ftructing or repairing the faid Bridge accordingly: the faid Thimothé Dufour, his heirs, executors, curators and affigns, and the perfons by him or them employed, doing as little damage as may be, and making reasonable and juft fatisfaction to the respective owners and occupiers of all fuch lands and grounds as fhall be altered, damaged, or made use of for the value of luch land as well as for that of the alteration or of the damages which they may cause to the proprietors by means of or for the purpose of erect. ing the faid Bridge and the faid Houle as above designated; and incafe of difference of opinion and dispute about the quantum of fuch fatisfaction, the fame shall be fettled by His Majefty's Court of King's Bench, of and for the diftri&t of Quebec, after a previous vifitation, examination, and estimation of the premises, fhall have been made by Experts, to be named by the parties refpectively; and in-default of fuch nomination by them, or either of them, then by the faid Court, in manner and form prescribed by Law, and the faid Court is hereby authorised and empowered to hear, fettle and finally determine the amount of luch compenfation in confequence. Provided always, that the faid Thimothé Dufour, his heirs or fucceffors, fhall not commence the erection of the laid Bridge and other works, by which any person may be deprived of his land or of part thereof, or may fuffer damage, before the price or value of the faid land and damages eftimated and settled in the manner before pref-. cribed,fhall have been paid to fuch person or after fuch price or value fhall have been offered to him, or that on his refufal, the faid Thimothé Dufour fhall have deposited it at the Office of the Court of King's Bench for the District of Quebec.

II. And be it further enacted by the authority aforefaid, that the faid Bridge Dufour, his heirs and and the faid Toll-Houfe, Turnpike and dependencies to be erected thereon, or Fation of 50 years near thereto, and also the ascents or approaches to the faid Bridge, and all mate assume the posses- rials which fhall be from time to time gotten or provided, for erecting, building, Bridging or making, maintaining and repairing the fame, fhall be vefted in the faid Thimothe Dufour, his heirs and affigns for ever. Provided, that after the expiration of fifty years, to be accounted from the paffing of this A&t, it fhall and may be lawful for His Majefty, his heirs and fucceffors, to affume the poffeffion and property of the faid Bridge, Toll-Houfe, Turnpike and dependencies, and the afcents and the approaches thereto,upon paying to the faid Thimothé Dufour, his heirs,executors, curators or affigns,the full and entire value which the fame may at the time of such affumption, bear and be worth, and when and fo foon as the faid Bridge shall be ad to Thimothe Du- erected and built, and made fit and proper for the paffage of Travellers, Cattle and Carriages, and that the fame fhall be certified by any two or more Juftices of the Peace, for the District of Quebec, after examination thereof, by three experts, to be appointed and fworn by the faid Juftices of the Peace,and be advertised in the Quebec Gazette, it fhall be lawful for the faid Thimothé Dufour, his heirs,executors,curators and affigns, from time to time, and at all times to ask, demand, receive, recover and

take toll, and for their own proper ufe and behoof, for portage, as or in the name of a Toll or duty, before any paffage over the faid Bridge fhall be permitted, the feveral fums following, that is to fay: for every Coach or other four-wheeled Carriage, loaded or unloaded, with the Driver and four Perfons, or lefs, drawn by two or more Horfes, or other Beafts of draught, one fhilling and three pence, currency; for every Chaife, Calafh, Chair with two wheels, or Cariole, or other fuch Carriage, loaded or unloaded, with the Driver and two Perfons or lefs, drawn by two Horfes or other Beafts of draught, fix pence, currency; and drawn by one Horfe or other Beaft of draught, five pence, currency; for every Cart, Sied or other fuch Carriage, loaded or unloaded,drawn by two Horfes, Oxen or other Beafts of draught, with the drivers, five pence, currency; and drawn by one Horfe or other Beast of draught, four pence, currency; for every Perfon on foot, one penny, currency; for every Horle, Mare, Mule, or other Beaft of draught, laden or unladen, two pence half-penny, currency; for every person on horfe-back, two pence halfpenny, currency; for every Bull, Ox, Cow and all other horned and neat Cattle, each one penny, currency; for every Hog, Goat, Sheep, Calf or Lamb, one half. penny, currency.

III. Provided always and be it further enacted by the authority aforesaid, that no Perfon, Horse or Carriage employed in conveying a Mail or Letters under the authority of His Majefty's Poft-Office, nor for the Horfes, or Carriages, laden or not laden, and Drivers attending Officers and Soldiers of His Majefty's Forces, or of the Militia, whilft upon their march or on duty, nor the faid Officers or Soldiers, or any of them, nor Carriages and Drivers or Guards fent with Prifoners of any defcription, fhall be chargeable with any Toll or rate what loever. Provided alfo, Thimothé Dufour that it fhall and may be lawful for the faid Thimothé Dufour, his heirs, executors, afterwards advance curators or affigns to diminifh the faid Tolls, or any of them, and afterwards if he or they fhall fee fit, again to augment the fame, or any of them, fo as not to exceed cafe the rates herein-before authorised to be taken. III. Pourvu toujours, et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucune perfonne, cheval ou voiture employé à transporter une Malle ou des Lettres, fous l'autorité du Bureau de Pofte de Sa Majefté, ni les chevaux ou voitures chargées ou non-chargées avec leurs conducteurs, qui accompagnent des Officiers et Soldats des Troupes de Sa Majefté, ou de la Milice, fur leur marche ou en fervice, ni lesdits Officiers ou soldats ou aucun d'eux, ni les voitures et conducteurs ou gardiens qui accompagnent des Prifonniers de toutes defcriptions, ne feront fujets à aucuns Taux quelconques. Pourvu auffi, qu'il fera loifible au dit Timothé Dufour, fes Hoirs, Exécuteurs, Curateurs ou Ayans Caufe, de diminuer les Taux fufdits ou aucun d'eux, et enfuite de les augmenter, s'ils le jugent à propos, de manière à ne pas excéder, en aucun cas, les Taux que cet Acte l'autorise d'exiger. Pourvu auffi, que le dit Timothé Dufour, fes Hoirs, Exécuteurs, Curateurs ou Ayans caufe, afficheront ou feront afficher, en quelqu'endroit vifible à ou près de la Barrière, une Table des Taux payables pour paffer fur le dit Pont, et auffi louvent que tels Taux feront diminués ou augmentés, ils ou elles feront afficher tel changement de la même manière,

IV. Et qu'il foit de plus flatué par l'autorité fufdite, que les dits péages feront, comme ils font par le préfent, accordés au dit Thimothé Dufour, fes Hoirs et Ayans caufe à toujours, Pourvu que fi Sa Majesté prend en la manière ci-devant mentionnée, après l'expiration de cinquante années, à compter de la paffation de cet acte, la poffeffion et propriété du dit Pont, Maifon de Péage, Barrière et autres dépendances et des montés et abords à iceux, alors les dits Péages, du tems de telle prise de poffeffion, appartiendront à Sa Majefté, fes Héritiers et fucceffeurs qui feront dès lors fubftitués au lieu et place du dit Timothé Dufour, fes hoirs et ayans cause pour toutes et chacune des fins de cet A&te.

VI. And be it further enacted by the authority aforefaid, that as foon as the said no other bridge to be Bridge fhall be paffable and opened for the ufe of the public, no perfon or perfons fhall erect, or caufe to be erected,any Bridge or Bridges, or works or use any Ferry for the Carriage of any Persons, Cattle or Carriages whatsoever, for hire, across the said River of Malbaie,within half a league above the faid Bridge and below the said Bridge, and if any person orperfons fhall erect a Toll-Bridge or Toll-Bridges over the faid River, within the faid limits, he or they shall pay to the faid Thimothé Dufour, his heirs, executors,curators and affigns, treble the Tolls hereby impofed, for the Perfons, Cattle and Carriages, which fhall pafs over fuch Bridge or Bridges; and if any Perfon or Perfons, fhall, at any time, for hire or gain, pafs or convey any Perfon or Perfons, Cattle, or Carriages across the faid River of Malbaie, within the faid limits aforesaid, fuch offender or offenders, fhall, for each Perfon, Carriage, or Animal fo carried acrofs, forfeit and pay a fum not exceeding forty fhillings, currency. Provided that nothing in this A&t contained, fhall be conftrued to prevent the public from paffing any of the Fords in the faid River within the limits aforefaid, or Canoes, without gain or hire,
