And whereas the pernicious vice of Gaming has become extremely prevalent in keepers keeping or Public Houfes in this Province,to the evil example of the rifing generation and the ruin of Individuals. Be it therefore further enacted by the authority aforefaid, that from ́and after the paffing of this Act, if any perfon licensed to fell Spirituous Liquors by retail or to keep a Houfe of Public entertainment within this Province, fhall knowingly fuffer any gaming in any houfe, out house, apartment or ground belonging to or in his or her occupation for money, liquor or otherwise either with Cards, Dice, Draughts Shuffle board, Skittles, Nine Pins or with any other implement or in any other manner of gaming, by any Journeyman, Apprentice, Labourer or Servant, and fhall be convicted thereof on the confeffion, or by the Oath of one credible Witness, before one Juftice of the Peace, if in the Villages or Country Parishes within fifteen days after the offence committed, or before the Juftices of the Peace in their Court of weekly fittings, if in the Cities of Quebec, or Montreal or Town of Three-Rivers, fuch perfon or perfons fo offending, fhall forfeit and pay for the first offence the fum of forty fhillings current money of this Province, and for the fecond offence the fum of five pounds current money of this Province, and be deprived of his, her or their Licence; and alfo, of being incapable of obtaining a licence to retail Spirituous Liquors or to keep a Houle of Public Entertainment for the fpace of one year; and if any Journeyman, Labourer, Servant or Apprentice, fhall game in any of the places or in the manner aforefaid, and shall be convicted thereof, before any Juftice of the Peace in the Villages or Country Parishes, or by any Juftice of the Peace in the Villages or Country Parishes, or before the Juftices of the Peace in their Court of weekly fittings in the

Who shall be deemed

XI. And be it further enacted by the authority aforefaid, that in all actions, proa competent witness. fecutions, caufes and proceedings relating to or concerning the execution of this prefent Act, or of any order or regulation to be made in virtue of the fame, any inhabitant refiding within any City, Town, place or District in this A&t mentioned or described, fhall be a competent witnefs and be admitted to give evidence upor any action or profecution as aforefaid, notwithstanding fuch inhabitant is charged with or liable to pay any rate or perform any duty or fervice by virtue of or under the authority of this A&t.

And be it further enacted by the authority aforefaid, that upon all and every judgment to be made by any Juftices of the Peace at their weekly or fpecial feffions, it shall and may be lawful to appeal therefrom to the Juftices of the Court of Quarter Seffions of the Peace of the District where fuch judgment may be made, upon which appeal the full merits of the original complaint may be heard, and adjudged; provided always, that the appellant before the allowance of any appeal the allowance of the as aforefaid, fhall give good and fufficient fecurity to pay the amount of the judgment appealed from, and cofts as well on the original complaint, as in the appeal.

for and recovered with the reasonable cofts of fuch profecution before any two of His Majesty's Juftices of the Peace of the Diftri& wherein the offence hall have been committed, in the weekly fittings of fuch Juftices of the Peace as directed by Law to be held in the Cities of Quebec and Montreal and Town of ThreeRivers, or in fpecial fittings thereof, which may be called for the purpose where the matter may require a more prompt decifion; and the aforefaid Juftices of the Peace are hereby authorized and empowered to hear and determine all caufes and complaints touching and refpecting the regulations of Police, or against any of the rules, orders or regulations concerning Apprentices, Domefticks, hired Servants or Journeymen, or their Mafters or Miftreffes to be made as aforefaid, in a fummary manner, on proof of the offence either by voluntary confeffion of the party or parties accused, or by the oath of one or more credible witnefs or witneffes other than the informer; which oath all and every of the faid Juftices of the Peace are hereby. empowered to adminifter; and one moiety of every such penalty, fhall belong to the informer, and the other moiety be paid to the Road-Treasurer, to be applied to the purposes of this A; and in all cafes of non-payment of any judgment to be awarded by any of the Juftices as aforefaid, the fum fhall be levied by diftrefs and fale of the offender's goods and chattles by warrant under the hands and feals of the Juftices of the Peace before whom the offence fhall have been profecuted, directed to a Conftable or Peace Officer, and the overplus of the money raised, after dedu&ing the penalty and cofts, fhall be returned to fuch offender.

XIV. And whereas it expedient and proper to provide for the payment of costs on fummary proceedings before His Majefty's Juftices of the Peace out of Seffion or at any Weekly Seffion or upon Appeals to the General Quarter Seffion thereupon by virtue of this A&t; Be it further enacted by the authority aforefaid, that it fall and may be lawful to and for the Juftices of the Peace for the faid Districts of Quebec, Montreal and Three-Rivers refpe&tively, before whom any fuch cafe may have been heard and determined, to award the cofts which either of the parties fhall have to pay the other as they fhall judge fit; and in cafe any perfón against whom fuch cofts fhall be awarded, by any fuch Juftice or Juftices of the Peace or by fuch Court of Quarter Seffion, fhall not pay fuch costs, within seven days next after the fame fhall have been fo awarded as aforefaid, it shall and may be lawful to and for any such Juftice or Juftices of the Peace whether in or out of Seffion, to iffue fuch execution for the fame as is herein-before directed, with regard to fuch pecuniary fines, penalties or forfeitures as may be inflicted by virtue of this Act.
