XXX. And be it further enacted by the authority aforefaid, that it fhall be law. ful for the faid Company of Proprietors, and they are hereby authorized and required from time to time, to nominate and appoint a Treasurer or Treasurers, and a Clerk or Clerks to the faid Company, and to take fuch fufficient fecarity for the due execution of their refpective offices as he laid Company of Proprietors fhall think proper, and from time to time remove any fuch Treasurer or Clerk, and appoint others in their place and ftead, which faid Clerk o: Cie ks, fhall, in a proper book, or books, to be provided for that purpose, enter, and keep a true and perfect account of the names and places of abode of the feveral Proprietors of the faid navigation and undertaking, and of the feveral perfons who fhall from time to time become owners and proprietors, or entitled to any fhare or fhares therein, and of all the other Acts, proceedings, and tranfactions of the faid Company of Proprietors, and of the faid Com mittee in the execution of this Act, and that each of the said Proprietors fhall and may at all convenient times have recourfe to, and peruse and inspect the same, and may demand and have copies thereof, or any part thereof, paying Gx--nce for e very one hundred words fo to be copied; and if any fuch Clerk thail refuse to permit any of the faid Proprietors to infpe&t or perufe fuch book or books, or refuse to make any fuch copy at the rate aforefaid, he shall for every tuch offence forfeit and pay the fum of five pounds currency; and whenever any fuch Clerk or Treafurei shall die or be removed from, or quit the fervice of the fad Company of Proprietors, it fhall be lawful for the faid Committee, or any three or more of them, to appoint fome other fit perfon in the place of the Treaturer or Clerk fo dying, removed, or quitting the fervice of the faid Company of Proprietors until the then next General Aflembly, when foch appointment of deemed proper, fhall be confirmed, or another Treasurer or Clerk fhall be nominated and appointed in his ftead.

XXXI. And be it further enacted by the authority aforefaid, that as foon as the horized to take faid Canal to be made and cut from Lachine or the ne ghbourhood thereof, to the foot of the current of Saint Mary, having at least one lateral branch as fat as, or to the neighbourhood of the Harbour of Montreal in manner aforefaid, shall have been completed, fo as to be navigable for boats, barges, veffels and rafts, it shall be Jawful for the fard Company of Proprietors, from time to time, and at all times thereafter, to afk, demand, take, and recover to and for then own proper use and behoof, upon all boats, barges, vellels, and rafis of lumber paffing through, or upon the faid Canal, the feveral rates and duties herein-after mentioned, that is to lay:

Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera loifible à la dite Compagnie des Propriétaires, et elle eft par le préfent autorisée et requise de nommer de tems en teins un Tréforier ou des Tréforiers, et un Commis ou des Com- Clercs, &c. mis pour la dite compagnie, et de prendre telle fûreté fuffifante pour l'exécution fidèle de leurs emplois refpectifs, que la dite Compagnie des Propriétaires jugera néceffaire, de déplacer de tems en tems tous tels Tréforiers ou Commis, et d'en nommer d'autres à leur lieu et place, lefquels dits Commis ou Commis entreront et tiendront dans un ou des livres convenables qui leur feront fournis à cet effet, un état jufte et parfait des noms et des lieux de réfidence des divers propriétaires de telle navigation et entreprise, et des différentes perfonnes qui de tems en tems de viendront poffeffeurs et propriétaires, ou qui auront droit à quelque action ou tions en iceiles, et de tous les autres actes, procédés et tranfactions de la dite Com-. pagnie des Propriétaires et du dit Comité dans l'exécution de cet Acte, et que chacun des dits propriétaires peut et pourra en tout tems convenable y avoir recours, les lire et examiner, et pourront demander et avoir des copiesd'iceux ou d'auc une partie d'iceux, en payant fix deniers courant pour chaque cent mots qui feront ainfi copiés, et fi tous tels Clercs refusent de permettre à quelqu'un des dits propriétaires, d'examiner ou de lire tel livre ou livres, ou reffent de faire telles copies au taux fufdit, pour chaque telle offense, il encoura et payera la fomme de cinq livres courant, et chaque fois que tout tel Clerc ou Tréforier mourra, ou fera déplacé, ou quittera le fervice de la dite Compagnie des Propriétaires, il fera loifible au dit Comité, ou à trois ou plus d'eux de nommer quelqu'autre perfonne capable à la place du Tréforier ou du Commis ainfi mort, ou qui aura été déplacé, ou aura quitté le fervice de la dite Compagnie des Propriétaires, jusqu'à la première affemblée générale où telle nomination, fi elle eft jugée convenable, fera confirmée, ou un autre Tréforier ou Commis fera nommé et conftitué à sa place.

XXXI. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'auffitôt que le dit Canal qui fera fait et creusé depuis, à ou près de Lachine jusqu'au pied du Courant dre des taux pour Sainte Marie, avec au moins une branche latérale jufqu'à ou près da Port de Montréal, de la manière fufdite, aura été achevé de manière à être navigable pour des Bateaux, Brges, Vaiffeaux et Radeaux, il fera loifible à la dite Compagnie des Propriétaires de tems en tems et en tout tems ci-après, d'exiger, demander, prendre et recevoir pour leur propre ufage et avantage fur tous Bateaux, Berges, Vaiffeaux et Cajeux de bois qui pafferont par, ou fur le dit Canal, les différens taux et droits ci-après mentionnés, c'est-à-dire: Pour chaque tonneau de bois, fix deniers courant;

for every ton of timber, fix pence, currency; for every cord of fire wood, two fhillings, currency; for each boat, barge, or veffel of five tons measurement and under, twelve fhillings and fix pence, currency; between five and twenty tons measurement, feventeen fhillings and fix pence, currency; between twenty and fixty tons measurement, twenty-five fhillings, currency; above fixty tons measurement, thirty fhillings, currency; for each ton of merchandize, conveyed in any of the faid veffels, five fhillings, currency; for each puncheon, two fhillings and fix pence, cur. rency; for each barrel of pot or pearl afhes, one fhilling and three pence, currency; for every tierce of rice, flour, or other articles, one fhilling, currency; for every barrel of pork or beef, nine-pence, currency; for every barrel of flour, fix pence, currency; for every half barrel of flour, four pence, currency; for every perfon not compofing the crew of any raft, boat, barge, or other veffel, one fhilling, currency; for every horse, mare, mule, bull, ox, cow, and all other horned and neat cattle, each one fhilling, currency; and for every hog, goat, fheep, calf, or lamb, three-pence currency; the faid rates to be paid refpectively for the whole diftance from La. chine to the foot of the current of Saint Mary, and fo in proportion for each mile of the faid diftance, that any fuch rafts, boats, barges, or other veffels may pals; and the faid perfons, cattle, goods, and effects may be tranfported upon fuch Canal; Provided always, that if after the expiration of two years from the time of the completing of the faid Canal, fo as to become navigable in manner aforefaid, the tolls herein-before established, thould be found exceffive, it fhall and may be lawful for the Legislature of this Province to reduce the faid rates of tolls, so as that the lame fhall not produce to the faid Company of Proprietors a greater rate of intercft and profit upon their capital ftock, than fifteen pounds for every hundred pounds of such capital ftock laid out and expended for the making of the faid Canals, the expences of repairs, and keeping up the faid Canal remaining, in confidera ion of fuch intereft and profit, at the charge of the proprietors of shares; and to this end, it shall be the duty of the faid Company of Proprietors, and they are hereby required to produce and lay before the feveral branches of the Provincial Parliament, wihin two years after the faid Canal fhall have been completed, and become navigable as aforesaid, a juft and true ftatement and account of the monies by them difbarled and laid out in the making and completing of the faid Canal in manner aforefaid, and alfo of the amount of the tolls and revenue of the faid Canal, and of the annual expenditure and difbarfements in maintaining and keeping up the fame, during the faid two years; the faid feveral accounts and ftatements to be ugned by the Prefident and Treasurer of the faid Company of Proprietors, and by fuch Prefi dent and Treasurer attefted before any of the Judges of either of His Majesty's Courts of King's Bench for the District of Montreal.

XXXII. Provided always, and be it further enacted by the authority aforesaid, of tous, how set that in all cafes where there fhall be a fraction of a mile in the diftance which any boat, barge, or other veffel, or any raft, fhall be navigated or país upon the faid inten

Les dits taux feront payés refpectivement pour toute la difance de Lachine au pied du Courant Sainte Marie, et ainfi en proportion pour chaque mille de la dite distance, que tels cages, bateaux, berges ou autres Vaiffeaux pourront paffer, et que les dites perfonnes, beftiaux, marchandises et effets pourront être tranfportés fur le dit Canal. Pourvû toujours, que fi après l'expiration de deux années du tems que le dit Canal fera parachevé, de manière à devenir navigable en la manière fufdite, les taux par le préfent ci-deffus établis font trouvés exceffifs, il fera et pourra être loifible à la Légiflature de cette Province de réduire les dits taux, de manière qu'ils ne produifent point à la dite Compagnie des Propriétaires un plus grand taux d'intérêt et profit sur son Capital, que quinze livres par chaque cent livres de tel Capital, payé et dépenté pour la confection des dits canaux, les frais de réparation et entretien du dit Canal demeurant, moyennant cet intérêt et profit, à la charge des actionnaires, et à cette fin il fera du devoir de la dite Compagnie des Propriétaires, et elle eft par le préfent requife de produire et mettre devant les différentes Branches du Parlement Provincial, dans les deux années après que le dit Canal aura été parachevé et rendu navigable comme fuldit, un état et compte jufte et fidèle des argents par elle debourses et employés à faire et parachever le dit Canal en la manière fufdite, et auffi du montant des taux et revenus du dit Canal, et des dépenses et débourfés annuels pour l'entretenir durant les dites deux années, lesquels dits différents comptes et états feront fignés par le Préfident et le Tréforier de la dite Compagnie des Propriétaires, et atteftes par tels Président et Tréforier devant un des Juges de la Cour du Banc du Roi de Sa Majefté, pour le Diftri& de Montréal.

XXXII. Pourvû toujours, et qu'il foit de plus ftatué par l'autorité fufdite, que dans tous les cas où il y auroit une fraction de Mile dans la diftance que parco ir ront ou feront tous Bateaux, Berges, ou autres Vaiffeaux ou Radeaux, fur le dit Canal

ded Canal, fuch fraction shall, in afcertaining the said rates, be deemed and confidered as a whole mile; and that in all cases where there fhall be a fraction of a ton in the measurement of any boat, barge, or other veff 1 fo to be navigated on the said in tended Canal, a proportion of the faid rates fhall be demanded and taken by the faid Company of Proprietors for fuch fraction, according to the number of quar ters of a ton contained therein; and in all cafes where there shall be a fraction of a quarter of a ton in any tuch meaforement as aforefaid, fuch fraction fhall be deem ed and confidered as a whole quarter of a ton; and in all cafes where timber, boards, plank and fcantling in rafts, fball pafs upon, or through the faid Canal, the aforefaid dues thereon fhall be calculated in proportion to the quantity of feet; but no quantity under twenty-five feet thereof fhall pay less than the proportion which may becharged for any twenty-five feet of such timber, boards, plank, and scantling as aforefaid.

XXXIII. And be it further enacted by the authority aforefaid, that the faid feveral rates and dues fhall be paid to fuch perfon or perfons, at fuch place or places to be paid to per- near to the faid Canal in fuch manner, and under fuch regulations as the faid Com pany of Proprietors fhall direct or appoint. And in cafe of denial or neglect of payment of any fuch rate or dues, or any part thereof on demand, to the perfon or perfons appointed to receive the fame as aforefaid, the faid Company of Propri etors may fue for, and recover the fame in any Court having jurisdiction thereof, or the person or perfons to whom the faid rates or dues ought to be paid, may, and he is, and they are hereby empowered to feize and detain fuch boat, veffel, barge or raft, for, or in refpect whereof such rates or dues ought to be paid, and detain the fame until payment thereof.

XXXIV. And be it further enacted by the authority aforesaid, that the said Company of Proprietors fhall, at the first General Affembly to be held as aforefaid, afcertain and fix the rates or dues to be taken by virtue of this Act; and that to be taken by it fhall be lawful for the faid Company of Proprietors, at any General Affembly to virtue of this Act be held for that purpose, (of which three calendar months notice at the leaft shall be given, in the manner herein provided for giving the notice of other General Affemblies) to leffen or reduce all or any of the faid rates or dues, as the faid Company of Proprietors fhall think proper, and afterwards from time to time, at any General Affembly, of which notice fhall be given as aforefaid, to advance and raise all or any of the faid rates or dues to diminished; provided always, that the faid rates fo to be advanced, afcertained, and fixed as aforefaid, fhall not in any cafe exceed the faid rates or dues herein-before granted; and that no reduction of the said rates or dues fhall be made without the confent of the Proprietors of at least one thousand shares in the said navigation.
