draught, nine-pence, currency; for every Perfon on foot, two-pence half-penny, currency; for every Horfe, Mare, Gelding, Mule, or other Beaft of draught, laden or unladen, seven-pence half-penny, curteacy; for a Horfe and his Rider, fevenpence half-penny, currency; for every Buli, Ox, Cow, and all other horned and neat Cattle, each four-pence, currency; for every Hog, Goat, Sheep, Calf and Lamb, two-pence, currency.

III. Provided always, and be it further enacted by the authority aforefaid, that no Perfon, Horfe or Carriage employed in conveying a Mail or Letters under the authority of His Majefty's Poft-Office, nor for the Horfes, Carriages, laden or not luden, and Drivers attending Officers and Soldiers of His Majefty's Forces, while upon their march or on duty, or of the Militia, whilft upon their march or on duty, nor Caniages and Drivers on the Guards fent with Prifoners of any defcription, fhall be chargeable with any Toll or Rate whatsoever. Provided also, that it shall may reduce and af- and may be lawful for the faid Jofeph Roi, his heirs, executors, curators or affigns to diminish the faid Tolls or any of them, and afterwards, if they fhall fee fit agaia to at ginent the fame, or any of them, so as not to exceed in any cale the rates hereinbefore authorised to be taken. Provided alfo, that the faid Jofeph. Poi, his heirs, conspicuous place at ex. cutors, curators or affigns fhall affix or caufe to be affixed, in lome confpicuous place, at or near the Toll-Gate, a Table of the Rates payable for palling over the faid Bridge; and to often as fuch rates may be diminished or augmented, he or they fhall caufe fuch alteration to be affixed, in the manner aforefaid.

IV. And be it further enacted by the authority aforefaid, that the faid Tolls shall be, and the fame are hereby vefted in the faid Jofeph Roi, his heirs and affigns for ever. Provided, that if His Majefty, fhall in the manner herein-before y at the end of 50 mentioned, after the expiration of fifty years, from the paffing of this Act, affume the possession of the the poffeffion and property of the faid Bridge, Toll Houfe, Turnpike and con-the same shall be veniencies, and the afcents and approaches thereto, then the faid Tolls, fhall, from vested in His Majes the time of fuch aflumption, appertain and belong to His Majefty, his heirs and fucceflors, who shall from thence-forward, be fubitituted in the place and stead of the faid Jofeph Roi, his heirs and affigns, for all and every the purposes of this A&.

V. And be it further enacted by the authority aforesaid, that if any person shall said Tirup ke with forcibly pals through the faid Turnpike without paying the Toll or any part thereor whe shallobstruct of, or fhall interrupt or disturb the faid Jofeph Roi, his heirs, executors, curators or building the said affigns, orany perfon or perfons employed by him or by them, for building or repairing the faid Bridge, or for making or repairing the way over the fame, or any road or avenue leading thereto, every perfon fo offending in each of the cafes aforefaid, fhall for every fuch offence, forfeit a penalty not exceeding forty fhillings, currency.

III. Pourvu toujours, et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucune perfonne, cheval ou voiture employé à tranfporter une Malle ou des Lettres, fous l'autorité du Bureau de la Pofte de Sa Majesté, ni les Chevaux ou voitures chargées ou non chargées avec leurs conducteurs, qui accompagnent des Officiers ou Soldats des Troupes de Sa Majefté, far leur marche ou en fervice, ni les voitures et conducteurs ou gardiens qui accompagnent des Prifonniers de toute defcription, ne seront fujets à aucun Taux quelconque. Pourvû auffi, qu'il fera lofible au dit Jofeph Roi, les Héritiers, Exécuteurs, Curateurs ou Ayans caufe, de diminuer les Taux fufdits ou aucun d'iceux, et enfuite, s'ils le trouvent néceffaire, de les augmenter de manière à ne pas excéder en aucun cas, les Taux que cet Acte les autorife d'éxiger. Pourvû auffi, que le dit Jofeph Roi, fes Héritiers, Exécuteurs, Curateurs ou Ayans caufe, afficheront ou feront afficher, à quelqu' endroit visible à ou près la Barrière, une Table des Taux payables pour paffer fur le dit Pont, et auffi fouvent que les Taux feront diminués ou augmentés, ils feront afficher tel changement de la même manière.

IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que les dits péages feront comme ils font par le préfent accordés au dit Jofeph Roi, fes Hoirs et Ayans cause à toujours. Pourvû que fi Sa Majefté prend en la manière ci devant mentionée, après l'expiration de cinquante années, à compter de la paffation de cet Acte, la poffeffion et propriété du dit Pont, Maifon de Péage, Barrière et autres dépendances, et des montées et abords à ceux, alors les dits Péages du tems de telle prife de poffeffion appartiend ont à Sa Maj fté, les Héritiers et Succeffeurs qui feront dès lors fubititués au lieu et place da dit Jofeph Roi, fes Hoirs et Ayans cause, pour toute et chacune des fins de cet Ace. :

No Bridge, &c. to be built within one

VI. And be it further enacted by the authority aforesaid, that as soon as the faid league of the Bridge. Bridge fhall be paffable and opened for the ufe of the public, no perfon or perfons fball erect or caufe to be erected any Bridge or Bridges or works or ufe any ferry, for the carriage of any perfons, cattle or carriage what foever, for hire, acrols the faid River Jefus, within a league from the faid Bridge, above or below the faid Bridge; and if any perfon or perfons fhall ere& a Toll-Bridge or Toll. Bridges ver the faid River, within the said limits, he or they fhall pay, to the faid Jofeph Roi, his heirs, executors, curators and affigns treble the Tolls hereby impofed, for the perfons, cattle and carriages which shall pass over fuch Bridge or Bridges. And if any perfon or perfons fhall at any time for hire or gain, pafs or convey any person or perfons, cattle, carriage or carriages, across the faid River, within the limits aforefaid, fuch offender or offenders fhall, for each carriage, perfon, or animal, fo carried across, forfeit and pay a penalty not exceeding twenty fhillings, currency, Provided that nothing contained in this A&t fhall be conftrued in any manner or way to prevent the public from paffing the faid River by fording within the limits aforefaid.

VII. And be it further enacted by the authority aforefaid, that if any perfon fhall the Bridge or Toll- maliciou fly pull down, burn or deftroy the faid Bridge or the Toll-Houfe, to be erected by virtue of this Act, every perfon fo offending, and being thereof lawfully conviced, shall be deemed guilty of felony.

VIII. And be it further enacted by the authority aforefaid, tha the said Jofeph red to erect the Rei, to entitle himself to the benefits and advantages, to him by this Act granted, shall and he is hereby required, to erect and complete the faid Bridge, Toll-Houle, Turnpike and conveniencies, within five years from the day of the paffing of this Act, and if the fame fhall not be completed within the time laft mentioned, fo as to afford a convenient and safe passage over the faid Bridge, he the faid Jofeph Roi, his heirs, executors, curators and affigns, fhall cease to have any right, title or claim, of, in or to the Tolls hereby impofed, which shall from thence-forward belong to His Majefty; and the faid Jofeph Roi fhall not by the faid Tolis, or in any other manner or way be entitled to any reimbursement of the expences, he may have occurred in and about the building of the faid Bridge; and in cafe the said Bridge, after it fhall have been erected and completed, fhall at any time, become impaffable and unsafe for travellers, cattle or carriages, he the faid Jofeph Roi, his heirs, executors, curators or affigns, shall, and they are hereby required, within eighteen months, from the time at which the faid Bridge fhall by His Majefty's Court of General Quarter Seffions of the Peace, in and for the faid District of Montreal, be alcertained to be impaffable or unfafe, and notice thereof to him or them by the faid Court given, to caufe the fame to be rebuilt or repaired, and made fafe Penalty if not.com- and commodious for the paffage of travellers, cattle and carriages; and if within the time laft mentioned, the faid Bridge be not repaired, or rebuilt, as the cafe may require, then the faid Bridge or fuch part or parts thereof, as fhall be re

Pourvû que rien de contenu dans cet acte ne pourra être cenfe en aucune manière s'étendre à priver le Public de paffer la dite rivière à gué dans les limites fusdites.

VII. Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelque perfonne Pénalité contre les abat, arrache, brule ou détruit malicieusement le dit Pont, ou la Maison de Péage, qui fera érigée en vertu de cet Acte, toute perfonne ainfi contrevenante et en étant légalement convaincue, fera jugée convenable de Félonie,.

Maifon de péage, Barrière et autres dépendances dans cinq années du jour de la pallation de cet A&te, et s'il n'eft pas parachevé dans ce dernier tems mentionné de manière à procurer un paffage fûr et commode fur le dit Pont, le dit Jofeph Roi, les Héritiers, Exécuteurs, Curateurs et Ayans caufe cefferont d'avoir aucun droit, titre ou prétention fur les péages par le piéfent impofés, lefquels dès lors appar fiendront à Sa Majefté, et le dit Jofeph Roi L'aura point de droit par le moyen des dits péages au de quelqu'autre manière que ce loit, à aucun remboursement des frais qu'il pourra avoir encourus en bâtiffant le dit Pont, et dans le cas que le dit Pont après qu'il aura été érigé et parachevé, devienne en aucun tems impraticable ou. dangereux pour les Voyageurs, beftiaux ou voitures, le dit Jofeph Roi, fes Héritiers, Exécuteurs, Curateurs ou Ayans caufe, feront comme ils font par le prefent requis de faire, fous dix-huit mois du tems que le dit pont fera conftaté être impraticable ou dangereux, par la Cour des Seflions Genérales de Quartier de la : Paix de Sa Majefte dans et pour le District de Montréal, et qu'avis en aura été · donné à lui ou à eux par la dite Cour, de réparer, conftruire et bâ ir de nouveau le Pénalité s'il n'eser dit Pont, et le rendre fûr et commode pour le paffage des Voyageurs, beftiaux et voitures, et fi dans ce dernier tems le dit Pont n'eft pas réparé ou, rebâti, ainfi que

IX. And be it further enacted by the authority aforefaid, that the penalties hereby inflicted, fhall, upon proof of the offences refpectively before any one or more of the Juftices of Peace for the District of Montreal, either by confeffion of the of fender, or by the oath of one or more credible witnefs, or witneffes, (which oath fuch Juftice is hereby empowered and required to adminifter,) be levied by diftrefs and fale of the goods and chattels of fuch offender, by warrant figned by such Juftice or Juftices, and the overplus, after fuch penalties and the charges of luch diftrefs and sale are deducted, fhall be returned upon demand to the owner of fuch goods and chattels, one half of which penalties, refpectively, when paid or levied, hall belong to His Majefty, and the other half to the person fuing for the fame.

Not to affect the X. And be it further enacted by the authority aforefaid, that this A&t or any thing herein contained, fhall not extend or be conftrued to extend, to leffen, take away or affect the rights or privileges of the King's Majesty, his heirs or fucceffors, or any perfon or perfons, bodies politic or corporate in any of the things herein-before mentioned, (except as to the powers and authority, hereby given to the faid Jofeph Roi, his heirs and affigns, and except to the rights which are hereby altered or extinguished) but that His Majefty the King, his heirs and fucceffors, and all and every perfon or perfons, bodies politic or corporate, their heirs and affigns, executors and adminif trators, fhall have, and exercife the fame rights, (with the exceptions aforesaid) as they and each them had before the paffing of this Act, to every effect and purpose whatsoever, and in as full and ample a manner, as if this Act had never been paffed.
