CA P. XVI.

An Act to confirm and make valid certain proceedings of the Commis. fioners for the building and the repair of Churches, Parfonage Houses, and Church Yards.

WHEREAS er verd Co an of

THEREAS divers Commiffions have, from time to time, heretofore been iffued under and by virtue of an Ordinance of the late Province of Que bec, paffed in the thirty first year of His Majefty's Reign, intituled, “An Actor "Ordinance concerning the building and repairing of Churches, Parsonage Houses, " and Church Yards," by the Governors or perfons adminiftering the Government of this Province, appointing and conftituting the perfons in the said Commiffion, named, to execute the truft by the faid Ordinance vefted in the Governors or Commanders in Chief for the time being; And whereas by reason of the determination from time to time, of the faid Commiffions, difputes and queftions have arilen and may arife, as to the validity or legality of certain Acts or proceedings done or had by the faid Commiffioners, after the determination of their authority as aforefaid; Now for the removing and putting an end to fuch questions and dif putes; Be it therefore declared and enacted by the King's Moft Excellent Majef ty, by and with the advice and confent of the Legiflative Council and Assembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an A& paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A&t paffed in the fourteenth year of His Majefty's Reign, inti uled, " An A& for making more effectual provifion for the "Government of the Province of Quebec, in North America;" and to make further "provision for the Government of the faid Province;” And it is hereby enacted by Acts of Com the authority of the fame, that all acts and proceedings whattoever, had or done before 13th day by or under the authority of the laid Commiffioners before the thirteenth day of So, 1816, October, in the year of our Lord one thousand eight hundred and eighteen, in the execution bona fide of the authority and truft so as aforefaid reposed in them, shall be and fhall be efteemed and taken, and in every Court of Law wherein question shall arile concerning the validity of the fame, fhall be adjudged and declared to be as good, valid and effectual in Low to all intents and purposes whatsoever, as if the laid Commiffions under which the faid Commiffioners fhali refpe&ively in fuch cafes have acted, had been and ftill remained in full force and virtue when the faid atis and proceedings were respectively had and done, any objection for or by reason of the cellation and determination of the powers to as aforelaid vefted in the faid Commiffioners to the contrary thereof notwithstanding.

des commiffions auroient été de tems à autre ci-devant expédiées fous et Préambulb. en vertu d'une Ordonnance de la ci-devant Province de Québec, paffée dans la trente-et-unième année du Règne de Sa Majefté, intitulée, "Acte ou Ordonnance qui concerne la construction et la réparation des Eglifes, Presbitères et Cime"tières," par les Gouverneurs ou les perfonnes ayant l'administration du Gouvernement de cette Province, appointant, et conftituant les personnes nommées dans les dites commiffions pour exécuter les pouvoirs dont les Gouverneurs et Comməndants en Chef pour le tems d'alors, font revêtus par la dite Ordonnance; Et vû que les pouvoirs délégués par les dites commiffions ont expiré de tems à autre, et que pour cette raifon des doutes et difficultés le font élevés et ont eu lieu, et pourroient encore avoir lieu et s'élever, quant à la validité ou légalité de certains Actes ou procédés faits et fuivis par les dits Commiffaires, lorfque leurs pouvoirs étoient expirés tels que fufdit; afin donc d'y remédier et de mettre fin à ces doutes et difficultés; Qu'il foit donc déclaré et ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, “Acte qui rappelle certaines "parties d'ur. Acte paffé dans la quatorzième année du Règne de Sa Majefté, inti* tulé, “A&e qui pourvoit plus efficacement pour le Gouvernement de la Province de " Québec, dans l'Amérique Septentrionale," Et qui pourvoit plus amplement pour le "Gouvernement de la dite Province;" Et il eft par le présent ftatué et déclaré par la même autorité que tous les A&es et procédés quelconques qui ont eu lieu et ont été faits par les dits Commiffaires, ou fous leur autorité, avant le treizième jour du mois d'Octobre, de l'année de Notre Seigneur, mil huit cent dix-huit, en, exécu tion bona fide, de l'autorité et du pouvoir dont ils étoient revêtus, tel que fufdit, fe ront jugés et confidérés, et dans toutes Cours de Justice, où il s'élevera une queftion fur lavalidité d'iceux, iis feront adjugés et déclarés être auffi bons et valides en Loi, à toutes fins et intentions quelconques, que fi les dites commiffions, fous et en vertu defquelles les dits Commiffaires auront refpe&tivement agi dans ces cas, avoient été et étoient encore dans leur pleine force et vertu, lorsque les dits Actes et procédés ont eu lieu, et ont été refpe&ivement faits, nonobitant toute objection faite pour et en raifon de la ceffation et expiration des pouvoirs ainfi donnés et accordés aux dits Commiffaires, tel que fufdit.

An A&t to difcontinue certain Duties therein-mentioned.

(24th April, 1819.)

WHEREAS by an A&t paffed in the fifty-third year of His Majefty's Reign, intituled, "An A&t to grant certain Duties to His Majefty towards fupply"ing the wants of the Province during the prefent war with the United States of "America, and for other purposes," which faid A&t was, by another A& paffed in the fifty-eighth year of His Majefty's Reign, intituled, "An Act to continue "for a limited time, the levying of the Duties impofed by the A&t of the fifty. "third year, of His Majefty's Reign, Chapter the eleventh, as amended by the "A of the fifty-fifth year of His Majefty's Reign, Chapter the fecond," further continued for a limited time, a duty of two pounds ten hillings, currency, is impofed on every hundred pounds worth of goods, wares and merchandize which fhould thereafter be imported into this. Province, from any place or country what. foever, by any perfon or perfons whatfoever, with the exception of certain articles eles exempt from enumerated in the fifth Claufe of the Act firft above mentioned; And whereas it is expedient alfo to exempt Seeds, Rye, Oats, Barley, Potatoes, Indian Corn, Beans, Peafe, Rice and Grain of all kinds, and Horles, Neat Cattle, Sheep, Hogs, Poultry, and other Live Stock, and live provisions of all kinds, as well as Pitch, Tar, Turpentine, Rofin,, Hemp and Flax, Butter, Cheefe and Honey, from the faid duty Be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower, Canada, conftituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, “An Act to repeal cer"tain parts of an Act paffed in the fourteenth year of His Majefly's Reign, intituled, "An Act, for making more effectual provifion for the Government of the Province of Quebec, in North America," and to make further provifion for the Govern "ment of the faid Province;" and it is hereby enacted by the authority of the fame,

Vu que par un Acte paffé dans la cinquante-troisième année du Règne de Sa Préambule, Majefté, intitulé, "Acte pour accorder des droits à Sa Majefté, pour fubve"nir aux befoins de la Province, pendant la préfente Guerre avec les Etats-Unis "d'Amérique, et pour d'autres fins," lequel A&te a été continué encore, pour un tems limité, par un autre Acte paffé dans la cinquante-huitième année du Règne de Sa Majefté, intitulé, "Acte pour continuer pour un tems limité, la perception des "droits impolés par l'Acte de la cinquante-troisième année du Règne de Sa Ma"jefté, chapitre onzième, tel qu'amendé par l'Acte de la cinquante-cinquième année "du Règne de Sa Majefté, chapitre deuxième," un droit de deux Livres et dix chelins courant eft imposé sur chaque cent Livres valant de biens, effets et marchandises qui feroient par la fuite importés d'aucune place ou pays quelconque en cette Province, par aucune perfonne ou perfonnes quelconques, à l'exception de certains articles énumérés, dans la cinquième claufe de l'Acte, le premier, ci-deffus Certains articles mentionné ; Et vû qu'il eft expédient auffi d'exempter du dit dioit les graines, le Seigle, l'Avoine, l'Orge, les Patates, le Bled-d'Inde, les Fêves, les Pois, le Riz, et les grains de toutes espèces, et les Chevaux, le gros Bétail, les Moutons, les Cochons, les Volailles et autres animaux vivans, et provifions vivantes de toutes pèces, ainfi que le Brai, le Goudron, la Terébentine, la Refine, le Chanvre, et la Filaffe, le Beurre, le Fromage et le Miel; Qu'il foit donc ftatué par la Très Excellente Majefté du Roi, par et de l'avis et conientement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en veitu et fous l'autorité d'un Acte paflé dans le Parlement de la Grande-Bre agne, intitulé, "Acto "qui rappelle certaines parties d'un Acte paffé dans la quatorzième année du Règne "de

An Act to continue for a limited time, an A&t paffed in the fifty-feventh year of His Majefty's Reign, intituled, " An Act to provide for the main"tenance of good Order on Sundays and Holidays.

(24th April, 1819.)

HEREAS an Act was paffed in the fifty-feventh year of His Majesty's Reign, intituled, "An Act to provide for the maintenance of good Order oap. 3, continued. " on Sundays and Holidays," which faid Act will expire on the first day of May, one thousand eight hundred and nineteen; And whereas it is expedient further to continue for a limited time, the aforefaid Act; Be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act paffed in the "fourteenth year of His Majefty's Reign, intituled, " An Act for making more ef"fectual provifion for the Government of the Province of Quebec, in North America, "and to make further provifion for the Government of the faid Province," And it is hereby enacted by the authority of the fame, that the aforefaid act passed in the fifty-feventh year of His Majefty's Reign, intituled, "An Act to provide for the "maintenance of good order on Sundays and Holidays," and all and every the matters and things therein-mentioned and contained, fhall continue and be in force until the first day of May, one thousand eight hundred and twenty-one, and no longer.
