for the government of the Province of Quebec in North Ame rica,' and to make further provifion for the government of the faid Province;" And it ishereby enacted by the authority of the fame, that it fhall be lawful to and for the faid William Hall, and he is hereby authorized and empowered at his own cofts and charges to erect and build a good and fubftantial Bridge over the great branch of the faid River Saint François, and to erect or build one Tall-Houte and Turnpik, with other dependencies, on or near the faid Bridge; and alfo to do, perform, and execute all other matters and things requifite and neceffary, useful and convenient for erecting and building, maintaining and fupporting the faid intended bridge, toll house, turnpike, and other dependencies, according to the tenor and true meaning of this Act; and further, that for the purpose of erecting, building, maintain. ing and tupporting the faid bridge, the faid William Hall, his heirs, executors, curators, and affigns, fhall have full power and authority to take, from me to time, and ufe the land on either fide of the great branch of the faid

ACTE pour autorifer William Hall, Ecuyer, à ériger un Pont de Péage fur la Grande Branche de la Rivière Saint François, près de la ligne de feparation entre les Townships de Dudfwell, et de Weftbu y, dans le Comté de Buckinghamshire.

ATTENDU que l'étection d'un Pont for la Grande Branche de la Rivière
Saint François près de la ligne de féparation entre les Townships de Dad
fweil, et de Weftbury dans le Comté de Buckinghamshire, augmenteroit de beau-
coup l'aifance et la facilité de la communication des Habitats des Paroiffes et
conceffions voisines, et du public en général ; Et attendu que William Hall, de la
Cité de Québec, a par fa Pétition à cet effet, demandé permiffion de bâtir un
Pont de péage fur la Grande Branche de la dite Rivière de Saint François ;
Qu'il plaife donc à Votre Majefté, qu'il puiffe être ftatué, et qu'il foit ftatné par
la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil
Législatif, et de l'Affemblée de la Province du Bas- Canada, conftitués et aflemblés
en vertu et fous l'autorité d'un A&te paffé dans le parlement de la Grande Bretagne,
intitulé," A&te qui rappelle certaines parties d'un Acte paffé dans la quatorz ème
"Année du Règne de Sa Majefté, intitulé; " A&te qui pourvoit plus efficacement
"pour le Gouvernement de la Province de Québec, dans I Amérique Septentrionale;"
"Et qui pourvoit plus amplement pour le Gouvernement de la dite Province;"
Et il eft par le préfent ftatué par la dite autorite, qu'il fera loifible au dit William
Hall, et il eft par le préfent autorifé et a pouvoir d'ériger et bâtir, à fes propres fra's
et dépens, un Pont folide et fuffifant fur la grande branche de la dute Rivière Saint un
François, et d'ériger et conftruire une Maifon de Péage et une Barnière
autres dépendances fur, ou près du dit Pont, et auffi de faire et exécuter toutes
autres matières et chofes requifes et nécellaires, unles ou commodes pour ériger
et conftruire, entretenir et foutenir le dit Pont projetté, Maison de Péag-, Barrière
et autres dépendances, fuivant la teneur et le vrai iens de cet A&te, et de plus e fin
de parvenir à ériger, bâtir et entretenir et foutenir le du Pont, le dit Will am Hall,
fes héritiers, exécuteurs, curateurs et ayans caufes auront plein pouvoir et autorité
de prendre de tems à autre, et de fe fervir du terrein foit d'un côté ou de l'autre de
la Grande Branche de la dite Rivière Saint François, là de travailler ou faire tra-

uthorize river Saint François, and there to work up, or cause to be worked up the materials use the land on and other things neceffary for erecting, conftruating, or repairing the faid bridge ac and to or cordingly; the faid William Hall, his heirs, executors, curators, and affigns, and the Bars for construct perfons by him or them employed, doing as little damage as may be, and making ing the bridge, reasonable and juft fatisfaction to the refpective owners and occupiers of all fuck to the respective lands and grounds as fhall be altered, damaged, or made ufe of for the value of cupiers of the fuch land as well as for that of the alteration or of the damages which they may lands for the da caufe to the proprietors by means of or for the purpose of erecting the faid bridge, and the faid house as above defignated; and in cafe of difference of opinion and dispute about the quantum of fuch fatisfaction, the fame fhall be fettled by His Majefty's Court of King's Bench, of and for the Diftri&t of Three-Rivers, after a previous vifitation, examination, and eftimation of the premises, shall have been made by experts to be named by the parties refpectively; and in default of luch nomi nation by them, or either of them, then by the faid Court, in manner and form prefcribed by law, and the faid Court is hereby authorized and empowered to hear, fettle, and finally determine the amount of fuch compenfation in confequence.Provided always, that the faid William Hall, his heirs or fucceffors, fhall not commence the erection of the faid bridge and other works, by which any perfon may be deprived of his land or of part thereof, or may suffer damage, before the price or value of the faid land and damages estimated and fettled in the manner before prescribed, fhall have been paid to fuch person or after fuch price or value fhall have been of fered to him, or that on his refufal, the faid William Hall, shall have deposited it at the office of the Prothonotary of the Court of King's Bench for the District of Three-Rivers. .

II. And be it further enacted by the authority aforefaid, that the said Bridge a signs, at the ex- and Toll-Houfe, Turnpike and dependencies to be erected thereon, or near years, His Majesty thereto, and also the afcents or approaches to the faid Bridge, and all materials possession of the which fhall be from time to time furnifhed or provided, for erecting, building, or paying to William making, maintaining and repairing the same, fhall be vested in the faid William Hall, his heirs and affigns for ever. Provided, that after the expiration of fifty years to be accounted from the paffing of this Act, it shall and may be lawful for His Majefty, his heirs and fucceffors, to affume the poffeffion and property of the faid bridge, toll-house, turnpike and dependencies, and the afcents and the approaches thereto, upon paying to the faid William Hall, his heirs, executors, Carators, and affigns, the full and entire value which the fame fhall at the time of fuch aflumption, bear and be worth, and when and fo foon as the faid bridge fhall be erected and bail, and made fit and proper for the paffage of travellers, cattle and carriages, and that the fame shall be certified by any two or more Juftices of the Peace, for the District of Three-Rivers, after examination thereof, by three experts, to be appointed and [worn by the faid Juftices of the Peace, and be advertized in the Quebec Gazette, it shall be Hall, for pontage lawful for the faid William Hall, his heirs, executors, curato.s and affigns, from ume to time, and at all times to afk, demand, receive, recover and take toll, and for their own proper ufe and behoof, for pontage, as or in the name of a tollor duty, before

Pourvû, qu'après l'expiration de cinquante années à A l'expiration compter depuis la paffation de cet Acte, il fera et pourra être loisible à Sa Majefte, fes héritiers et fucceffeurs de reprendre la poffeffion et propriété du dit Pɔnt, Maifon de péage, Barrière et autres dépendances, ainfi que les abords et montees tere valeur. à icelui, en payant au dit William Hall, les héritiers, exécuteurs, curateurs oa ayans caufe, l'entière et pleine valeur qu'il pourra avoir et valoir an tens de telle accordés à Wilprite de poffeffion, et lors et auffitôt que le dit Pont fera érigé et conftruit, et fait Pontouage. d'une manière propre et convenable pour le paffage des voyageurs, beitiaux et voitures, ce qui fera certifié par deux ou plus des Juges de Paix, pour le Danc des Trois Rivières, d'après un examen d'icelui par trois experts, qui feront nommés · et affermentés par les dits Juges de Paix, et publiés dans la Gazette de Québec, il fera lofible au dit William Hall, les héritiers, exécuteurs, curateurs et ayans cause, de tems à autre, et en tous les tems, de demander, exiger, recevoir t

any paffage over the faid bridge fhall be permitted, the feveral fams following, that is to lay for every coach, or other four wheeled carriage, loa ed or unloaded, with the driver and four perfons, or lefs, draw by two or more hofes, or other brafts of draught, one fhilling and two pence currency; for every waggon, or other four wheeled carriage, loaded, or unloaded, eleven pence currency; for every chaife, calafh chair with two wheels, cariole, or other fuch carriage, load d or unloaded, with the driver and two perfons or lefs, drawn by two horles or other beats of draught, three pence half-penny, currency; and drawn by one horfe or beast of draught two pence half penny currency; for every cart, fled, or other fuch carriage, loaded or unloaded, drawn by two hories, oxen, or other beafts of draight, with the drivers, three-pence half-penny currency; and drawn by one horse or other beaft of draught, two-pence half penny currency; for every perfon on foot one half-penny, currency; for every horfe, mare, mule, or other beaft of draught, laden or unla den, one penny, half-penny currency; for every perlon on horseback, two-pence cur. rency; for every bull, ox, cow, and all other horned and neat cattle, each one pen. ny, currency; for every hog, goat, sheep, calf or lamb, one half-penny, currency.

III. Provided always and be it further enacted by the authority aforesaid, that no person, hoise or carriage employed in conveying a mail or letters under the authority of his Majefty's Poft Office, nor the horses, or carriages, laden or not la⚫ den, and drivers attending officers and foldiers of His Majesty's Forces, or of the Militia, whilft upon their march or on duty, nor the faid officers or foldiers or any may reduce and of them, nor carriages and drivers or guards fent with prifoners of any defcription, shall be chargeable with any tall or rate whatfover. Provided a fo, that it fhail and may be lawful for the laid William Hall, his her s, execu ors, curators and affigns to diminish the faid tolls, or any of hem, and afterwards if he or they fhall Table of rates fee fit, again to augment the fame, or any of them, fo as not to exceed in any cafe the rates herein.before authonfed to be teken. Provided allo, that the faid William Hall, his heirs, executors, curators, and affigns fhali affix, in fome conspicuous place, at or near fuch Toll-Gate, a Table of the Races payable for paffing over the faid bridge; and fo often as fuch rates may be diminished or augmented, he or they fhail caufe fuch alteration to be affixed, in manner aforefaid.

IV.
