Rivers Sud Ouest and Calix.

CA P. XXVI.

An A&t to authorize Jean Lagorce to erect a Toll-Bridge over the Rivers Sud-Oueft and Calix, in the Parish of Saint Hyacinthe, in the County of Richelieu.

(24th April, 1819.)

WHEREAS the erection of a Toll-Bridge over the Rivers Sud-Oueft and Ca

lix, near their confluence (and which empty into the River Yamaska) at the place where the King's Highway now paffes over the faid rivers Sud-Oueft and Calix, in the Parish of St. Hyacinthe, in the County of Richelieu, would materially contribute to the convenience of the Inhabitants of the adjacent parishes: And whereas Jean Lagorce hath, by his petition in this behalf, prayed leave for to build a Bridge over the Toll-Bridge over the faid rivers Sud-Ouest and Calix, at the aforefaid place; Therefore, may it please Your Majefty, that it may be enacted, and be it enacted by the King's Moft Excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A& passed in the Parliament of GreatBritain, intituled, " An Act to repeal certain parts of an A&t paffed in the fourteenth "year of His Majefty's reign, intituled, " An Act for making more effectual provi fion for the Government of the Province of Quebec, in North-America," and to make "further provifion for the government of the faid Province;" and it is hereby enacted by the authority of the fame, that it fhall be lawful for the faid Jean Lagorce, and he is hereby authorized and empowered, at his own cofts and charges, to erect and build a good and fubftantial Bridge over the faid Rivers du Sud-Oueft and Calix, and to erect and build one Toll-Houfe and Turnpike, with other dependercies, on or near the said Bridge; and also to do, perform, and execute all other matters and things requifite and neceffary, ufeful or convenient for erecting and building, maintaining and fupporting the faid intended bridge, toll-houfe, and turnpike, withother dependencies, according to the tenor and true meaning of this A&t.

II. A&te qui autorife Jean Lagorce à bâtir un Pont de péage, fur les Rivières du Sud-Ouest et Calix dans la Paroiffe Saint Hyacinthe, Comté Richelieu. (24me. Avril, 1819.)

TTENDU que l'érection d'un Pont de péage fur les Rivières du Sud-Oneft et Calix, près de la jonction d'icelles (qui fe déchargent dans la Rivière Yamaska) à l'endroit où paffe le chemin du Roi, actuellement fur les dites Rivières SudOueft ou Calix, en la Paroiffe de Saint Hyacinthe, Comté de Richelieu, augmenteroit de beaucoup l'aifance et la facilité des communications des habitans des Paroiffes circonvoi fines; Et attendu que Jean Lagorce a par fa pétition à cet effet demandé permiffion de bâtir un pont de péage fur les dites Rivières du Sud-Ouest et Calix, à l'endroit fufdit; Qu'il plaife donc à Votre Majefté qu'il puiffe être statué, et qu'il foit ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un A&te paffé dans le parlement de la Grande-Bretagne, intitulé, "A&te qui rappelle certaines parties d'un Ace ❝ paffé dans la quatorzième année du Règne de Sa Majefté, intitulé, "Ate qui "pourvoit plus efficacement pour le Gouvernement de la Province de Québec, dans t▲"mérique Septentrionale," Et qui pourvoit plus amplement pour le Gouvernement "de la dite Province;" Et il eft par le préfent ftatué par la dite autorité, qu'il fera loifible au dit Jean Lagorce, et il eft par le préfent autorifé et a pouvoir d'ériger et bâtir, à fes propres frais et dépens, un Pont folide et fuffifant fur les dites Rivières du Sud-Oueft et Calix, et d'ériger et conftruire une Maison de Péage et une Barrière avec d'autres dépendances fur, ou près du dit Pont, et auffi de faire et exécuter toutes autres matières et choses requises et néceffaires, utiles ou commodes pour ériger et conftruire, entretenir et foutenir le dit Pont projetté, Maifon de Péage, Barrière et autres dépendances, fuivant la teneur et le vrai fens de cet A&c.

When the bridge

the alteration or of the damages which they may cause to the proprietors by means of or for the purpose of erecting the faid bridge, and the faid houfe as above de fignated; and in cafe of diffe ence of opinion and di'pute about the quantum of fuch fausfaction, the fame fhall be fettled by His Maj fty's Court of King's Bench, for the Diftri& of Montreal, after a previous vifitation, examination and ef timation of the premises, shall have been made by experts to be named by the parties refpectively; and in default of fuch nomination by them, or either of them, then by the faid Court, in manner and form prefcribed by law, and the faid Court is hereby authorized and empowered to hear, fettle, and finally determine the amount of fuch compenfation in confequence.-Provided always, that the faid Jean Lagorce, his heirs, executors, curators and figns, fhall not commence the erection of the faid bridge and other works, by which any perfon may be deprived of his land or part thereof, or may fuffer damage, before the price or value of the faid land and damages, eftimated and fettled in the manner before prescribed, shall have been paid to such person, or after such price or value shall have been offered to him, or that on his refufal, the faid Jean Lagorce shall have depofited it at the office of the Prothonotary of the Court of King's Bench for the District of Montreal.

III. And be it further enacted by the authority aforefaid, that the faid bridge and the faid toll-house, turnpike and dependencies to be erected thereon, or near thereto, and alfo the afcents or approaches to the faid Bridge, and all materials which fhall be from time to time found or provided, for erecting, building, or maintaining and repair. ing the fame, fhall be vefted in the faid Jean Lagorce, his heirs and affigns for ever. Provided, that after the expiration of fifty years from the paffing of this Act, it fhail and may be lawful for His Majefty, his heirs and fucceffors, to affume the pollesfion and property of the faid bridge, toll house, turnpike and dependencies, and the affents and approaches thereto, upon paying to the said Jean Lagorce, his heirs, executors, curators or affigns, the full and entire value which the fame fhall at the time of fuch affumption, bear and be worth.

IV. And be it further enacted by the authority aforefaid, that when and fo foon is built and con as the faid bridge fhall be erected and built, and made fit and proper for the paffage passage of travel- of travellers, cattle and carriages, and that the fame fhall have been certified by entitled to certain any two or more Juftices of the Peace, for the District of Montreal, after examination solls for poutage thereof, by three experts, to be appointed and sworn by the faid Juftices, and shall

Pourvû toujours, que le dit Jean Lagorce, les Héritiers ou fucceffeurs ne pourront commencer l'érection du dit Pom et autres ouvrages par lefquels aucun individu pourroit être privé de fon terrein on partie d'icelui, ou fouffrir des dommages, avant que le prix. ou valeur du dit terrein et dommages eftimés et règ és en la manière ci-deffus prefcrite, ayent été payés à tel individu, ou après que tel prix ou valeur lui aura été offert, ou qu'à fon refus le dit Jean Lagorce, l'ait configné au Greffe de la Cour du Banc du Roi, pour le District de Montréal.

Et qu'il foit de plus flatué par l'autorité fufdite, que le dit Jean Lagorce, ies hoirs et ayans caufe, font revêtus pour to jours de la propriété du dit Pont et de la dite Maifon de péage, Barrières et autres dépendances qui y feront érigés fur et près d'iceux, et auffi de toutes les montées ou abords du dit Pont, et de tous les matériaux qui feront, de tems en tems, obtenus et pourvus pour l'ériger, conftruire, faire, entretenir et réparer. Pourvû qu'après l'expiration de cinquante années, à compter depuis la paffation, de cet Acte, il fera et pourra être loifible à Sa Majefté, de cinquante fes Héritiers et Succeffeurs de reprendre la poffeffion et propriété du dit Pont, jesté pourra prendre posses. Maison de Péage, Barrière et autres dépendances, ainsi que les aboids et montées à sion du du Pont icelui, en payant au dit Jean Lagorce, les Héritiers, Exécuteurs, Curateurs ou ayans dit Jean Lagorce caufe, l'entière et pleine valeur qu'il pourra avoir et valoir au tems de telle prife de poffeffion.

IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que lors et auffitôt que le dit Pont fera érigé et conftruit, et fait d'une manière propre et convenable pour le Pont sera conspaffage des voyageurs, beftiaux et voitures, et qu'il fera certifié par deux ou plus des ble pour le pasJuges de Paix, pour le diftrict de Montréal, d'après un examen d'icelui par trois geurs &c.
