III. repealed. tices of the Peace (one of whom shall be of the Quorum) to meet, and cause the offender to be convened before them, at some public and convenient place, and then and there, or at fuch other time and place to which they might adjourn, to hear the charge and defence with the evidence for and against the prifoner, and to determine the fame; and upon their conviction of the guilt of the prisoner to give judgment against him for fuch corporal punishment, (not extending to life or limb) as they or the major part of them should, in their difcretion, think adequate to the demerit of his offence; and that after the execution thereof the offender fhould be difcharged. But if he fhall not have been a ftated refideat of this Province for twelve months preceding his commitment and fhould, in twenty days after his difcharge be found within the fame Diftrict, and fhould wilfully have remained in the fame, it should be lawful for any one Juftice to commit him to prison, and for three Juftices to proc ed against him in manner aforefaid and to adjudge him to fuch further correction (not extending to fe or limb) as they in their difcretion fhould think proper, unless he should find good and fufficient fecurities in the opinion of the Judices, by whom he fhall have been tried, to recognize in fuch fum as they fhall appoint, for his good behaviour for feven years, on giving which he shall be fet at liberty and the recognizance be filed with the Clerk of the Peace. And whereas it is expedient to repeal the above recited Claufe of the afore-faid A&t or Ordinance herein-before-mentioned, fave and except fo much of the fame as declares and enacts that fimple Larceny when the goods ftolen fhall not in value exceed twenty fhillings, fterling money of Great-Britain, fhall be deemed and adjudged Petty Larceny. MOST GRACIOUS SOVEREIGN, WE HEREAS pursuant to Addresses from the Houfe of Affembly, during the prefent feffion of the Provincial Parliament, His Excellency the Governor-inChief has been pleafed to advance, by two feveral warrants directed to the ReceiverGeneral of the Province, the fum of Four thousand and eighty-two pounds, twelve Chillings, and nine-pence one halfpenny, currency, for and on account of the contingent expences of the Houfe of Affembly, one of the faid warrants bearing date the twenty-eighth day of January laft, for the fum of Three thoufand three hundred and feven pounds, four fhillings and ten-pence one halfpenny, current money of this Province; the other warrant bearing date the tenth of February laft, for the sum of seven hundred and feventy-five pounds, fever fhillings and eleven-pence, current money aforefaid: And whereas the funds provided by an A&t paffed in the thirty-third of your Majesty's Reign, intituled, "An Act to eftablish a fund for paying the falaries of "the officers of the Legislative Council and Affembly, and for defraying the contingent expences thereof," have been found infufficient for the purposes of the faid A&, whereby it is expedient to make good the monies fo as aforefaid advanced, pursuant to Addreffes from the House of Affembly; may it therefore please your Majesty, that it may be enacted, and be it enacted by the King's most excellent Majefty, by and with the advice and content of the Legiflative Council and Affembly of the Province of Lower Canada, constituted and affembled by virtue of, and under the authority of an Act paffed in the Parliament of Great Britain, entituled, " An Act to repeal certain "parts of an Act paffed in the fourteenth year of His Majefty's Reign, intituled, " An "Act for making more effectual provifion for the government of the Province of Quebec "in North America," and to make further provision for the government of the faid £4058: 12: 9" Province: "And it is hereby enacted by the authority of the fame, that the said contingent fum of four thousand and eighty-two pounds, twelve shillings and nine-pence one House of Assembly halfpenny, current money of this Province, so as aforesaid advanced on account of the granted for paying Application of the money to be account cn'ingent expences as forefaid, fhall be,and they are hereby directed to be charged against the unappropriated monies in the hands of the Receiver-General of the Province, that may have been raised, levied, and collected under and by virtue of an A& or Acts of the Legiflature of this Province, II. HEREAS an Act was paffed in the forty-third year of His Majesty's Reign, intituled, "An Act for the better regulation of the Militia of "this Province, and for repealing certain A&ts or Ordinances therein-mentioned," which faid Act expired on the first day of May, one thoufand eight hundred and fixteen; And whereas it is expedient that the aforesaid A&t, passed in the forty-third year of His Majefty's reign, be revived and continued in force for a limited time, be it therefore enacted by the King's moft excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an A&t paffed in the Parliament of Great Britain, intitu led," An Act to repeal certain parts of an Act paffed in the fourteenth year of His Cap. 1 revived and Majefty's Reign, intituled, " An A&t for making more effectual provifion for the government of the Province of Quebec in North America ;" and to make further pro "vifion for the government of the faid Province:" And it is hereby enacted by the authority of the fame, that the said Act herein before recited, paffed in the fortythird of His Majefty's Reign, and all the claufes, provifions, powers, authorities, directions, and regulations therein contained, shall be and remain in full force and authority, until the first day of May, one thoufand eight hundred and nineteen, and no longer, in as full and ample a manner, to all intents and purposes, as if the fame were repeated and re-enacted in the body of this A&t; Provided al. or reviews way's, that nothing herein-contained, fhall be conftrued to extend to oblige the Mili general orders from tiamen to any exercife or reviews ordered by the aforefaid Act, without a pe cial or general order for fuch exercife or review, from the Governor, LieutenantGovernor, or perfon adminiftering the Government of this Province for the time being, any thing in the faid Act contained to the contrary in any wife notwithstanding.
