XII. And be it further enacted by the authority aforesaid, that it shall and may be lawful for the faid Company of Proprietors, and they are hereby authorized and all Brooks, &c. to empowered from and after the paffing of this Act, to fupply the faid Canal, whift way all sorts of making, and when made, with water from all such brooks, springs, ftreams, water-cour enter on all lands, fes, hollow, and other repofitories of water, as shall be found in making the said Canal, Majesty, &c. not or within the distance of one thousand yards, (except asherein-before or herein-after on which houses mentioned) from any part of the faid Canal, or from any refervoir or refervoirs to be made, for fupplying the faid Canal with water: And the said Company of Proprietors are hereby alfo authorized and empowered by themselves and their deputies, agents, fervants, and workmen, to make one or more refervoir or refervoirs, and to make one or more fire engine or engines, or other machines, for the purpose of railing water to supply the faid Canal, or any part thereof, and fuch refervoir or refer voirs with water, and fuch and fo many feeders, tunnels and aqueducts, for fupplying the faid refervoirs and Canal with water, and conveying water from any fuch refervoir or refervoirs, to the faid Canal, as to them fhall feem neceffary and proper, (except as herein-after or above mentioned). And for the purpotes aforefaid, the faid Company of Proprietors, and their agents, fervants, and workmen, are hereby authorized and empowered to enter into and upon the lands and grounds of, or belonging to the King's Majefty, his heirs or fucceffors, or of any other perfon or perfons, bodies politic or corporate, excepting as is herein-before provided, and to furvey and take levels of the fame, or any part thereof, and to let out and af certain fuch parts thereof as they fhall think neceffary and proper for making the faid Canal, and any fuch refervoir or refervoirs, feeders, tunnels, and aqueducts, and all fuch other matters and conveniences as they fhall think proper and necef. fary for making, effecting, preferving, improving, completing, and ufing in the faid intended navigation; and alfo to bore, dig, cut, trench, remove, take, carry a way, and lay earth, foil, clay, flone, rubbish, trees, roots of trees, beds of gravel or fand, or any other matter or things which may be dug, or got in the making of the faid Canal, or in the making of any refervoir or refervoirs, feeders, or aque duas, or out of any lands or grounds of any person or persons adjoining, or laying contiguous thereto, and which may be proper, requifite, or convenient for car. rying on, continuing, or repairing the faid Canal, or other the faid works, or which may hinder, prevent, or obftru&t the making, ofing, completing, and maintaining the fame: And alfo to make, build, erect, and fet up in and upon the faid Canal, or upon the lands adjoining or near to the fame, fuch and to many bridges, tun

XII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible à la dite Compagnie des propriétaires, et ils font par le préfent autorisés et ont pouvoir, depuis et après la paffation de cet Acte, de fournir le dit Canal, tandis qu'il fera après le faire et quand il fera fait, d'eau de tous tels ruiffeaux, fources, cours d'eau, cavités et autres étangs, qui pourront fe rencontrer en faisant le dit Canal, ou à une distance n'excédant pas mille verges, (excepté comme ci-devant ou ci-après mentionné) d'aucune partie du dit Canal, ou de quelque Réfervoir ou Réfervoirs à faire pour fournir d'eau le dit Canal, et la dite Compagnie des Proprié taires par le préfent Acte eft auffi autorifée et a pouvoir de faire par eux-mêmes et leurs Députés, Agens, Serviteurs ou Ouvriers, un ou plufieurs Réfervoirs, et de faire une ou plufieurs pompes à feu ou Engins, ou autres machines à deffein d'élever l'eau, et d'en fournir le dit Canal ou aucune partie d'icelui, et tel réservoir ou réfervoirs, tel et tels Filons, communications et aqueducs pour fournir d'eau les dits Réfervoirs et Canal, et conduire l'eau de tout tel Réservoir ou Réservoirs au dit Canal, ainfi qui leur paroîtra néceffire et convenable, (excepté comme ci-après ou ci-deffus mentionné,) et pour les fins fufdites, la dite Compagnie de Propriétaires et leurs Agens, Serviteurs et Ouvriers font par le présent autorisés et ont pouvoir d'entrer dans et fur les terres et terreins de ou appartenant à Sa Majefté le Roi, fes Héritiers ou Succeffeurs, ou à toute autre perfonne ou perfonnes, corps politique ou corporation, excepté comme ci-deflus pourvu, et de mefurer et prendre les niveaux d'iceux ou d'aucune partie d'iceux, et de tracer et conftater telles parties d'iceux de la manière qu'ils le jugeront néceffaire et convenable pour faire le dit Canal, et tous tels Réfervoir où Reiervoirs, Filons, communications et aqueducs, et tous tels autres objets et · commodités qu'ils trouveront néceffaires et convenables pour faire, exécuter, conserver, améliorer, achever et mettre en ufage dans la dite navigation projettée, et auffi : de percer, creuler, couper, trancher, ôter, prendre, emporter et pofer de la terre, fol, argile, pieries, décombres, arbres, racines d'arbres, lits de gravier ou de fable, ou toutes autres matières ou chofes qui peuveut être creufees ou prifes en faisant le dit Canal, ou faifant quelque Réservoir ou Réservoirs, conduits ou aqueducs, ou d'au... -cune terre ou terrein de toute perfonne ou perfonnes, joignant ou contigus à iceux,. et qui peuvent être propres, réquifes ou convenabies pour exécuter, continuer ou éparer le di Canal, ou autres des dits ouvrages, ou qui peuvent en outre em êcher, prevenir ou obftruer la confe&ion, l'ulage et l'entretien d'icelui, et auffi de faire, bâur, éniger et conftruire dans et fur le dit Canal, ou fur les terres adjacentes ou

nels, aqueducts, fluices, locks, weirs, pens for water, tanks, refervoirs, drains, wharves, quays, landing-places, weigh-beams, cranes, fire-engines, or other machines, and other works, ways, roads and conveniences, as the faid Company of Proprietors fhall think requifite and convenient for the purposes of the faid naviga. tion; and alfo from time to time, to alter, repair, amend, widen, or enlarge the fame, or any other of the conveniences above-mentioned, as well for carrying or conveying goods, commodities, timber, and other things, to or from the faid Canal, as for the carrying or conveying of all manner of materials neceffary for the making, erecting, furnishing, altering, repairing, amending, widening, or enlarging the works of and belonging to the faid navigation; and alfo to place, lay, work and manufacture the faid materials on the grounds, near to the place or places where the faid works, or any of them, are or fhall be intended to be made, erected, repaired, or done-and to build and conftru&t the feveral locks, bridges, works, and erections belonging thereto; And alfo to make, maintain, repair, and alter any fences or paffages over, under, or through the faid Canal, or the refervoirs and tunnels, aqueducts, trenches, paffages, gutters, water-courfes, and flices refpectively, which shall communicate therewith; and alfo to make, fet up, and appoint fuch roads, towing-paths, banks, and ways convenient for towing, hauling, or drawing boats, barges, veffels, or rafts paffing in, through, along, or upon the faid Canal, as they the faid Company of Proprietors fhall think convenient; and to conftruct, erect, and keep in repair any piers, arches, or other works, in, upon and across any rivers or brooks, for making, ufing, maintaining, and repairing the faid Canal, and the towing-paths on the fides thereof: And also to construct, make, and do all other matters and things which they shall think necessary and convenient for the making, effecting, preferving, improving, completing and ufing the faid Canal, in pursuance and within the true meaning of this Act; they the faid Company of Proprietors doing as little damage as may be in the execution of the feveral powers to them hereby granted, and making fatisfaction in manner herein-before mentioned, for all damages to be fiftained by the owner or occupiers of fuch lands, tenements, or hereditaments, waters, water-cous fes, brooks, or rivers respectively, as fhall be taken, ufed, removed, diverted, or prejudiced in or by the execution of all, or any of the powers by this Act given and granted; and this A& fhall be fufficient to indemnify the faid Company of Proprietors and their fervants, agents, and workmen, and all other perfons whomfoever, for what they, or any of them fhall do by virtue of the powers hereby granted.

XIII. And be it further enacted by the authority aforesaid, that it fhall be lawso much of the for the faid Company of Proprietors, in conftructing and making the faid Canal water of the river from Lachine as aforefaid, to the foot of the current of Saint Mary, to take and may by necessary appropriate for the use of the faid Canal, fo much of the land covered with the waters completing of the faid river Saint Lawrence, or of the bed thereof as may be found necessary

proches d'icelui, tels et autant de Ponts, Communications, Aqueducs, Ecluses, Pales, Vannes, Fontaines, Réfervoirs, Tranchées, Quais, Places de débarquement, Balancines, Grues, Engins ou autres machines et autres ouvrages, chemins et commodités, que la dite Compagnie des Propriétaires jugera néceffaires et convenables pour les fins de la dite navigation, et auffi de tems en tems, changer, réparer, raccommoder, élargir où aggrandir icelui ou aucune autre des commodités fufmentionnées, tant pour porter ou transporter des Effets, Marchandifes, Bois et autres chofes dans ou hors du dit Canal, que pour porter ou transporter toutes fortes de matériaux néceffaires pour faire, ériger, fournir, changer, réparer, raccommoder, élargir ou aggrandir les ouvrages de et appartenant à la dite navigation, et auffi de placer, metrre, travailler et manufacturer les dits matériaux fur les terreins proches de la place ou des places où l'on fe propofera de faire, ériger, réparer ou achever les dites ouvrages, et auffi de bâtir et conftruire les différentes vannes, ponts, ouvrages et édifices appartenant à celui, et auffi de faires entretenir, répareret changer toutes clôtures ou paffages fur, fous, ou à travers le dit Canal, ou les réfervours et communications, aqueducs, tranchées, paffages, égouts, cours d'eau et éclufes refpectivement, qui communiqueront à icelu, et auffi de faire, établir et appointer tels Chemins, Sentiers de Touage, Chauffées et voies convenables pour touer, haler ou tirer les Bateaux, Berges, Vailfeaux ou Radeaux paffant dans, par ou fur le dit Canal, tel que la dite Compagnie des Propriétaires le jugera convenable, et de conftruire, ériger et entretenir en bon état toutes digues, arches ou autres ouvrages dans, fur et à travers aucune Rivière ou Ruiffeau, pour faire, entretenir et réparer le dit Canal et les Sentiers de touage fur es bords d'icelui, et auffi de conftruire et faire tous les autres objets et chofes qu'ils ugeront néceffaires et convenables pour faire, exécuter, préferver, améliorer, comleter et employer le dit Canal, en conféquence de et fous la vrate intention de cet Acte, la dite Compagnie des Propriétaires faifant auffi peu de dommage que poffible ans l'exécution des divers pouvoirs qui lui font accordés par le préfent, et faifant atisfaction, de la manière ci-après mentionnée, pour tous dommages que pourroient ouffrir les Propriétaires ou occupants de telles terres, poffeffions ou héritages, aux, cours d'eau, Ruiffeaux ou Rivières respectivement, qui feront pris, employés, cés, détournés ou endommagés dans ou par l'exécution de tous ou aucun des pou. oirs donnés et accordés par cet Acte, et cet Acte fuffira pour indemnifer la dite ompagnie des Propriétaires et leurs ferviteurs, agens et ouvriers, et toutes autres rtonnes quelconques pour tout ce qu'eux ou aucun d'eux feront en vertu des Duvoirs accordés par cet A&c.

XIII. XIV. Provided always, and be it further enacted by the authority aforesaid, that make the intend the faid Company of Proprietors fhall and may make the faid intended Canal lands of any per- through, acrofs, or over the lands or grounds of any perfon or perfons whomfo shall have been ever, whofe name or names fhall appear to have been by mistake omitted in the take in the book faid book of reference, and where it fhall appear that inftead of the name or names of persons whose of the owner or owners of fuch lands or grounds, the name or names of fome other been substituted perfon or perfons to whom fuch laft mentioned lands and grounds do not belong, hath or have been inferted by mistake therein: Provided always, that the faid Com of Proprietors fhall give at least three weeks notice to the perfon or perlons poffeffing or occupying fuch lands or lots, of its intention of carrying the faid Canal through the faid lands or lots.

XV. Provided always, and be it further enacted by the authority aforesaid, that en for towing the land and ground to be taken and ufed for the faid Canal, the towing-paths, deed a certain ex- and the ditches, drains and fences to feparate any fuch towing-paths from the ad joining lands fhall not exceed forty yards in breadth, except in fuch places where the faid Canal fhall be raised higher, or cut more than five feet deeper than the prefent furface of the land, and in fuch places where it fhall be judged neceffary for boats and other veffels and rafts to turn, he or pafs each other, nor more than fixty-five yards in breadth, in any of those places, without the consent of the owner or owners of fuch land or ground refpectively under his, her, or their hand or hands in writ ing, first had or obtained, nor fhall any land or ground be set out, ascertained, contracted for and fold for the purpofe of making any navigable cut, trench or fluice, to convey goods or other things to or from the laid Canal, without fuch confent as aforesaid, any thing in this A&t contained to the contrary notwithstanding.

XVI.
