Tolle vested in jesty, at the end assume the poses beafts of draught, one fhilling, currency; for every waggon or other four-wheeled carriage, loaded, or uploaded, fix-pence, currency; for every chaise, calash, chair with two wheels, or cariole, or other fuch carriage, loaded or unloaded, with the driver and two perfons or lefs, drawn by two horfes or other beafts of draught, four pence, currency; and drawn by one horse, or other beaft of draught, three-pence currency; for every cart, fled, or other fuch carriage, loaded or unloaded, drawn by two horses, oxen, or other beafts of draught, with the driver, three-pence, currency; and if drawn by one horse or other beaft of draught with the driver, two-pence, currency; for every perfon on foot, one half-penny, currency; for every horse, mare, mule, or other beaft of draught, laden or unladen, one penny, currency; for every perfon on horfeback, one penny and half-penny, currency; for every bull, ox, cow, and all other horned and neat cattle, each one half-penny, currency; for ever hog, goat, fheep, calf or lamb, one half-penny, currency. V. Provided always, and be it further enacted by the authority aforesaid, that no person, horse or carriage employed in conveying a mail or letters under the authority of His Majefty's Poft-Office, nor for the horfes, or carriages, laden, or un laden, and drivers attending officers and foldiers of His Majefty's Forces, or of the Militia, whilft upon their march, or on duty, nor the faid officers or foldiers or any of them, nor carriages and drivers, or guards fent with prifoners of any defcription, shall be chargeable with any toll or rate whatfoever. Provided alfo, that it shall and may be lawful for the faid Jean Lagorce, his heirs, executors, curators or affigns, to diminish the said tolls, or any of them, and afterwards if he or they shall see fit, again to augment the fame, or any of them, fo as not to exceed in any cafe the rates herein-before authorised to be taken. Provided alfo, that the faid Jean Lagorce, his heirs, executors, curators, or affigns fhall affix, or caufe to be affixed, in fome confpicuous place, at or near fuch Toll-Gate, a Table of the Rates payable for paffing over the faid toll-bridge; and fo often as fuch rates may be diminished or augmented, he or they fhall caufe fuch alteration to be affixed, in manner a forefaid. VI. And be it further enacted by the authority aforefaid, that the faid tolls, Jean Lagerce. fhall be, and the fame are hereby vefted in the faid Jean Lagorce, his heirs and Unless His Ma- affigns for ever. Pourvû toujours, et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucune Exemption on perfonne, cheval ou voiture employé à tranfporter une Malle ou des Lettres, fous l'autorité du Bureau des Poftes de Sa Majefté, ni les chevaux ou voitures chargés ou non charges, avec leurs conducteurs, qui accompagnent des Officiers et Soldats des Troupes de Sa Majefté, ou de la Milice, fur lear marche ou en service, ni les dits Officiers ou Soldats ou aucun d'eux, ni les voitures et conducteurs ou gardiens qui accompagnent des Prifonniers de toute description, ne feront fujets à aucun Taux quelconque. Pourvu auffi, qu'il fera loifible au dit Jean Lagorce, les Hoirs, Exécuteurs, Curateurs et ayans caufe, de diminuer les Taux fufdits, ou aucun d'eux, et enfuite de les augmenter, s'ils le jugent à propos, de manière à ne pas excéder, en aucun cas, les Taux que cet A&te autorife d'exiger. Pourva auffi, que le dit Jean Lagorce, fes Hoirs, Exécutears, Curateurs ou ayans cause, afficheront ou feront afficher, en quelqu'endroit visible à ou près de la Barrière, une Table des Taux payables pour paffer fur le dit Pont, et auffi fouvent que tels Taux feront diminués ou augmentés, ils ou elles feront afficher tel changement de la même manière. VI. Et qu'il foit de plus ftatué par l'autorité fufdite, que les dits péages feront comme ils fout par le préfent, accordés au dit Jean Lagorce, fes hoirs et ayans caufe à toujours; Pourvu que fi Sa Majefté prend, en la manière ci-devant mentionnée, après l'expiration de cinquante années, à compter de la paffation de cet A&te, la posfeffion et propriété du dit Pont, Maison de Péage, Barrière et autres dépendances, et des montées et abords à iceux, alors les dits Péages, du tems de telle prife de poffestion, appartiendront à Sa Majefté, fes Héritiers et Succeffeurs qui feront dès lors fubftitués au lieu et place du dit Jean Lagorce, fes hoirs et ayans cause pour toutes et chacune des fins de cet A&te. pourra diminuer et ensuite aug Une table des dans un endroit Barrière. 1 Penalty on per soas forcibly pas without paying obstruct the said VII. Provided that nothing in this A&t contained, fhall be conftrued to prevent the public from paffing the faid Rivers of Sud-Ouest and Calix, at any fords within the limits aforefaid, or in canoes, without gain or hire. IX. And be it further enacted by the authority aforefaid, that if any perfon fhail maliciously pull down, burn or destroy the faid bridge, or any part thereof, or the toll houfe to be erected by virtue of this A&t, every perfon fo offending, and being thereof legally convicted, fhall be deemed guilty of felony. X. And be it further enacted by the authority aforefaid, that the said Jean Lagorrequired to erect ce, to entitle himself to the benefits and advantages to him, by this A&t granted, fhall and he is hereby required to erect and complete the faid bridge, to house, turn. pike and dependencies within one year from the firft day of October next; and if the fame fhall not be completed within the time laft mentioned, fo as to afford a convenient and fafe paffage over the faid bridge, he the laid Jean Lagorce, his heirs, executors, curators, and affigns, fhall ceafe to have any right, title or claim of, in, or to the tolls hereby impofed, which from thence-forward belong to His Majefty; and Pénalité contre passerout force Barrière sans les personnes qui VII. Il ne sera érigé aucun Pont, &c. à la distauce d'une demi-lieue, dit Pout sera pa VIII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'auffitôt que le dit Pont fera paffable et ouvert pour l'ufage du public, dès lors aucune perfonne quelconque ne pourra ériger ou faire ériger aucun Pont ou Ponts, pratiquer ou faire pratiquer aussitôt que le aucune voie de paffage pour le tranfport d'aucunes perfonnes, beftiaux ou voitures rachevé. quelconques, pour gages à travers les dites Rivières du Sud-Oueft et Calix, à une demie lieue au deffus du dit Pont, ni du côté de la Rivière Yamaska, et fi quelque perfonne ou perfonnes conftruifent un Pont ou des Ponts de péage fur les dites Rivières du Sud-Oueft et Calix, dans les dites limites, cile payera ou elles payeront au dit Jean Lagorce, fes héritiers, exécuteurs, curateurs ou ayans caufe, trois fois la valeur des péages impofés par le présent A&te, pour les perfonnes, beftiaux et voitures qui pafferont fur tel Pont ou Ponts, et fi quelque perfonne ou perfonnes paffent en aucun tems que ce foit, ou transportent pour gages ou gain aucune perfonne ou personnes, bestiaux, voiture ou voitures à travers les dites Rivières du SudOuest et Calix, dans les limites fufdites, tel contrevenant ou contrevenans encourront et payeront pour chaque perfonne, voiture ou animal ainfi traverfé, une fomme n'excédant pas quarante chelins courant. Pourvu, que rien contenu dans cet Acte Pénalité. ne fera cenfé s'étendre à priver le Public de paffer les dites Rivières du Sud-Ouest et Calix dans les limites fufdites à gué ou en Canot, fans lucre ou gages. Pénalité contre les personnes qui le dit 'Pont ou Maison abateront IX. Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelque perfonne abat, arrache, brule ou détruit malicieufement le dit Pont ou quelque partie d'ice lui, ou la Maison de Péage qui fera érigée en vertu de cet Acte, toute personne ainfi page. contrevenante, et en étant légalement convaincue, fera jugée coupable de Félonie. Jean Lagorce par le présent re d'ériger le d'un an. Pont dans l'es X. Et qu'il foit de plus ftatué par l'autorité fufdite, que le dit Jean Lagorce, pour fe donner le droit aux profits et avantages à lui accordés par cet Acte, érigera et quis complêtera, et il eft par le présent requis d'ériger et complêter le dit Pont, Maifon pace de péage, Barrière et autres dépendances, dans un an, à compter du premier Octobre prochain, et s'il n'eft point parachevé dans ce dernier tems mentionné, de manière à procurer un paffage fûr et commode fur le dit Pont, le dit Jean Lagorce, fes Exécuteurs, Héritiers, Curateurs et ayans cause cefferont d'avoir aucun droit ou prétention fur D d and the laid Jean Lagorce, fhall not, by the faid tolls, or in any other manner or way, be entitled to any reimbursement of the expences he may have incurred in and about the building of the faid bridge; and in cafe the faid bridge, after it fhall have been erected and compleated, fhall, at any time, become impaffable or unsafe for travellers, cattle or carriages, he the faid Jean Lagorce, his heirs, executors, curators, and affigns, fhall, and they are hereby required, within one year from the time at which the laid bridge fhall, by His Majesty's Court of Quarter Seffions of the Peace, in and for the faid District of Montreal, be ascertained to be impassable or unfafe, and notice thereof to him or them by the faid Court given, to caufe the fame to be rebuilt or repaired, and made lafe and commodions for the paffage Penalty if not of travellers, cattle and carriages; and if within the time laft mentioned, the laid bridge be not fo repaired or rebuilt, as the cafe may require, then the faid bridge, or fuch part or parts thereof, as fhall be remaining, fhall be, and be taken and confidered to be the property of His Majefty; and afte: such default to repair or rebuild the faid bridge, the faid Jean Lagorce, his heirs, executors, curators and: affigns, fhall ceafe to have any right, title or claim of, in, to, or out of the faid bridge, or the remaining parts thereof, and the tolls hereby granted, and his and their rights in the premifes, fhall be wholly and for ever determined. compleated. And be it further enacted by the authority aforesaid, that the present A&; or any of the difpofitions therein contained, shall not extend, or be construed to ex. tend, to weaken, diminish, or extinguish the rights and privileges of His Majefty the King, his heirs and fucceffors, nor of any perfon or perfons, body politic or corporate, in any of the things therein-mentioned, (except as to the power aud authority hereby given to the faid Jean Lagorce, his heirs and affigns, and except as to the rights which are hereby exprefsly altered or extinguished,) but that His Majefty the King, his heirs and fucceffors, and all and every perfon or persons, body politic or corporate, their heirs and affigns, executors and adminiftrators, fhall have and exercife the fame rights as they and each of them had before the paffing of this A&, (with the exceptions afo efaid) to every effect and purpose whatsoever, and in as ample manner as if this Act had never been paffed. XII. And be it further enacted by the authority aforesaid, that the penalties here by inflicted, fhall, upon proof of the offences refpectively, before any one or more of the Jeftices of the Peace for the Diftri&t of Montreal, either by confeffion of the offender, or by the oath of one or more credible witnels, or witneffes, (which Oath fuch Juft.ce or Juftices is hereby empowered and required to adminifter,) be levied by diftrels and fale of the goods and chattels of fuch offender, by warrant |
