Preamble. allowed to take toll River Quelle, CA P. XXXIV. AN ACT to grant to Pierre Cafgrain, Efquire, a right of Toll over the W (22 March, 1817.) HEREAS the erection of a Draw-Bridge over the River Ouelle,in the County of Cornwallis, at the place where at prefent there exifts a Ferry, will materially improve the convenience and facility of the intercourse of the inhabitants of the neighbouring Parishes,and will not be an impediment to the navigation of the faid River, and whereas PierreCafgrain hath at his own proper coft and charges erected a Draw-Bridge over the faid River Ouelle, as reprefented by his petition in that behalf, praying for an adequate indemnity: May it therefore please Your Majefty that it may be enacted,. and be it enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower-Canada, conftituted and allembled by virtue of and under the authority of an A&t paffed in the Parliament of Great-Britain, intituled, "An Act to repeal certain parts of an "Act paffed in the fourteenth year of His Majesty's Reign, intituled, "An A&t "for making more effectual provifion for the Government of the Province of Quebec "in North America ;" and to make further provifion for the Government of the faid Province;" And it is hereby enacted by the authority of the fame, that it shall be Pierre Casgrain, lawful for the faid Pierre Cafgrain, his heirs, executors, curators and affigns, from over the Bridge of time to time, and at all times after the paffing of the present Act, to ask, demand, receive,recover and take toll,and for his or their own proper ufe and behoof, for por tage, as or in the name of a Toll or duty,before any paffage over the faid Bridge, fhall be permitted, the feveral fums following, that is to fay: for every Coach or other four-wheeled Carriage, loaded or unloaded, with the Driver and four Perfons, or lefs, drawn by two or more Horfes, or other Beafts of draught, one fhilling and eight pence, currency; for every Chariot, or other four-wheeled Carriage, loaded. or unloaded, one fhilling and three pence, currency; for every Chaife, Calafh, Chair with two wheels, or Cariole, or other fuch Carriage, loaded or unloaded, with the Driver and two Perfons or lefs, drawn by two Horfes or other Beafts of draught, one fhilling, currency; and drawn by one Horfe or other Beaft of draught, eight pence, currency; for every Cart, Sled or other fuch Carriage, loaded or unloaded, drawn by two Horfes or other Beafts of draught, fix pence, currency; and drawn by one Horfe or other Beast of draught. five pence, currency; for every Person on foot, one penny, currency; for every Horfe, Mare, Gelding, Mule, or other Beast. of draught,laden or unladen,two pence halfpenny,currency; for every Horfe and his Rider,two pence half-penny, currency; for every Bull, Ox, Cow and all other horned and neat Cattle, each two pence, currency; for every Hog, Goat, Sheep, Calf or Lamb, one penny, currency. CA P. XXXIV. Afte pour accorder à Pierre Cafgrain, Ecuier, un Droit de Péage fur le (22e. Mars, 1817.) TTENDU que l'érection d'un Pont Levis, fur la Rivière Ouelle, dans le A Comté de Cornwallis, à l'endroit où il y a maintenant une traverfe, augmenteroit de beaucoup l'aifance et la facilité de la Communication des Habitans des Paroiffes voisines, et ne fera pas une entrave à la Navigation de la dite Rivière, et vû que Pierre Cafgrain a fait bâtir à fes propres coûts et frais un Pont Levis fur la dite Rivière Ouëlle, ainfi qu'il a représenté par la Requête à cet effet, demandant une indemnité convenable: Qu'il foit ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un A&te paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle certaines "parties d'un Acte paffé dans la quatorzième année du Règne de Sa Majesté "intitulé, "A&te qui pourvoit plus efficacement pour le Gouvernement de la Province "de Québec dans l'Amérique Septentrionale;" Et qui pourvoit plus amplement pour "le Gouvernement de la dite Province;" Et il eft par le présent ftatué par la dite autorité, qu'il fera loisible au dit Pierre Cafgrain, fes Héritiers, Exécuteurs, Curateurs et Ayans cause, de tems à autre, et en tous les tems, après la passation du présent Acte de demander, exiger, recevoir et prendre à fon propre ufage et profit pour le Pontonage, fous le nom de péage ou de droit, avant de permettre le paffage fur le dit Pont, les différentes fommes fuivantes, c'est-à-dire, Pour chaque caroffe ou autre voiture à quatre roues, chargé ou non chargé, avec un cocher et quatre perfonnes ou moins, tiré par deux chevaux ou plus, ou autres bêtes de fomme, un chelin et huit déniers courant ; Pour chaque chariot ou autre voiture à quatre roues chargé et non chargé, un chelin et trois deniers courant: Pour chaque calêche, cabriolet à deux roues, ou cariole ou autre voiture femblable, chargé ou non chargé, avec le cocher et deux perfonnes ou moins, tiré par deux chevaux ou autres bêtes de fomme un chelin courant, et la même voiture tirée par un cheval ou autre bête de fomme huit deniers courant; Pour chaque charette traine ou autre voiture femblable, chargée ou non chargée tirée par deux chevaux ou autres bêtes de fommes, six deniers courant, et tirée par un cheval ou autre bête de fomme, cinq deniers courant. chaque perfonne à pied, un denier courant. Pour chaque cheval, jument, mule ou autre bête de fomme, chargé ou point chargé, deux deniers et demi courant. Pour chaque perfonne à cheval, deux deniers et demi courant. Pour chaque taureau, bœuf, vache ou autre bête à corne, de quelque efpece qu'elle foit, deux deniers courant. Pour chaque cochon, chèvre, mouton, veau, ou agneau, un denier courant, Pour 11. Provided always and be it further enacted by the authority aforefaid, that no Perfon, Horse or Carriage employed in conveying a Mail or Letters under the authority of His Majefty's Poft-Office, nor for the Horfes,or Carriages, laden or not laden, and Drivers attending Officers and Soldiers of His Majefty's Forces, or of the Militia, whilft upon their march or on duty, nor the faid Officers or Soldiers, or any of them, nor Carriages and Drivers or Guards fent with Prifoners of any defcription, fhall be chargeable with any Toll or rate whatfoever. Provided alfo, Pierre Casgrain that it fhall and may be lawful for the faid Pierre Cafgrain, his heirs, executors, curators or affigns to diminish the faid Tolls, or any of them, and afterwards if he or they fhall fee fit again to augment the fame, or any of them, fo as not to exceed in any cafe the rates herein-before authorised to be taken. Provided alfo, that the faid Pierre Cafgrain, his heirs, executors, curators, or affigns fhall affix or caufe to be affixed, in fome confpicuous place, at or near fuch Toll-Gate, a Table of the Rates payable for paffing over the faid Bridge; and fo often as fuch rates may be diminished or augmented he or they fhall caufe fuch alteration to be affixed, in manner aforefaid. may reduce and afterwards advance the tolls. Table of rates to be ixed ina conspicuous place at each Toll Gate. Tolls vested in Pierre Casgrain. at the end of 50 years session of the Bridge, in III And be it further enacted by the authority aforefaid, that the faid Tolls, shall be, and the fame are hereby vefted in the faid Pierre Cafgrain, his heirs and affigns, for the space of fifty years from the day of the paffing of this Act. Provided Unless his Majesty, always, that if His Majefty fhall, after the expiration of fifty years from the paffing of shall assume the pos- this A&t,affume the poffeffion and property of the faid Bridge, Toll-Houfe, Turnpike Ac. then the same and dependencies and the afcent, and approaches thereto, the faid Pierre Cafgrain, his heirs, executors, curators or affigns fhall be entitled to recover, have and receive of and from His Majefty, his heirs and fucceffors the full and entire value which the fame may at the time of fuch affumption bear and be worth, and the faid Tolls fhall from the time of fuch affumption appertain and belong to His Majefty, his heirs and fucceffors, who shall from thence-forward be fubftituted in the place and ftead of the faid Pierre Cafgrain, his heirs and affigns,for all and every the purposes of this Act shall be vested in his Majesty. Gate of the Draw for the passage of vessels. IV. And be it further enacted by the authority aforefaid, that the faid Pierre Cafbridge to be raised grain, his heirs, executors, curators, reprefentatives or affigns owing, holding or having charge of the faid Draw-Bridge, fhall at all times upon verbal notice or request to that intent, be bound forthwith to raise the gate of the faid Draw-Bridge, without any toll,fee,orrecompenfe whatfoever,in order to afford and give paffage to all and evePenalty for neglest. Jy veffel, craft or decked boat, having a mast or masts,navigating in and upon the said River Ouelle,under the penalty of one pound,currency,for each and every default, to be paid with cofts of fuit to fuch perfon or persons as may be aggrieved by reason of each and every fach default, without prejudice to the damages which the above named Pierre Cafgrain, his heirs, executors, curators, representatives or affigns fhall Exemption en cor cas. Pourvu toujours, et qu'il foit de plus ftatué par l'autorité fafdite, qu'aucune tains cal perfonne, cheval ou voiture employé à tranfporter une Malle ou des Lettres, fous l'autorité du Bureau de la Pofte de Sa Majefté, ni les chevaux ou voitures chargés ou nonchargés avec leurs conducteurs, qui accompagnent des Officiers ou Soldats des Troupes de Sa Majefté, ou de la Milice, fur leur marche ou en fervice, ni lesdits Officiers ou soldats ou aucun d'eux, ni les voitures et conducteurs ou gardiens qui accompagnent des Prifonniers de toutes defcriptions, ne feront fujets à aucuns Taux quelconques. Pourvu auffi, qu'il fera loifible au dit Pierre Cafgrain, fes Hoirs, Exécuteurs, Curateurs ou Ayans Caufe, de diminuer les Taux fufdits ou aucun d'iceux, et enfuite, s'il le trouve nécessaire, de les augmenter de manière à ne pas excéder, en aucun cas, les Taux que cet Acte les autorise d'exiger. Pourvu auffi, que dans un androit émile dit Pierre Cafgrain, fes Hoirs, Exécuteurs, Curateurs ou Ayans caufe, afficheront nent à chaque Barou feront afficher, à quelqu'endroit vifible à ou près de la Barrière, une Table des Tau x payables pour paffer fur le dit Pont, et auffi louvent que tels Taux feront dimi nués ou augmentés, ils ou elles feront afficher tel changement de la même manière. et ensuite augmenter les taux. Une Table des taux sera affichée rière. III. Et qu'il foit de plus ftatué par l'autorité fufdite, que les dits péages feront, comme ils font par le préfent, accordés au dit Pierre Cafgrain, fes Hoirs et Ayans cause pour l'espace de cinquante années, du jour de la paffation de cet Acte. Pourvu toujours, que fi après l'expiration de Cinquante années, à compter de la paffation de cet Acte, Sa Majefté prend poffeffion et propriété du dit Pont, Maifon de Péage, Barrière et autres dépendances et des montés et bords à iceux, le dit Pierre Cafgrain, fes Héritiers, Exécuteurs, Curateurs ou ayans cause auront droit d'avoir et recevoir de Sa Majefté, fes Héritiers et Succeffeurs la pleine et entière valeur qu'ils pourront avoir au tems de telle prife de poffeffion, et les dits Péages, du tems de telle prise, de poffeffion, appartiendront à Sa Majestê, fes Héitiers et fucceffeurs qui feront dès lors fubstitués au lieu et place du dit Pierre Casgrain, fes hoirs et ayans cause pour toutes et chacune des fins de cet Acte. La Porte du Pont lévis sera levée pour tous vaisseaux IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que le dit Pierre Cafgrain, fes Héritiers, Exécuteurs, Curateurs, Repréfentans ou ayans caufe, poffedant, donner passage à tenant ou ayant charge du dit Pont Lévis, feront tenus en tout tems, fur notice verbale ou demande à cet effet, de lever fans délai la porte du dit Pont Lévis fans aucun droit, honoraire ou Récompenfe quelconque, afin d'accorder et donner paffage à tous et chaque Vaiffeau, Barque ou Chaloupe pontée, portant un mât ou des mâts, qui naviguera fur la dite Rivière Ouelle, fous une pénalité d'une Livre courant Pénalité pour refus. pour tous et chaque défaut, laquelle fera payée avec les frais de pouriuite, à telle. perfonne ou perfonnes qui auront fouffert à raison de tous et chaque tel défaut, sans préjudice aux dommages que le dit Pierre Casgrain, fes Héritiers, Exécuteurs, Curateurs, Pierre Casgrain required to repair the Bridge. fhall have caused by fuch neglect or delay in raising the gate of the faid Draw-Bridge, and of which he or they fhall be refponfible to those who may have luffered or fuftained fuch damages. V. And be it further enacted by the authority aforefaid, that in cafe the faid Bridge fhall, at any time, become impaffable or unfafe for Travellers, Cattle or Carriages, he the faid Pierre Cafgrain, his heirs, executors, curators, or affigns, fhall, and they are hereby required, within eighteen months from the time at which the faid Bridge fhali, by His Majefty's Court of General Quarter Seffions of the Peace, in and for the faid District of Quebec, be afcertained to be impaffable or unfafe, and notice thereof, to him or them, by the faid Court given, to cause the fame to be rebuilt or repaired, and made fafe and commodious for the paffage of Penalty if not re- Travellers, Cattle and Carriages, and if within the time laft mentioned, the faid Bridge be not fo repaired or rebuilt, as the cafe may require, then the faid Bridge or fuch part or parts thereof, as fhall be remaining, fhall be, and be taken and confidered to be the property of His Majefty; and after fuch default to repair or rebuild the said Bridge, the faid Pierre Cafgrain, his heirs, executors, curators or affigns, fhall ceafe to have any right, title or claim of, in, to or out of the faid Bridge or the remaining parts thereof, and the Tolls hereby granted, and his and their right in the premises, fhall be wholly and for ever determined. built. Penalty on persons Bridge obstruct said Pierre VI. And be it further enacted by the authority aforefaid, that if any person, forcibly passing the fhall forcibly pals over the faid Bridge, without paying the Toll or any part paying Tolls or who thereof; or fhall interrupt or disturb the faid Pierre Cafgrain, his heirs, executors, in building the Brid- Curators or affigns, or any perfon or perfons employed by him, or them, for build ing or repairing the faid Bridge, or for making or repairing the way over the fame, or any road or avenue leading thereto, every perfon to offending, in each of the cafes aforefaid, fhall for every such offence, forfeit a fum not exceeding forty fhillings, currency. ge, &c. No Bridge, &c. to half a league above below the said Brid -said River. VII. And be it further enacted by the authority aforefaid, that no perfon or perbe erected within fons shall erect, or caufe to be erected, any Bridge or Bridges, or works or works, or the said Bridge ufe any Ferry for the Carriage of any Perlons, Cattle or Carriages whatsoever, for ge to the mouth of hire, acrofs the faid River Quelle, and within half a league diftant from and above the faid Bridge, and below the faid Bridge to the mouth of the River; and if any person or perfons fhall erect a Toll-Bridge or Toll-Bridges over the faid River, within the faid limits, he or they fhall pay to the faid Pierre Cafgrain, his heirs, executors, curators and affigns, treble the Tolls hereby impofed, for the Perfons, Cattle or Carriages, which fhall pafs over fuch Bridge or Bridges; if any Perfon or Perfons, fhall, at any time, for hire or gain, pals or convey any Perfon or Perfons, Cattle, Penalty. |
