rials as may be neceffary or proper for the purposes aforefaid, without any previous treaty whatsoever with the owner or owners, occupier or occapiers of, or other perfon or perfons intere fted in fuch lands, grounds or hereditaments or any of them, doing as little damage thereby as the nature of the works will admit of, and mak ing recompence for fuch damages to the owners or occupiers of, or other perfons interested in fuch lands, grounds, property, or hereditaments, within the fpace of fix calendar months next after the lame fhall be demanded, for all damages which fhall or may be done by means of the digging for, getting, working, taking, carrying away, and ufing fuch ftones, gravel, and materials, or any of chem; which damages, and the fatisfaction and recompenfe in respect thereof, shall be settled, adjufted, affeffed, ascertained, and determined by the ways and means herein prefcribed, with refpect to other damages done by the making and completing the faid navigation.

XL. And be it further enacted by the authority aforefaid, that nothing in this A& fhall extend or be conftrued to extend to reftrain or hinder the owner or owners of any lands or grounds through which the faid Canal may pafs, from making, erecting, or using any wharves, quays, landing places, cranes, weigh-beams, or warehouses, in or upon their own lands, grounds, or waters adjoining, or near to the faid Canal, or from landing any goods or merchandize, or other things there upon, or upon the banks lying between the fame and the faid Canal, or from making or using proper and convenient places for boats, barges, or other vessels to be in, fo that the making, erecting, or ufing thereof refpectively, fhall not, and do not encroach upon, obftru&, or prejudice the navigation of the faid Canal, or the towing paths thereof; and provided the fame be made and erected within twelve calendar months after notice given to fuch owner or owners, by or on behalf of the faid Company of Proprietors, that the faid lands or grounds are neceffary for the purposes aforefaid; and all fums of money which fhall be paid for the ufe and benefit of the faid wharves, quays, landing places, cranes, weigh-brams, and warehoufes refpectively, fhall be, and the fame are hereby vefted in the owner or own. ers of fuch lands or grounds, who fhall make and ere& fuch wharves, quays, landing-places, cranes, weigh beams, or warehouses refpectively, his, her, or their heirs and affigns, fo that the rates or dues hereby granted to the faid Company of Proprietors fhall not be thereby reduced or altered.

XLII. And be it further enacted by the authority aforesaid, that the mafter or for all damages, owner of any boat or other veffel navigating upon the faid Canal, fhall be and is hereby made answerable for any damage, fpoil or mischief, loss or accident, occafioned through negligence or defign, that fhall be done by his boat or other veel, or by any of the boatmen or watermen employed in and about the fame relpec. tively, unto any of the bridges, weirs, locks, dams, engines, or other works, in, upon, or near the faid intended Canal, or by loading or unloading any boat or other veffel; and for any injury or damage that shall or may be done to the owners of any building or land adjoining the fame; and the mafter or owner of fuch boat or other veffel, fhall and may be profecuted for the fame in any Court of Record; and if a verdict, or judgment, be given against him, in fuch Court, in any such cale, the plaintiff fall recover his damages thereby sustained, with costs of fuit.

XLIII. And be it further enacted by the authority aforefaid, that if any boat,. ing the navigati veffel or raft fhall be placed in any part of the faid Canal, fo as to obftru&t the na vigation thereof, and the perfon having the care of such boat, vessel or raft, shall not immediately, upon request of any of the fervants of the faid Company, made for that purpule, remove the fame, he fhall, for every fuch offence, forfeit a penalty of ten fhillings, currency, for every hour fuch abftruction fhall continue; and it shall be lawful for the agents or fervants of the faid Company of Proprietors, to caufe. any fuch boat, veffel, or raft to be unloaded, if neceffary, and to be removed in fuch manner as fhall be proper for preventing fuch obftruction in the navigation, and to feize and detain fuch boat, veffel, or raft, and the loading thereof, or any part of fuch loading, until the charges occafioned by fuch unloading and removal, are paid; and if any boat or vellel fhall be funk in the faid Canal, and the own er or owners, or the perfon or perions having the care of fuch boat or velfel, fhall not, without loss of time, weigh or draw up the fame, it fhall be lawful for the agents or fervants of the faid Company of Proprietors, to caufe fuch boat or veffel to be weighed or drawn up, and to detain and keep the fame untill payment be made of all expenfes neceflarily occafioned thereby,

Et qu'il foit de plus ftatué par l'autorité fufdite, que fi aucun Bateau, Vaiffeau ou Cajeu fe trouve placé dans quelque partie du dit Canal, de manière à en ront la navigation obftruer la navigation, et que la perfonne ayant fous les foins tel Bateau, Vaiffeau ou Cajeu, ne le déplace pas immédiatement auffitôt qu'il en fera requis par aucun des employés de la dite Compagnie, il encourra pour chaque telle offenfe la pénalité d'une fomme de dix chelins courant, pour chaque heure que telle obftruction continuera, et il fera loifible aux Agens ou ferviteurs de la dite Compagnie des Pro-priétaires, de faire décharger tel Bateau, Vaiffeau ou Cajeu, fi c'eft nécellaire, et de le faire déplacer de la manière qu'il fera convenable pour empêcher telle obftruction de la navigation, et de faifir et détenir tel Bateau, Vaiffeau ou Cajeu et la charge d'iceux, ou aucune partie de telle charge, jufqu'à ce que les frais occafionnés par telle décharge et déplacement foient payés, et fi quelque Bateau ou Vaifleau coulait à fond dans le dit Canal, et que le Propriétaire ou les Propriétaires, ou la perfonne on perfonnes ayant foin de tel Bateau ou Vaiffeau ne le faifoient pas lever ou tirer fans perte de tems, il fera loifible aux Agens ou ferviteurs de la dite Compagnie des Propriétaires, de faire retirer tel Bateau ou Vaiffeau, et de détenir et garder iceux jufqu'à ce que le payement de toutes les dépenfes néceffairement occafionnées foit. remboursé.

XLV. And be it further enacted by the authority aforefaid, that the feveral and refpe&tive perfons united into a Company of Proprietors as aforefaid, for mak. ing the faid Canal and other works as aforefaid, fhall, and they are hereby feverally required to pay the respective fums which may be by them fubfcribed to be advanced as aforefaid, towards making and completing the faid Canal and other works, or fuch parts or proportions of fuch fums as fhall from time to time be called for, by the faid Company of Proprietors, by virtue of the powers and directions of this Act; and alfo, all perfons who may hereafter fubfcribe and agree to advance and pay any money for the purposes aforelaid, are hereby required to pay the fum or fums of money which fhall be by them refpectively fubfcribed to be advanced, of fuch parts or proportions thereof as fhall from time to time be called for by the faid Company of Proprietors, by virtue of the powers and directions of this A; and in cafe any of the faid feveral and refpective persons who may have subscribed, or who fhall hereafter fubfcribe, to advance and pay any fum or fums of money as aforefaid, fhall neglect or refale to pay the fame, at fuch time and times as fhall be required by the laid Company of Proprietors as aforefaid, then, and in that case it fhall be lawful for the faid Company of Proprietors to fue for and recover the fame in any Court of Law having jurifdiction.

XLVI. And be it further enacted by the authority aforefaid, that the faid Company of Proprietors, to entitle themfelves to the benefit and advantages to them granted by this A&t, fhall, and they are hereby required to make and complete the faid Canal, from Lachine to the foot of the current of Saint Mary, having a later al branch iffuing at or near the Harbour of Montreal, in manner aforefaid, within three years from the paffing of this A&t; and if the fame fhall not be fo made and completed within the period b.fore-mentioned, fo as to be navigable for boats, bar
